  1. If anyone out there has had this same problem, or something like it, PLEASE ADVISE. There was additional information needed for my I-129 application, and I was given a date to have the information returned. I sent the information, before the due date as requested, and my I-129 was denied stating I did not send the information. I do not have the letter of denial here in Colombia. I am waiting for my roommate to fax/mail it to me.

    WHAT DO I DO NOW? :help:

    I am currently living in Colombia with my wife, and am waiting here for her interview at the embassy in Bogota. We are waiting for package #3 to arrive.

    Hello everybody,

    I have been married for 3 years and a half and I already have my green card. I never changed my name (I still use my maiden name) but I want to do it now.

    The question is this: Can my maiden name become my new middle name? I called USCIS customer service and they said NO. According to the CSR, marriage only changes your last name, not your middle name. So if I am Ana Maria Perez, I have to become Ana Maria Smith. But I want to be Ana Perez Smith.

    The CRS answer seem odd too me (hello, Hillary Rodman Clinton). I called Social Security Administration and they said I can indeed replace my original middle name with my maiden name.

    Any experiences? I am going to e-file the petition. I will have to show the proper documentation (my marriage certificate) at my district office. Do you think there will be any problem?

  3. Well, in looking at "Now That You Are a Permanent Resident" it seems that if a resident is abroad less than a year, there is no problem upon reentry to the U.S. Has anyone experienced otherwise? I can't find anything to the contrary in the pinned section of this forum.

    "International Travel

    A Permanent Resident of the United States can travel freely outside of the US. A passport from the country of citizenship is normally all that is needed. To reenter the US a Permanent Resident normally needs to present the green card (Permanent Resident Card, Form I-551) for readmission. A reentry permit is needed for reentry for trips greater than one year but less than two years in duration."

    My boss and good friend and his wife were out of the country together for over a year in Aruba. They had some minor issues but nothing major.

  4. Hi there, we applied june 06, i130 and i485...... the case status still says that they are sitting at the MISSOURI SERVICE CENTER...... the case was last touched 11/18/06... so its not like they forgot about it.... the processing time for MISSOURI SERVICE CENTER doesnt show i130 or i485....

    is this normal? shouldnt they have been moved to the california service center?

    MARRIAGE based I-485 timelines are not reported anywhere by USCIS.

  5. ok.. here is what is in the letter

    Based on the documents submitted with form I-864 affidavit of suport and the information provided on form I-864, the petitioner's or substitute sponsor's income for the last tax year and /or current income does not meet

    125 % of the poverty line for the household size calculated on form I-864. Submit proof that the petitioner's household income meets or exceeds 125 % of the federal poverty line for the household size provided on form I-864.

    Send them what they asked for...no more, no less. You state that you are well above the minimum requirements. Resend the information. I was rfe's for two items. One was for not completing section seven of the affidavid of support ( the instructions clearly stated that it was not required) and the other was for a birth certificate that was included in the original submission.

    Personally, I think it is a tactic to manipulate their numbers and timelines to take the heat off of them.

    We had our Interview today in the NYC office in Federal Plaza. We got there around 9:15am for our 9:45 appointment. We were called in around 11 and it was over by 1130 but no approval....

    I was a nervous wreck at first!!! We were sworn in and the officer asked for birth certificates, passports and marriage license. The first question she asked was for Peters full name and address. Then she asked me for Peter's birthday and I blanked out. I don't know why but I blanked....but i said it stumbling through....

    She asked a bunch of questions, how we met, who initiated the relationship, what do we like to do on the weekends, about each others parents (names, have we both met the other's parents, etc.). She even asked Peter what was my address prior to our current one, he couldn't remember the address itself but the city and described the location. When did we have our last fight, what was the first thing I noticed about Peter. She looked at pictures and asked Peter who one of the girls was and he got that right. She then asked me about a picture of Peter with one of his friends. She also took two pictures of us (one from the wedding and one from NYE). She asked Peter about the picture from NYE. She also asked Peter where was the last time I went out of the country and where. He answered the location right but missed on the year.

    Then here is where it got a little hairy...She asked Peter what did I do for a living and he didn't know the name of the company......Well I was unemployed for a lil bit and I have my own consulting company. I just got a job at a dance studio and started last week (so no paystubs or letter from employer). I did however bring all my W-2s and paystubs for my company... She didn't say whether or not she needed anything else.

    Then she asked for proof of joint documents. Peter has no driver's license or Social Security number. He was just approved for the EAD 3 1/2 weeks ago and once we received the card we went straight to the SS Office to get his card. Social security said that would take 4 weeks. I own a Co-Op and I can't put him on my deed or my monthly maintaince bill because they have to do a credit check on him. The bank told me no ID or Social Security Number no joint account, even Cablevision requires a social security number or Driver's License to add him to my account. The only thing I was able to put Peter on was my credit card. I explained this to the officer and backed it up with documentation showing what was required to add him to my accounts.

    She took Peter's passport and wrote I-485 still pending and said she had to review the file before she can make a decision. IS THIS REALLY BAD???? I am so scared that we are going to be denied. If we are denied can we appeal???

    If they ultimately deny you, they have to have a reason. Once you have that reason...you can work on overcoming the problem. She didn't ask for any additional material. There are a thousand possibilities for her actions, one being she was inexperienced and needs to consult with someone about her own insecurities and questions.

