  1. Hello, 

     

    I have a question about my naturalization form.

    Finally the great has come I filled the online form, very simple and easy and I submitted. I saved a copy just for reference.

    2 days after I accessed my account a N-400 form was available online, I was just curious and I opened the form. 

    One thing a noticed was that under Marital status:

    The current marital status is blank since I'm divorced and I have no spouse. However there are two boxes that are filled in the application, they are:

    Is it you current spouse a US citizen? the box yes is ticked

    When did you current spouse became a US citizen: the box by birth is also ticked 

    For me it looks like a technicality since I have NOT entered any information during the process that mentioned any current spouse. My marital status is divorced and under previous spouse all the information is correct.

     

    Do you have any idea if this is correct? I contact an attorney and he wasn't able to assist me. I'm attaching both both forms the online form that I filled and the N-400.

    Maybe someone filled the form under the same circumstance as I did and is seeing the same thing.

  2. Hello guys, I'm looking for advice on my case if you know any experienced attorney or someone that help me with a consultation I would appreciate. 

    This is my case:

    I got married on Mar 2015 and on Sep 2015 my conditional GC was granted.

    In Jun 2015 I filled jointly my I751. 

    In Mar 2018 my spouse and I got separated, the final decree I got on june 2018, I informed the immigration of that and I sent some documents and a letter explaining what happened.

    In Dec 2018 I received an immigration document asking if I'd like to change my case into a waiver. I accepted but I forgot to sign (the IO told me that later on).

    In Aug 2019 I had my waiver interview, the interview was smooth and fast (20 minutes), the IO seemed to be satisfied with my answers as he did not ask follow up questions, he allowed me to tell everything that happened and at the end he said that he was going to mail his decision, one thing he mention was that I was called for an interview because I did not send a lot of documents, however, my file was huge as I sent a lot of documents (bank statements, insurance, loans, bills, photos and affidavit letters and many other documents). My attorney asked if there was a timeframe and he said no because they were a little behind.

    In December I contact USCIS through the phone and the opened a ticket inquiring why my case was  taking so long, this was the answer: U.S. Citizenship and Immigration Services (USCIS) records show that your case is currently pending adjudication. However, we have had to perform additional reviews on your case, and this has caused a longer processing time.

    I had also on December an infopass because I might travel in January and I got a stamp on my passport only for 6 months.

    What concerns me is definitely the time that is taking to get an answer. Also I heard from a friend that my ex spouse is married again and they might be in an immigration process as well for their marriage. I have an upcoming trip and I don't know what to do, I'm scared of leaving the country and then getting my I751 denied and with that not having  my entrance here granted. I have a house here, a job and I definitely can proof that the marriage was bonafide if I need to go to an immigration judge. However I don't know if I should take the risk and travel for work (4 days) while my i751 is pending. Also I don't know why is taking so long, idk since my case is taking so long if they are performing a new background check, or if the my ex if going to have an interview in the future with the new spouse and immigration is just waiting for that before giving me a final answer.

    I would truly appreciate if someone could help me with that or refer an attorney or someone that could help me

  3. I had my waiver interview in Aug 2019, my experience was very smooth. The IO was very polite. The first question was: So what happened? I explained how I met my spouse, how was the relationship and how ended. I was asked when we me, when we got married and where I used to live. The IO was checking if I was living in the same area of my spouse.

    The IO told me that the reason why I was called was because of lack of evidences, which I don't think is completely true  because I sent a lot of documents. Anyways the IO said that a decision would be made and they will inform me by mail.

    Since then I haven’t heard anything back.

    In December I had an infopass and the person who helped me told me that my case shouldn’t take more than 6 months to be adjudicated. Because of that I got a stamp for 6 months.

    I did open a outside processing time and the answer that I've got was the following:

    I believe that they have requested a background check since I had my fingerprints collected on Aug 2017.

    The IO was very polite, I sent a big package to them when I filed for the I751 jointly and I added more to the file during the interview. 

    She basically asked me what was going on (why thge relationship was over) and listened to my story, she was looking the documents all the time and she informed that the reason why I had an interview was lack of documentation and because I forgot to sign a document that they sent me (I sent a letter informing that my relationship did not work out and I was divorced while the joint I751 was pending, then they send me a document where I needed to accept the modification into a waiver process). In regards to the documents I sent a big package full of documents (car insurance, bank statements, life insurance, credit cards, pictures, work documents that showed both names, personal loan, flight tickets and many other docs).

