    Many times they ask for children's birth certificate sometimes even asking for DNA when they aren't immigrating. He should have went to NPC (National Population Commission) to get their birth certificates.

     

    Being a K1 means your petition will be returned to USCIS and expire. Seems it already has and the embassy will not revalidate it. Your best recourse for a man who already has two children and has been married is for you two to get married. There will be no letter you will get from USCIS. They don;t do that for K1's. Sorry.

    He did have a copy of the childrens birth certificate, but she wanted the one that the children had when they started pre school. They didnt used a birth certificate to start school they used immunizations card.

    Ok. The kids were not coming. So i dont see why they ask about a birth certificate.

    he had immunization and he went and had copies from there records office. She called him a liar.

    What exactly did the paper say? Nigeria is a tough consulate Especially if there are many red flags. If you got denied and they are not looking for additional information then your next step is to get married.

  5. Hello everyone its been a long hard and heartbreaking journey, my fiancee interview was today and he was denied a visa . He said when he walked in the door he could hear screaming coming from one of the rooms, his heart fell to the floor, and he said my God i hope i do not have to interview with her. but he was called by her. anyway  she denied him, she yelled out and called him a liar.... on the paper it says denied unless revalidated before it can be treated, there was no lies.   What does that mean? We had everything and more.....she never even looked at the petition. Have anyone ever went through this. We dont know what to do now. We have been fighting this battle for over 2 years.

      I always thought this happened when the consulate returns the petition but when NVC sends an approved petition back after approval isn't it usually administrative (like USCIS forgot something) so wouldn't the expiry date be put on hold?   

    Im not sure how it goes, but we have been told so many different things that our minds are spinning. I pray to God that is all it is, and that it will soon be reaffirmed.

    And after its died we will just go on and marry. Its seems as if the k1 is a waste of time and money, and definitely stress!

    At this point we are going to ride this rollercoaster until it comes to an end. See whats going on and then we will make a decision. We have one of the congressmen immigration team helping us, by inquiring for us. Do you have any ideas? We are opened for ideas. Its been the most stressful ordeal in ones lifetime.

    No. We didnit get married. If we had gotten the approval and everything went through correctly we would been married in May of 2018 last year. We started this process in Nov of 2017.We got the noa2 in Jan. 2019. So we thought we could try for this May of 2019. Which looks as of that will not happen. Yeah its May now.

  11.  ok. Did you see about how long did it take for uscis to reaffirm their case. The reason i ask is bcoz i called uscis to inquire about the case, and he said usually when that happens they will be sending a letter " an intent to deny" this i could not understand bcoz we never received a rfe or anything. Plus the petition was approved. 

  12. we received a letter from nvc saying that they returned our case back to uscis for extended review. Its been over 30 days and we have not received a letter or anything from them. Our petition was approved. Also nvc gave us the invoice and case numbers along with beneficiary numbers. Has this happened to anyone? And if so how long is the wait? This k1 process has been going on since 2017. We probably should have just got married instead.

    I'm not sure why this happens, but we received a letter a few days later saying the USCIS re-affirmed the approval decision and re-send it to NVC for processing, called NVC a month later and got the NVC case and invoice#, last week got an email saying it's being sent to the embassy. I heard it could be the signature page or a stamp is missing that's why it gets returned to USCIS. Just give it time and they should fix the issue and send it back to NVC. Good luck!

One for another NOA2 but with a different date, and an I-797C notice indicating that the USCIS has reaffirmed the previous decision (which is approved) as the Department of State has sent the petition back to the USCIS for some reason. 

     

    I'm wondering if anyone else went through this. Why would the NVC send the petition back to the USCIS?

    The same thing has happen to us, i would like to know also. Just received a letter from nvc, saying perition was sent back to uscis for review. I just wants to know what is going on.
