Hi To All,
I have thankfully been away from the immigration process for a while but spent many many hours here while going through the process of getting visas for my fiance (now wife) and children and finally permanent green cards without conditions. I am not sure if we would have made it without the help of the Visa Journey community. I will be forever grateful to the assistance we received here.
Now I unexpectedly find myself back here because I need some assistance and time is very short.
Just this morning I was told that my wife's very good friend has an interview at the embassy tomorrow morning and gee, "is there anything she should do to prepare?" Yikes! Thanks for the advance notice dear.
I gather that the petitioner (husband) is not terribly enthusiastic about having his wife join him but he apparently has started the process because it has gotten to the point where she has an interview scheduled.
Here is what I know:
- Her husband is a permanent resident (not a citizen). He has been in the US for approximately 8 years. There have been visits home to Colombia but not frequent and I do not think she has any documentation of those visits.
- She is in Colombia and has never been to the US.
- She has an interview tomorrow. Her husband is with her.
- She had a doctor's appointment this morning in Bogota.
- She is prepared with only a passport, whatever she received from the doctor this morning, and the interview appointment letter.
I know the answers to all my questions are here somewhere but candidly I do not have time to read through everything in time. I will review what I can but if anyone can provide some pertinent information and tips or links to the same I would appreciate it greatly!
Here are the questions that come to mind but I am sure there are some other things I should know about also.
- I assume her husband filed an I-130 but after that I get a little confused. Is she now going through the I-485 process or is she going through consular processing?
- If she got to the interview stage, was the affidavit of support already approved or is that evaluated during the interview?
- Where can I find a recent list of Bogota interview questions?
- Is there anything special she needs to be aware of regarding the interview?
- In the likely event that she does not have all the pieces of the puzzle assembled, will she be given a chance to correct deficiencies or is the interview her only shot?
- Does she need a DAS or police certificate (Certificado Judicial)? If so, is there any way to obtain it quickly? She is in Bogota now.

We received the coveted email notification today:
"On May 31, 2012, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283."

What happened when your conditional resident status 12 month extension granted with the I-797C NOA expired? Did they issue a new one?

My daughter is 13 and she did not get a seperate biometrics appointment letter, nor was she named on my letter. I called and asked and they reassured me that kids under 14 are not obliged to have their biometrics taken again although you still have to pay for it at the time of submitting the I-751. At my biometrics appointment I even checked with the officer there and he confirmed that it was not required. i hope this helps.

Do Dependents not receive biometric appointments? Wife and kids each received a NOA1 but only the wife has received a biometrics appointment letter.

Are any of you capable of looking up your case status on the USCIS website? We put our number in there and the computer cannot find us. We do have a receipt number from the NOA, and since we have not gotten the biometrics appointment we checked online. But nothing...
USCIS cannot find our receipt number from the NOA either.
We are good for another year with the NOA so I am not stressed out over this like I was with earlier steps.

Application was received at VSC on 8/24. NOA for spouse was dated 8/24 and we received it in the mail 8/27. NOA's for the children were not received but I assume they are in the mail. In any case, we were very glad to see the NOA because her greencard expires today. See? Procrastinating is never a problem.

Mr. Procrastinator here. Green cards expire 8/28.
Sent ROC package via Fedex on 8/23 to VSC. It was delivered the next morning. Now watching our checking account to see when the check clears.
Hopefully things will go smoothly and we will receive the NOA soon. Then I can relax and just wait for the process to run its course.

Things are beyond repair. That is why I was hoping that they could leave without their greencards... Oh well, they'll have to take their greencards with them.

I don't claim to be an expert, but I don't know why they need their green cards to return to Colombia. They will need their passports for the airline and for immigration in Colombia. I am not aware of a point in the process where they will need their green cards. Am I missing something?
If I were you I would try to keep the cards. It minimizes the chances that she or someone else enter the country later with the cards and you wind up supporting them for 10 years. You can't force her to leave the cards behind but if she is willing to do so, I would certainly let her. If by chance she has a change of heart and begs to come back, you can always send the cards to her.

