  1. I apologise if this is in the wrong forum. My husband went through the AOS process after arriving in the US in Feb or March of 2020 (very lucky to have gotten in before lockdown ). With 2022 approaching, we are thinking about next year's condition removal process. 
     

    His Japanese passport is now expired and normally their embassy makes a stop in our state for people abroad to renew. Because of COVID, that is not happening. He would have to physically pick up at embassy or consulate. 
     

    I'm assuming it is, but does his passport need to be current for interview next year? With snow possible from late October it may be a rough drive. 

     

    Probably man more details than necessary, just looking for insight so everything goes smoothly. 

  2. In this climate with the politics around immigration and ICE conducting raids, I'm worried about my husband being able to prove he's able to be in the US legally. In other threads I've read that while USCIS is deciding a case you're free to be in the US, but does this update the I-94? Because that expires on August 11. We'll be sending the packet in this week. I'm assuming a NOA is enough proof, but I also know that it can take 30 days to receive anything that they've received the AOS.

     

    Probably overthinking the situation, but the visa in his passport is expired since it's past 3 months since the US embassy issued it and the I-94 will also end soon as well.

  3. My fiance has health insurance he bought in his home country and I have just moved back to the US now with him for our marriage. 

     

    We're now ready to file the AOS but I have not yet found a job and am worried about being uninsured. I would like to apply for Medicaid. 

     

    If we have a co-sponsor will it be OK? I know he cannot file for state benefits but I don't know whether I am or if it will hurt the immigration process. It is just a short term thing since I do plan on going through my job after I find one. It is just risky to be uninsured.

    Sorry, just scrolled up to see that you had your parents' Affidavit of Support. You also have to have your own, mostly to show that you've filed taxes since you were in Japan. Did you also fill out an Affidavit of Support? Were you missing your tax documents or your mother's? Hopefully it's an easy fix to get, but you may want to make sure you have more than necessary just to cover your bases. I believe the documents said you could need to attach up to 3 years worth, and I did that no matter what out of fear, so they got my last 3 years of taxes in copy form.

    Thank you for your reply. I actually didn't know that I needed my own---I only included my mother's and it had three years of W2s, but no tax transcripts. I think the tax transcript request was regarding the one submitted as I asked the interviewer and he said the W2's alone were not enough now with a new rule change or something. I feel like the best course of action now is just submit what they specifically asked for versus filling one out for myself... I feel like it could bring more opportunities for extra document requests than it would be worth. Or am I wrong?

  5. Very disappointing results from interview today, I accidentally missed the tax transcripts for Affidavit. 

     

    And the interviewer also said it seems like I (petitioner) did not have plans to change domicile back to US. 

     

    I was at embassy with my fiance so after he got the denial I went up myself and asked about it. They still have his passport and we have to send doc's. 

     

    So depressed

    Thank you, I've got little less than four weeks so I gotta get on that. 

     

    Appreciate the input. We've got police report and medical check done so it's kind of the last thing on our to do list. 

  7. So for the Affidavit of Support is it ok for my mother (the sponsor) to email all the files and I print them out? Asking primarily because of the signature one the form itself. Is it ok to be a photocopy? Or should I have it express mailed to Japan?

  9. My fiance has his interview scheduled for the first Monday in March! I'm pretty happy.

     

    Working with my mother to get the AOS filled out. Does my fiance need a copy of his bank records too or does that not matter? Seems like it is probably going to be 10,000 to request those statements from the bank.

     

    The health check set us back 48,000 because he needed a vaccination as well. Ouch.

  10. I just want to make sure I'm doing everything right, so if I can get some opinions that would be great.

     

    • Specific U.S. travel plans

    Should this be 'Yes'? Technically they don't encourage people buying tickets before visa is issued, but obviously he would like to go as soon as possible.

     

    • Are there other persons traveling with you?

    I will be traveling with traveling with my foreign fiance, but I'm assuming he should check 'No' because it seems like it's geared more towards non-US citizens traveling along.

     

    • Fiance's Address

    This would be my information, but should it be my current Japanese address or should I use my family's home address where we will be staying after arrival?

I ask because this is not a requirement of the I-129F (they determine if the relationship is bona fide at the interview). They likely asked for evidence of meeting within the past 2 years and/or letters of intent to marry.

    I apologize, yes it was the meeting requirement.

