  1. Thanks to everyone. Really appreciate your help.

I didn't know about H2B visa. That might be a good way for some people. Still not for us, here is why:

    1. You have to find an employer who will sponsor your visa which is not easy. Found some messages on another forum where some person send resume to many companies (he said a hundred) and nobody want to do that for truck drivers. I personally was talking with 3 companies last year and they told me here is no way to work for him as a truck driver. Probably just do not want to do it. Still probably possible if find the company but not for us (see #2).

    2. I've checked here https://www.uscis.gov/working-united-states/temporary-workers/h-2b-temporary-non-agricultural-workers and found that H2B only for qualified countries and our country (Kazakhstan) is not in the list.

So, will think about re-entry permit or more often visits during 2 years of waiting.

There is actually some form of one, I am not sure exactly what it is but I know someone who regularly spends 6 months a year driving trucks here. Makes a lot of $$$ to take home, enough to live on for the other 6 months over there.

Of course you’re spending the time driving trucks all over the country and not at “home” anyway.

I think this is kind of illegal way when people work with tourist visa. I didn't hear anything about work visa for truck driver.

I don't care about money or job for them for 2 years. I will support them for that period.

  3. Thanks WeGuyGal,

Yes, I told them about worst scenario (to leave separately for 2 years). They do not want to do it. So, the other option is to live like about 6 months here/6 months there for 2 years. If He will not be allowed to get here in this period on his tourist visa (I would like to know it in advance) will do re-entry permit for my mom.

Just checking for fastest and best way.

  4. Hi everyone.

I got few questions, cannot find any information about it (specially first one). My mom will get a LPR status soon and she needs to file petition for her husband (my stepfather, I cannot file petition for him). We would like to do it as soon as it possible to shorter time when they cannot live together here. Here is my questions:

    1. When she will arrive in the Airport she will get a stamp in her passport. Do we have to wait her Green Card and SSN to file petition or the stamp is enough and we do not need SSN? Can we file petition right in the first day? Any experience?

    2. He has a visitor visa and would like to come with her for couple months while they do petition. Then they are planning to go back to stay together. Does it going to be a problem for him to cross the border with his wife who becomes a LPR? He was in U.S. for 4 times already,  each time for 2 months.

    3. Just wonder if here is any LEGAL way (no any illegal ways accepted) for him to stay here for 2 years while his visa will be current. Just to stay with the family, no work permit or something else. I was thinking about F1 visa to study English (he will need it anyway), but he is about 50 years old with High School Degree and I do not think his F1 visa will be approved (specially if his wife is LPR).

    Thanks for recommendations.

Wondering what the deal was with the police certificate. You uploaded it, but said it was not required ?!

My mom was living in another country for 3 years. So, in CEAC we had 2 items to upload Police Certificates (two countries). We uploaded both.

NVC actually accepted both! But sent me the message "The police certificate required for [SECOND COUNTRY NAME] is not needed in order for the interview to be scheduled. However, the police certificate must be obtained and submitted before the visa interview". Also this certificate had similar message in "Note" section. Have no idea why they put that message if I have it already. For me it sounds like "You do not have it, that's OK for now but obtain it before your interview" :)

  6. Well. seems like I've got some good news.

    Just received this email:

Notice regarding your Immigrant Visa Case becoming Documentarily Qualified

    Dear [Beneficiary's name],

The National Visa Center (NVC) received all of the fees, forms, and documents that are required prior to attending an immigrant visa interview at a U.S. Embassy/Consulate General overseas.

NVC will work with the U.S. Embassy/Consulate General in ALMATY, KAZ to schedule an interview appointment for you. Once we have confirmed an interview date, we will send a notice to you, your petitioner and attorney (if applicable).

Please do NOT make any travel arrangements, sell property, or give up employment until you have received an immigrant visa from the U.S. Embassy/Consulate General.

The U.S. Embassy/Consulate General may require additional documentation at the time of the interview. Please visit https://nvc.state.gov/interview for information about immigrant visa interviews.

But what I am worried about is CEAC show that my wife's docs Submitted (not Accepted). I've attached the file.

Actually she has no any income. I just added her to make sure I will be approved from the first time. Probably they just skipped her when saw I have enough income.

One more thing. In the message center I have a message:

    Quote

The police certificate required for [SECOND COUNTRY NAME] is not needed in order for the interview to be scheduled. However, the police certificate must be obtained and submitted before the visa interview. For information regarding an acceptable police certificate, please use our Document Finder at https://nvc.state.gov/find.

But they had a separate item for that certificate and I uploaded it at the same time I did all other documents :) No problem just will bring it to the interview.

Well, hope everything is OK and the interview will be scheduled soon :)

Willcrack, you are a week behind, so probably will be reviewed in a week!