Margarita and Daniela are going back to Colombia permanently. We've been having problems for quite a while, and Margarita doesn't want to try to work things out with me. I'm devestated, but hopefully this will be for the best. When they travel back to Colombia, do they need anything besides their Colombian passports? I assume they do not need their green cards because they do not plan to return to the US.

I am Sorry to hear that John. I know from experience that the transition can be difficult for everyone and sometimes it just doesn't work out.
You did not ask this question but if you are convinced she is not coming back, I suggest you get divorced before she goes. It might be difficult to accomplish it once she goes back and your options for the future will be very limited if you are not divorced.

We had our greencard interview this afternoon at 1:30. We had an interpreter with us as required since Bella is not fluent in English. The officer did not smile as he greeted us and I began to get a little nervous. However, by 1:45 he said that he was going to approve the AOS.
The interview consisted mostly of the standard questions although there were a few very personal and uncomfortable questions for Bella that I would have preferred the 10 year old did not hear. Other than that, everything was very routine. Out of the 20 lbs of documents I hauled in there, the only things he requested were the EAD's, AP's and passports. He also asked for the marriage certificate but then remembered that he already had an original. He placed a photo copy that I provided in his file and returned the original from the application to me.
The 20 minutes was taken up mostly by the standard questions regarding being a terrorist, communist, prostitute etc. There were no questions about the I-864 and he did not ask for any evidence of the relationship. He also did not ask why we waited almost a year from the marriage to file for AOS.
At one point he made a comment that the embassy had already done most of the work on the file so that may be why the K1's seem to go more quickly and are more likely to get transferred to California. He also said that he was able to do some of his work in advance of the interview because we had submitted an original marriage certificate.
As he was finishing up, I inquired if it was possible to get stamps in the passport. He asked if we needed to travel in the next two weeks and was obviously looking for justification to say yes. I began to explain that they needed to travel ASAP. Unfortunately the interpreter was on auto pilot and she simultaneously interpreted the question for Bella who said no. After kicking her I explained that if we could find flights Bella really needed to go to Colombia as soon as possible. He agreed to stamp the passports so only 78 days after I put the package in the mail they are now fully documented permanent residents!
I hated to part with the EAD cards for the kids because it is so funny to see a work authorization from the US government for a 2 year old. I wanted to keep them as mementos. I asked if we could keep them if he punched them to render them useless. He paused a moment and then said what the heck, and handed them to me without altering them.
All in all it was an easy process and other than having to pay $130 for the interpreter and spending hours preparing documents that were not used I have no complaints.
Here it what I learned:
- At least in one office it is still possible to get the stamp in the passport so it does not hurt to ask for it.
- Sending an original marriage certificate with the application may speed up the process a little
- Having an interpreter makes it very difficult to exert any control on the process since the conversation tends to flow from officer, to interpreter, to immigrant and then back to the officer. For me to get a word in required me to interrupt someone.

We had our interview today and were APPROVED!!! I will describe in more detail later when i'm at a computer.

Thank you for your advice! I also thought that the local office should know something, but I was wrong. I made an infopass appointment, and the lady said that she cannot get any information on the interview schedule. So she said I should just wait some time (and it took me 2.5 hours one way to get to my office)
I don't know what I should be doing, I am obviously behind everyone else's timelines by probably a couple of weeks at least.
Given that you have such a long drive for an infopass appointment I can understand why you would be reluctant to make another one. Hopefully Marry is correct and you will get your letter soon.

We had our interview at 8:30 am and by 8:35 am we were out the door with an "approved stamp", and "welcome to america" from the interviewer to my wife. He asked the standard 5 yes/no questions on the I-485 and asked if we still lived at the same address. Nothing else was asked. It was quick and easy!

I have to wonder though, why did they even bother to have an interview? If that is all the interview consists of it seems to be a huge inconvenience and expense for everyone.
Did USCIS already have evidence of your post marriage relationship? I know they have the K1 stuff, but did you send new relationship evidence when you submitted the 485?
Again, much congratulations. It must feel great to finally be finished with this process for a while!

