  1. I did actually get a decision on the I-290B, this was before the status on my account changed to denied and closed.
  2. Sorry, I should have mentioned that my case on USCIS has been changed to denied on January 7th and to case closed. However, I haven't had any documentation about the second denial. I just wondered if they will send me a confirmation letter or maybe they don't bother.
  3. Just an update, I still haven't had a new denial as of yet and it's not on my USCIS account either. Perhaps they just uphold the original denial but I would have thought they should explain why I was denied again, why my new evidence was unsuccessful?
  4. I was really hopeful when I got the letter stating that my case has been reopened again as there was enough evidence to do so. Then about a week later is denied.
  5. Yes, I looked through all the tabs and there is no denial document for this new decision, just the original denial.
  6. I came on a K1 visa and married within the timescale of the visa. The first denial letter said that I was still legal in the US. Thanks for the advice, I will try to get a new filling as soon as possible. Just wondered regarding the medical, as I had a medical including blood work and vaccinations just a matter of weeks ago but the faulty I-693 was the cause of the denial, do I need a full medical again from another doctor?
  7. Does anyone know how long I have to file a new I-485? The initial denial letter said that I was still legally in the United States but didn't give a date of until when. I assume that I have approving 30 days after this denial?
  8. Yes, spouse is US citizen. Just really down right now, can't believe they can deny for someone else's mistake. Thanks to everyone for their comments.

  10. Just to let you know, I got denied again, I can't get into my main account for the denial notice but I checked on the case status and I was denied yesterday. Can't say how much of a blow this is, I really want to just go home to be honest.
  11. Just an update, USCIS have sent me a letter stating that there is enough evidence for my filling to reconsider/reopen my case and they have withdrawn the denial letter for now. They are now looking at it again. Fingers crossed, I will update more when I hear more. Thanks again guys.
  12. Hi all, one final question I promise. I have compiled my I-290b package and it should be sent tomorrow. One thing though, my denial decision was headed the San Bernardino office and I assume that I should send to the domestic office address and not the USCIS service centre address? https://www.uscis.gov/i-290b-addresses

  14. So I can argue that the reviewer should have noted that vaccines that I was denied on are age dependant. But can't use this to support my case? Can you give a quick example?
  15. Hi again, . Once again, thanks to everyone who has helped me on this. One final question, as I am filing for a motion to Re-Open and Motion to Reconsider on the I-230b, should I do headings for both separately. For example, title the motion to reconsider and then add and comment on all the failings the reviewer made in determining the rules. Then title the motion to reopen and add all my new evidence? Or can I just lost all my evidence with references and reasons all together under a joint heading?
  16. Can I ask something else? Having read the instructions again, I noted the paragraph below. What I do with this, do I just say that I am unaware of any judicial proceeding or just ignore? "All motions must also contain a statement about whether the USCIS decision that is the basis of the motion is, or has been, the subject of any judicial proceeding; and, if so, the court, nature, date, and status or result of the proceeding".
  17. Haha, you are right! Thanks to all you nice people on visa journey. Hopefully I can get this all sorted and then be able to add my voice to others on this long and sometimes difficult path!

Could I use the USCIS guidelines for reviewing the vaccines on the I-693 that indicate that reviewers may issue blanket waivers for age inappropriate vaccines even if civil surgeons have not indicated this. In other words, can I bring attention the rules for reviewers in my evidence or is this counter productive and may get a negative reaction?
  19. Hi Wuozopo, I had decided to follow Family's advice and file for both, reopen and reconsider, unless this isn't a good option? Thanks to both of you by the way, I have really appreciated all the views and information/advice.
  20. Hi there, The vaccines were for children and not adults, the surgeon forgot to tick the two check boxes that indicated this and USCIS denied me purely for that. I do have a new corrected I-693 and I have also a letter from the doctors office admitting that they made an error and that I have all adult required vaccines.