    Ultimately you just have to wait and see. It can be nerve wracking.

    Could you please tell me more info about Adjsutment of Status?

    My I-94 expires already but we got married before it was expired. My visa expires next month which is less than 2 weeks and we just submit our application for AOS.

    What is the status then of our application for AOS if I applied and/or submitted after my I-94 expires but not my legal stay?

    I would definately do it as soon as practical. However six months and one year are important milestones I would avoid at all cost.

  8. Hi everyone,

    I tried to search timelines, etc but couldn't find what i needed to. We've been waiting since Jan. 2005 for our AOS and other things. Has anyone else been waiting since 2005 for their AOS and their interview? We were called for a Feb. 1 interview which was then cancelled.

    Besides the name check possibility any other theories as to what is going on? The 1-800 folks have taken 2 inquiry calls and no one has bothered to respond. We also wrote to USCIS (snail mail) and AGAIN nothing.

    I tried the Senator route and that also didn't help. I'm running out of options. I scheduled an infopass for this week but I feel that again we will be given no information.

  9. You could always make an infopass appointment at your local office and enqire there as to your case....

    In my case...I phoned and after discussing it at length "we" arrived at this conclusion. The "expected" processing times for marriage based AOS in ALL areas is six months. As I was six months plus about a week the person on the misinformation line agreed to make a service request. That has been about a week. She indicated that I should get an update within a month.

    I just got back from China with the form signed and her passport, so I just need to get my W2's from last year and I'll be set. She only made, like, $2500 or less all year, so I don't think I'm going to burden myself with getting proof of that unless the guys in black jackets show up at the door one day. :oops:

    I did the same thing for tax year 2003. My wife was working in Colombia and had no verifiable income. It has not been an issue to date.

  11. I was in the same position , my Wife and Stepdaughter are Colombian and the Colombian law requires a written letter , certified either by your consulate or as we did with a "Notario". Every time your Stepdaughter goes back to Colombia , she needs a new letter.

    I have read accounts of iterviews together and separate. So apparently it is at the discretion of the interviewer.

  13. We have been to the DMV 5 times now, every time needing something else,

    and then finally the last time they said too much time had passed on our original K1 visa

    and that we were now less than 61 days to its expiration and because of

    that they wont give my wife her permit license, she doesnt have international drivers license

    so she is really stuck at home while I am at work all day

    We today have gotten first NOA "receipt" I-797C from our AOS package,

    is this what the DMV needs or do we have to wait for yet another letter

    regarding our AOS indicating NOA "approval" rather than just "reciept" ?

    and if so how long after receipt does that sometimes take others?

    It can be very frustrating. In Louisiana, I had to research the law and teach the DMV the law. It varies from state to state. The New Jersy on line DMV does not detail your requirements. Be patient and persistant.

    I am in the process of filling out the G-325A for myself (a USC).

    I have been naturalized and wanted to know if I still need to put in my old "A" number.

    Also, when it asks for address outside of the US for more than a year, do I put my address from the Philippines when I was 4 years old? That was a long time ago.

  15. Um...ever consider calling the number and seeing what address they have on file? There are other reasons for mail being undeliverable as well.

    I went on a month long vacation and my nephew did not pick up the mail everyday and the box got full and I had an NOA returned as undeliverable.

    I know of several other things it COULD be. I would check with the local postmaster and call the number given.

    We check our mail everyday!

    We have already recieved mail from CIS before it was transfered to CSC.

    Bu we never recieved anything from CSC confirming the transfer!!!

    I know they have it because its been touched several times.

    How can they not have our correct address??

  16. Can you submit the passport instead of a notarized copy? My husband lives far from the Embassy so it would a lot easier to have him send it to me? And if so do I attach it to the 2006 tax return or can I apply for the ITIN in advance?

    The intructions state that you can attach it to the return. I got mine notarized at the embassy in Bogota ahead of time. The instructions also state that you can get it ahead of time.====> http://www.irs.gov/pub/irs-pdf/fw7.pdf

    Since the interview came well after your I-130 was submitted and approved, pray tell how did your presence at the interview suffice as evidence of a bona fide marriage for the I-130?

    Note also that when you submitted your I-130 the USCIS was not asking for evidence that the marriage was bona fide. They were asking only for evidence that a marriage existed, for which a marriage certificate - not license - is quite adequate.

    Thing is... we have been married for 3 and a half weeks. We got to live together for 2. How is that going to be considered proof of an ongoing marital relationship?? And the only people who got to see us married are in the UK.

    He cant even come see me!

    I used a marriage license and my presence at the interview. It sufficed.

    The OP indicates filing for a K-3. That is the interview I was refering to. The I-130 wasn't approved for another 14 months.

  18. I sent my I-485 package by Priority Mail with Delivery Confirmation from Seattle on January 16th. Nothing in USPS website about being delvered yet and my checks have not been cashed. This is the 9th day and that seems to be on the long side after checking all the timelines. Anyone else have the same problem?

    I had a similar experience. I don't remember the exact times but it took a long time to cash the check and a very long time to get the return receipt requested card. Maybe ten days to cash the check and six weeks for the card. The first indication for me was the clearing of the check online.
