  1. Hello everyone!

     

    I filed for ROC around early/mid-November 2020, about two weeks before the expiration of my resident card. With this package, I submitted a check for $760. The new amount listed here https://www.govinfo.gov/content/pkg/FR-2020-08-03/pdf/2020-16389.pdf (page 4, near the bottom) which I assumed was in effect. I now realize I should have sent two checks for the fee listed on the i-751 page, one for the $565 filing fee and one for the $85 biometrics fee.

     

    Of course, I only have realized this after receiving a NOA rejection notice just today. It lists the reason for rejection due to 'the payment amount is incorrect, or has not been provided', along with my original check stapled to the notice. Underneath the NOA is also a green sheet of paper explaining that 'your rejected benefit request will not retain a filing date. You may submit your benefit request as a new filing if you are able to correct the issue that caused the rejection.' This green sheet also says 'if you do submit your benefit request again, please enclose this letter with your submission.' Additionally, the green sheet underneath the NOA also says:

     

    'If you do file the benefit request again, please note the following:

     

    -Since your submission was rejected, it is not yet considered properly filed.

    -You must meet all requirements as of the date of the new filing.

    -Please review the relevant form instructions to determine if your new filing can be considered as timely filed.'

     

    I'd like to add that my entire package (minus the cover letter) has been sent back to me with the NOA. I notice that each page of the application and my supporting documentation is stamped with a long chain of digits and a name at the end. The original USPS mail package was also photocopied by the caseworker and attached to the back of my package. They sent me back the clippings of the original USPS mail package that they cut up to photocopy, as well as the sticky notes I used to separate each section of my ROC, except they are now bundled and stapled together with the USPS clippings.

     

    So, I know that I need to 'resubmit the application/petition package with the appropriate fees, and include all required supporting documentation' (as stated by the NOA). However, I just have some questions retaining to how exactly I should go about resubmitting the ROC:

     

     

    1. Can I write the new checks, remove the old check, and resubmit the package they sent back to me (with the NOA)?
    2. Do I need to include a new cover letter, explaining that I have included the corrected payment amount?
    3. Because my resident card expired in November 2020, do I need to include a letter of explanation as to why my package is technically being filed late?

    1) On the notice that we got from USCIS, we are asked to bring in several items that we already submitted in our original application package.

    For example, the notice asks for "A completed Affidavit(s) of Support (Form I-864) with all required evidence, including the following, for each of your sponsors (unless already submitted)......"

    We are planning to bring any new documents that we have got from the time of application up to now, for example, pay stubs, letters of employment, our latest tax returns, latest tax returns from our sponsor. Should we fill out the I-864s and bring all the documents we've already given them one more time? 

     

    2) I got the medical exam done in May 2017, which was less than two years ago. It seems that the law has changed regarding the exam and now it remains valid for two years.

    I just want to make sure that is the case and I do not have to pay for the exam to be done again?

    You don't need to fill out another I-864. I brought the latest tax year documents with me and my interviewer never asked to see them, but I would assume its all dependent on your specific case and the interviewer you get. I would bring updated information just in case they want to see more proof that your sponsor is financially able to support you. So latest tax returns with W2s or 1099s, as well as pay stubs etc.

     

    If you already submitted a letter of employment from your sponsor, and the latest tax returns and pay stubs both show that they are still working at the same job I doubt you'd need another letter of employment. I would think that if circumstances changed with your sponsor's job, you'd need to bring one to show that they are employed. I never submitted a letter of employment and didn't bring one to the interview either, and the interviewer never asked.

     

    You should bring all the documents you submitted with your case. When I submitted my package I made 2 copies of each form and filled each out by hand, so for the I-864 I had 2 copies and sent one with the package. I brought the other with me to the interview. The interviewer never asked for it, but I was paranoid because it seemed like I needed to take it with me. I don't think you need to as the interviewer already has your forms neatly set out in a folder.

     

    At the interview regarding evidence, they mainly asked for more photos, recent bank statements with both your names on them, any other things you share with your spouse like insurance etc. But that was specific for my case, so I would suggest bringing any updated supporting evidence for the I-864 (if employment circumstances have changed) as well as the most recent tax returns and related documents just in case.

     

    Regarding the medical exam, I'm not sure sorry. I had mine done fairly close to the interview and brought it with me.

    Current case status on I-485 on USCIS website says:

    "At this time USCIS cannot provide you with information for your case. Please contact the USCIS Contact Center at 1-800-375-5283 for additional information."

     

    So that's my timeline thus far. Any ideas on the USCIS case status message? I saw a different message previously, something to do with my forms being transferred to my local office (Manhattan) so perhaps things are moving along...

    Update: called the number and the automated voice said that my case was ready to be scheduled for an interview. Pretty sure this is what my case status said online before, but who knows why it changed to "unable to provide information". Did a quick Google and most were saying it's just a glitch or something. 👍
