    Thanks very much for the suggestions. I just wanted to respond to let you know I took you up on them. I had never heard of an Ombudsman before and that's quite a form. Hopefully I will be hearing from one or all of them in short order to get this ridiculous mess resolved.

  2. Hello everyone. I've read what forums I could on the subject but nothing seems to really match what I am dealing with and I am hopeful of receiving advice on how to proceed. I'm new to posting here myself, I did once in August 2017 I-129F Filers, Part II, so I may leave some information out. Please feel free to ask and I will provide whatever I can, within reason of course to privacy. Like most everyone, my fiancee and I want to get married. We met all of the basic requirements like having met in person, my income here in the states, etc so I filed like most of you have. Here is our story so far and I hope the formatting makes this mess a little easier to read:

     

    Aug. 2017: I filed the I 129F petition.

     

    Sept. 21, 2017: I receive my I-797C Notice of action stating they received my petition on Sept. 19th

     

    March 15, 2018: Approval Notice of Action received by mail stating it has been approved and forwarded to the consulate (everything sounds good so far)

        - We give it a few weeks and start trying to contact the consulate listed. She calls and they just say to email so we do that as well. 

        - First they say they haven't received it yet, then they have it and it's pending

     

    May 11,  2018: Ceac.state.gov website updates showing it has been returned to NVC

         - Email consulate who will only tell me that it was returned for having an error. Can't get any further details about what error or who's error.

         - No interview scheduled or contact was ever made, they just sent it back.

         - Begin contacting NVC after a few weeks and they haven't received it yet.

         - Eventually they state they have it and it's effectively in the pile to be looked at. Still can't get any detail about what this possible error is.

     

    Aug. 8, 2018: I-797 Notice of action again saying that it was approved with new valid dates from 8/14 to 12/13 and being sent to consulate. (back on track?)

         - Again start contacting the consulate after a few weeks but they never receive anything.

         - Continue checking the online resources for updates like an obsessed person.

     

    Sept. 10, 2018: Notice that the egov.uscis check page has updated to show "Department of State Sent Case to USCIS For Review"

         - Well that seems odd. The notice I got specifically said it was being forward to the consulate in Germany.

         - So ensues more calls to NVC where one representative eventually says that is indeed odd and I should call over there to see what is going on.

         - More calls only to USCIS now with them constantly saying they don't have any further information.

     

    Oct. 15, 2018: Still can't get any information out of them. One recommends submitting a request for more info that takes 2-3 weeks. I do so.

         - One month goes by and I still have not received it. Start calling again and put in another request.

         - This becomes a revolving pattern. Nobody will tell me anything and this supposed request for information never results in some appearing.

     

    March 15, 2019: Today I'm escalated up to an immigration officer which I thought might mean I get some answers. Same deal though with no information.

     

    I've done what research I can which mostly amounts to the closest reports I find are it being returned to sit in limbo after the consulate interview which never happened so I'm hoping there is a closer match of an experience that someone may have had. I'd love to hear how everything is fine but I'm realistic that isn't the case. I just don't know where to go from here. It started as being called an error which is never identified so don't know if I should refile, go get married and pursue that avenue, contact every senator and congressman I can, or where to even begin with this it's quite overwhelming. Any advice from anyone who has faced similar is very welcome.

    1) If the embassy did not contact you after NVC said your case was at the embassy, then it might have been your responsibility to contact them. Did you ever contact them during that period asking for an interview/medical to be done?
    2) I think I have heard of 2 cases where a case was sent to NVC after it was sent to embassy?
    For both, it was basically that NVC sent the case files to the embassy prematurely- as in not all the background checks were done correctly at the USCIS stage and the case had to be re-reviewed from scratch.

    My suggestion to you- you need to call NVC ASAP and figure out what is going on

    Although our email specifically stated they would contact her,  yes she called the embassy during that time frame and was told to email instead. So she did that although we never got a reply, likely due to it being mysteriously sent back. I have been calling NVC for the last couple of weeks but it hasn't arrived back there yet so they have no information until it does unfortunately.

  4. Hello fellow August Filers!

    I'm new to the forums. I'm hoping you all might be able to answer a questions for me and I'd like to share our journey so far. Sorry in advance if this is a little long.

     

    August 2017 I filed the petition for my fiance who resides in Germany.

    Sept. 21st, 2017 I received via regular mail what I believe is termed our NOA1 saying it had been received.

    April 4th, 2018 I received email saying the I-129F was approved and will forward the petition to Frankfurt.

         -We requested Munich but that's just a side note.

    April 4th, 2018 I also received another email that stated :

         -The U.S. Embassy in Frankfurt, Ger approved your request for expedited processing of your immigrant visa application.

          The NVC sent your petition to the U.S. Embassy for their action. The Embassy will contact you soon to schedule a

          Visa interview.

         -Oddly we didn't request such a thing but sounds good anyway as the wait is already long enough.       

     

    We waited throughout the month of April to be contacted, constantly checking our respective emails and mailboxes but we never received anything. At the start of May she called the Embassy there but was instructed to email instead which she did. Again we never heard anything back which is very stressful. 

     

    May 11th, 2018 the status when checking the CEAC website now says Returned to NVC.

     

    I have since called trying to get more information but they state they haven't received anything back yet so I'm stuck in limbo on that point which has us both quite nervous as it's been a month now since it changed. I spent 3 weeks with her in Germany last year in April and we meet all the other criteria as far as we can tell anyway. I have searched repeatedly for possible reasons it would go from approved and being sent to the Embassy to being sent back to NVC. All I can find however is bad news with that occurring after the interview. We never made it that far though. No interview was ever scheduled. Does anyone had or know of anything like this happening? It's very disheartening after being so excited we had finally made it to the final hurdles with the medical exam and interview only to have it mysteriously sent back.