As to me, I STILL DID NOT get my interview date. I am really worried and don't know what to do. I just hope that it wasn't lost in the mail and I am going to miss it because of that

It could be that your local office is overloaded and taking a long time to schedule appointments. On the other hand, if you do have an interview scheduled and the letter was lost, I think the only way to know is to make an infopass appointment and ask them. Apparently the local offices make the appointments but do not share the information with anyone else in USCIS. After trying for days to get someone at USCIS to correct their scheduling mistake (Bella and the kids scheduled for different days) we finally made an info pass appointment, made the long drive and got things straightened out quickly.

I got my EAD + AP Today in the mail!!!
I didn't bother to look through the rest of the mail and my husband 2 hours later went to throw out flyers and saw another letter!
My interview is set for Sep 21st!!
NERVOUS ALREADY!!!

Bella received an Employment Authorization Card with an expiration of August 2010 in the mail a few minutes ago.
I am off to the motor vehicle agency to see if they will accept the card as proof of her legal status and FINALLY let her apply for a drivers license.
We are also looking for a Spanish interpreter for the GC interview. The friend we were counting on does not seem eager to do it. I suspect she does not want to go within a 100 miles of a USCIS office.
The DMV accepted Josue's EAD as his legal presence but we also had to take a electric bill that was in both of his names to show his Virginia residency. I think they also used his SS card and passport as ID. They are so strict with all the requirements! But he was able to take the written test in Spanish and he understood enough English to do the driving part with a woman from there. His DL expires the day his EAD expires, but when he gets his GC they will extend it.
I hadn't even thought of an interpreter for the GC interview! Hopefully since we were transferred to CSC we won't have to worry about that. Where will your interview be?
The interview will be in Mt laurel, NJ and the instructions say that if the applicant does speak fluent English they must bring an interpreter.
We will also need to use utility bills in both names as well as other ID's and the EAD card. Bella had no drivers license in Colombia so she will only receive a 3 months learner's permit after she passes the written test in Spanish. After 3 months of driving with a licensed driver in the passenger seat she can take the driving test and drive alone. I think I am looking forward to that day more than she is. It will be such a relief not to be responsible for all the driving. It has been so difficult to get anything accomplished because it seems like every 10 minutes I need to take someone somewhere.

I don't know if it is for all local offices, but today my field office (Helena, MT) updated their processing times on USCIS website and now as of June 30, 2009 they are processing March-02 for I-485.
Did any of your local office dates get updated?
Our field office is Mt. laurel, NJ. They show that they are currently processing 485's from Feb 12, 2009. Given that our NOA1 date is June 19th and our interview is scheduled for Aug 28th, I assume the posted time frames are a little off. I don't know if this is an updated timeframe or not because I never looked at that information before today.
However, I do remember from our K1 days that they always post the date of the oldest application they are still processing. If they have a problem case that takes forever to adjudicate, it makes the timeframes look much worse than they really are.
Correction. I see that the information was last updated on June 30th so it is a month and half out of date.

I got my EAD in the mail but for some reason they put the WRONG date of birth on the card.I called their costumer service and they managed to make me more confuse than I wasbefore calling.She told me to send another I 765 application with the original card and some evidence that my DOB is the actual one and that I am eligible for EAD.They also have to determine if it's my error or theirs and depending on that I might have to pay again for I-765.
I got sooo mad and told her how come yesterday I was eligible and today I'm not and asked her if she expects me to send the whole application again and what will happen if they lose my EAD somehow.After a few minutes she changed the story and said I could just send one copy of EAD ,a new application for EAD and some evidence of my DOB.
Just wanted to share my experience with you.Hopefully nobody will have to deal with this.
I am so sorry to hear this. You must feel so frustrated! Hopefully they will get things straightened out quickly.

If they have gotten to the interview stage, have they passed the affidavit of support hurdle yet?
It is good news that she will have an opportunity to fill in any blanks. I suspect she does have any evidence with her to prove that their marriage is legitimate. Hopefully that will be the only thing she lacks and she will be able to provide it later.
As to the husband's lack of enthusiasm... well I am staying away from that one!