    I had three photos when I sent it in (and a fourth which had the date, but it fell out of the 2 year period). But I didn't write the date or location on the back. When I sent in the RFE materials I wrote location and also an explanation of each regarding where it was taken, etc. I also included copies of chats with family members and friends that talked about physically meeting my fiance (such as what we did to celebrate Christmas, birthdays). Also included copy of my Japanese residence card to prove my residence here.

     

    Thank you for the quick replies... looks like I have a long time at the convenience store copy machine to look forward to 😛 Really hoping we can wrap this up by Dec 31st because if I'm here Jan 1 I have to pay Japanese taxes...

  13. Hi everyone.

     

    After eight months of waiting I was disappointed to receive an RFE requiring more proof of my relationship with my fiance (we both live in Japan and have been together for about 3 years, I am a long term resident looking to come back home). I sent back a packet of proof I compiled, again hopeful that this would get us to the NOA2 stage.

     

    Unfortunately I got back another RFE, this time because I "submitted no proof of US citizenship". This is actually false because I included an original (not copy) birth certificate in my original filing. I knew that this would not be returned to me, but my parents had an extra one so it was fine.

     

    The RFE makes no mention that it was submitted in the original filing, whereas my first RFE said what I had submitted was not dated and not sufficient proof. In the RFE letter it says that they want "a birth certificate registered and issues by a civil authority that shows birth in the United States. The birth certificate should contain the child's name, date and place of birth, and parents names, doctor's name, hospital name ... etc.

     

    After reviewing the photocopy of my birth certificate it does not contain doctor or hospital information--but after checking online I don't see any example of Minnesota birth certificates including that information. Did they lose my cert or was it rejected because it wasn't enough?

     

    I have two options

    • Resubmit same birth certificate, this time just a photocopy of front/back (back is blank)
    • Submit passport copy; this is problematic however because I have a new 90 page passport and I believe you have to copy EVERY. SINGLE. PAGE. which seems like a waste of time and money. Am I wrong about this? Is it enough to just photocopy front page?

     

    Likely I will submit both, but not if I have to copy every page of my mostly blank passport. Please advise VJ family :(

    Photos are secondary evidence. Putting a verifiable date to a photo is quite difficult (and jut a timestamp on one can be very easily forged). They are best used with other evidence to nail down the time.

    The residence cards would be good to include to show that you were living in the same country as her within the past 2 years.

    The screenshots are fine to include, but again aren't verifiable evidence. Anybody can say they met even if they didn't actually do so. Remember that USCIS IOs are looking for fraud.

     

    Credit card receipts (I know...credit cards aren't as common in Japan vs the US!), hotel and other receipts, the movie tickets, etc. are good to include since they should show a date and location, which I'm assuming would be fairly near where she lives.

    Did you use a JR pass? Hmm..probably not since I think you can't if you're a resident there, but it's worth asking. :P Any other train/shinkansen tickets?

    The receipts we have are mostly from email so they'll be printed out and I don't feel like that is going to look overly professional. I do have a credit card and I will check if there is anything I bought that could be used to back up our claims. 

  15. First, thank you to everyone on this forum who helped me get this far. I only joined last night, but I've been reading since I started the process. 

     

    I got our NOA1 back in Jan 2018, but at the the end of August I ultimately received an RFE

     

    It said that the photos provided were not dated and the one that was fell outside of the 2 year mark. As frustrating as an RFE is, I can see that I should have been more thoughtful when compiling evidence. 

     

    I currently live in Japan and have been living here for just under 8 years. There aren't any particular passport stamps for me that are relevant because my fiancé and I have never gone on an international trip together. Here is the proof I'm thinking to send in:

     

    -  Photos, probably same ones, along with screenshots from my iPhone's photo app in which the photo and date taken are visible. I will also add a written account of the photo

    - Copies of my residence cards showing I was living in the country in 2016 and 2017 (although my address is in Japan so I don't know if they doubt I'm living there...)

    - Screenshots of chats (Facebook, LINE, Etc) that mention seeing my fiancé

     

    Things I've been mulling over:

    - Movie ticket receipts, but there's obviously no name and no proof that we were the ones who used the two tickets. 

     

    Would enjoy any advice or comments you have about this situation! Thank you!

     

    EDIT: My sister is giving birth in December and it would really be amazing to be back in the country by then, or at least by Dec 31. Do you think that if the application is accepted theres any possibility the we'll be able to get a visa to fly back by then?
