  1. Good afternoon, 

    Hoping to get some insight regarding the scheduling of the I-751 interview. My wife's case status was updated to "Case Is Ready To Be Scheduled For An Interview" about a month ago. Heard reports that cases can be in this status for up to a year or longer. Is this true? I know for her CR-1 application was in "ready for interview" to being scheduled in less than a month I feel like. 
     

    Side note: My wife will have been a PR for the 3 year requirement next month. Is she eligible to apply for citizenship while her I-751 is still pending? Or do we need to wait for that to be approved and closed out before we can submit the paperwork to begin the citizenship process?


    Any insight would be a huge help!
     

  2. My wife's documents were accepted by the NVC in June. On August 10th we received notification that her interview was on Sept 4th. She was approved and her passport was back in her hands on Sept 7th. Crossed POE on Sept 9th. 

    It is completely frustrating. 502 days from I-130 submission until she became a resident. The "idk", or "I have no information to share with you at this time" from USCIS, NVC, and the embassy is enough to make anyone crazy. Just remember the end goal. It will be worth it, no matter what the wait is.

    You are correct in your assumption @NikLR

    I appreciate everyone's input. Our lawyer was less than helpful throughout the 500+ days from start to finish. REALLY wish I had found this forum sooner. Oh well!!

    Time to become an international tax expert. Dang exchange rates make it very unappealing for her to continue to work for her Canadian employer to begin with!

  4. Hey all, 

    Searched prior questions and did not see this one. My wife became a resident of the US as of YESTERDAY! She still plans to work at her current job in Windsor, Ontario and commutes from our house in Michigan. 

    When she crosses into Canada, she should still show her biographics page in her Canadian Passport and then show her Visa page when crossing back into the US correct? (and then show her green card in addition to this Visa page once it arrives in a couple months)?

  5. My wife and I became documentary qualified on June 8th. We received notification that her interview was scheduled for Sept 4th on August 10th (1 month ago today) in Montreal for her CR-1. 

    Her interview went well and the passport was mailed the next day. So she actually crossed in this weekend with her visa! From  our priority date in April, 2017, start to finish, 501 days. 

    Montreal from what I am told only schedules their interviews once a month. We got ours on this day in August, so Im crossing my fingers that you hear back this week for an October interview date. 

  6. @NikLR Thank you!  Her visa is a CR-1. Missed a letter there. We got married in Jan-2017. As she was living and working in Canada, we were advised that she and I should have filed as single for our 2017 taxes earlier this year. Was this the wrong call? 

    We will obviously be filing as married now that she moves over based on the feedback here. Was pretty sure that was the case, but wanted confirmation. 

    I actually set up a complementary consultation with Serbinski for next week to ensure we do everything we need to after she moves. Thanks for the heads up for her employer changing her tax status to non-resident. This was exactly why I asked. Did not want to wait until tax time before asking questions. 


    Out of curiosity, do you know what Serbinski will/would charge if and when we utilized their services for filing her US and Canadian taxes?

  7. My wife currently works in Windsor, Ontario. I live in Detroit Michigan (1 mile from Windsor). We plan to have her continue to work in Windsor when she moves next week. I am curious as to how income taxation will work. Should I still file as single? Shes ultimately going to have to pay taxes in both Canada and the US. 

    Several tax professionals that I have called seemed to be uncertain in their responses, and it makes me question if I should use their services or not!

  8. My wife's CR-1 Interview in Montreal was approved on Tuesday and her passport is in the mail. We plan to move her this weekend from Windsor, ON to Detroit, MI. 

    Have heard rumors that you are required to move all belongings in one shot and that during this one shot, duties will not be assessed. Is there any truth to this? Or are we able to move her stuff in spurts?  We have the required information to import her vehicle, but I am curious about what happens when we go to sell it. Will we be able to sell this back in Windsor as its a canadian vehicle with km/hr ect? 

    The other question I was hoping someone could help answer is regarding all of the documents she will need to apply for once over and the order in which to do them. We completed the electronic DS-260 for the NVC, which according to the Social Security website, means that her SSN will automatically be processed and mailed to the address we put onto the DS-260, is this correct? I know she can't apply for really anything else like a license ect without that SSN.
