  2. Hi, my fiancee just went to her interview and they told her that we did not meet the requirements for the i-134. I don't make enough at all but we had a second form from a joint sponsor who makes about 21k which I thought met the requirements according to what I found online. https://mypathtocitizenship.com/income-requirement-affidavit-support-form-134/ (He has no dependents). However, the embassy said that we did not meet the requirements and needed a sponsor that has assets such as a house and a car. I still unsure exactly what requirements need to be met and why ours wasn't enough?  

  3. For the I-134 once I am finished signing it and everything can I scan it and email the scanned document to my fiancee and she print them out? Or do they need to be the original copies?

     

    Also, for the supporting evidence for the I-134, it says that I need 

    • A signed statement from an officer of the bank or other financial institution that states when you opened an account, the total amount deposited for the past year, and the present balance of such account
    • A signed statement from your employer on business letterhead that states the date and nature of your employment, salary paid, and whether the position is temporary or permanent

     

    Do I need both of these or will the employer statement be okay? I assumed that the bank statement was only for if you're using assets to meet the finical requirements but I want to be sure.

    I heavily recommend a second job, not only to meet the requirements, but for your own financial security for when your fiance comes. A second job shouldn't be to hard as 26 hours a week isn't much in the whole scheme of things.

    Do you live home alone? At home with family? Have room mates? Going to school?

    The entirety of your living situation, along with your financials can affect the decision.

    I'm in college and am currently staying with family to save up money. 

  5. I just recently started a full time job and even with it I don't think I make enough to meet the requirements. I asked my uncle for help months ago when we submitted the initial petition and he said he would think about it and get back to me. He finally responded today and said no. I'm running out of time and idk what to do. Our petition was approved and I still don't have a cosponsor. I just want to be with the one I love why does this have to be so difficult. 😓

  6. My fiancee first visited me for a month this past May 28 to June 29. We submitted our application for the petition for alien fiance and it was received July 19. My fiancee plans to come to visit me in again September 13 and stay for about 3 months until December 4. Would staying that long that soon after the first visit and during the k1 process be okay? Do you think she could have any problems coming back into the US? Thank you.

    Expect increased scrutiny of immigrant intent with a USC fiance and pending petition but visiting is absolutely permitted. The more face time together, the better.

    Agree, visiting was never a problem. My fiance has an ESTA which permitted him to very easily cross the border without scrutiny. We did 6 trips back and forth each. He was just always was asked when he will be returning. I'm not sure if the time frame will just enter into more questions, which I can see being a possibility, but as long as your fiance can prove their intent to return back to their country there shouldn't be an issue.

    I visited my fiancé on my ESTA whilst we was waiting on NOA2, make sure you have a return flight, proof of ties ie. letter from employer stating your expected to return to work after your trip, any proof of renting etc. - i also took a copy of my NOA1 letter that my fiancé received in the post.. i was asked at border patrol "what was the purpose of my visit?" i replied "visiting my fiancé" to which he replied "are you planning on moving here?" i replied "yes, we are in the process of a K1 fiance visa" he said "okay great" no proof was requested but i felt better knowing i had proof of ties and the copy of NOA1 to show we are going through the legal process. Just my experience, i cant guarantee you will be allowed as said above but i read alot of reassuring threads around the forum about visiting.

     

    Would the time be a problem? She stayed with me for one month and now she's coming again for another 3. The first visit was May-June and now Sep-Dec.

    Okay thank you so much for all your help! I was also wondering if we needed to stay in the same state for the entire process?

    Yes, you can file, the I-129F before meeting the income requirements. A co sponsor may be needed by the time of the interview, or you may have sufficient income by that time.

     

    If you are employed, your current income is best displayed via your pay stubs and an employment letter. If you are self-employed or earn other types of income, the tax returns would be the go-to source for current income evidence. You can also use assets in lieu of (or conjunction with) income, but at a 3x rate (technically 5x but many COs tend to go by the 3x rate used for a spouse with a K-1 visa application).

     

    That said, there are a small handful of embassies that are more strict on the Affidavit of Support requirements where they prefer to see a longer period of employment/sufficient income. What embassy or consulate are you going through?

     

    The CO makes the final call on the public charge concern based on the totality of the circumstances (not just minimums).

    Keep in mind that even if you have a co sponsor for the K-1, it's not cheap to do marry, do AOS, etc. while not having a job or starting a new job. And your partner won't be able to work for ~3-6 months after marrying and filing for AOS. This isn't to discourage you, but be aware of the upcoming costs and circumstances...the K-1 is only the first step in a much longer process (immigration or otherwise).