     

    After 25 minutes interview the answer was  "I need to review your case and I will mail you the decision". My attorney asked for a time frame and she said that she couldn't give it since they were very busy. My attorney also said that everything went well and hopefully I will hear from them soon, however 3 months already passed and no answer.

     

    On top of that I have a work trip planned for January and I don't know what to do.

    My attorney asked for a timeframe and his said that they were a little bit behind and he couldn’t give us a specific timeframe.

    As stated once a withdrawal is sent it can NOT be retracted. According to policy when either party on a joint ROC withdraws from the petition USCIS is suppose to "offer" the immigrant a chance to switch to a waiver rather then let the petition be withdrawn. This is done by sending an RFE asking for divorce decree. They dont always do this though. Recently there was someone in one of the waiver threads that a similar thing happened to them. Their spouse withdrew but instead of being offered a waiver USCIS simply closed the case and they had to refile. It may have to do with how their withdrawal letter was written or it could have just be a fluke. 

     

    You should assume your withdrawal will be received and processed and the current ROC packet canceled. Send in another ROC packet (including fees) asap. You can submit the ROC more then once, so it wont be a problem. Keep on top of all correspondence from them. Proceed with the original case as long as they will let you. If you get an interview based on the first case they will be able to sort out the paperwork re the second case filing in it.

    I had a waiver interview on Aug 29th, it was a I751 waiver. Initially I filled jointly but since the relationship did not work for us we got divorced 3 years after the marriage.

    I filled on jun 2017 for I751

    In July the divorce was final and I informed the USCIS

    In Dec 2018 USCIS sent me a letter asking me to amend it to a waive. I did and I sent more documents 

     

    Then I got an interview schedule. The interview was fast the IO was very polite, I sent a big package to them and I added more documents to my file. The answer was  "I need to review your case and give you my decision", he also mentioned that my ex spouse sent a withdrawal letter and he said "this doesn't matter I am the one making a decision on your case" stating that what my spouse asked was not valid at that point. He asked me to tell him what happened, he did not interrupted me or asked follow up questions, he only asked about my spouse's previous marriage. My attorney said that everything went well and hopefully I will hear from them soon, my attorney inquired about a timeframe, he said that they were a little behind and he couldn't give us a timeframe. However I haven't heard yet. Some people told me that this might go to a supervisor.

    What do you think?

    The interview was fast and the officer very nice. Basically they asked me "what is going on ?". I started to explain, the office listened, no interruptions or anything to  make me feel nervous. Few questions from her, basically how we met, when, where I lived when we met. The IO also said that my case was transfer due to lack of documents (even though I sent a lot of financial statements, joint loans, bills, insurances like car and life, pictures and affidavits from our friends)and because I forgot to sign the waiver letter.

  13. Hi guys I was schedule for an interview. Originally filled jointly (a big package full of evidences was sent) and after getting divorced I sent a letter asking then to change into a waiver application.

    Basically I applied on June 2017 for I751, in April 2018, my divorce was final and I sent another package with more evidences.

    My case was moved to the local office and in December 2018, I received a notification asking if I would like to change my process to a waiver. I accepted and I replied back, however I forgot to sign the letter.

    Two weeks ago I received an appointment for an interview. I got all the docs that I had sent + new ones and I hired an attorney. The interview was smooth, 20 minutes approximately. At the end the officer explained that my case was on his hands because I did not submit enough evidences   and because I forgot to sign the adjustment letter. I sent 2 big packages with more than 150 pages each. He looked into the documents quickly. He was very nice and polite. He told me that he will inform me soon about his decision. my attorney asked how long would that take and he couldn't estimate.

    A week has passed and I still haven’t heard anything.

     

    Any thoughts folks?

    Thank you! I received my green card less than a week after the interview. Surprising efficiency there by USCIS 😂 but a welcome one.

    I had my interview yesterday, it was a I751 waiver the interview was fast the IO was very polite, I sent a big package to them and I added more to the file yesterday. The answer was the same. "I need to review your case and give you my decision". My attorney said that everything went well and hopefully I will hear from them soon.

    Basically I contacted them to change my address (I tried 4 times and didn’t go through) the representative then transferred the case to a supervisor who called me. My inquiry was about the address update but he also opened a ticket inquiring about an approval notice that I didn’t receive. Few weeks later I called to check if my address was updated and it wasn’t then this agent opened an inquiry in regards to the time that is taking to process my case. My local office (orlando) replied saying that within the processing time. I’m assuming that by the moment that my case got amended to a waiver (dec 18) the process time restarted.

    ·         In May 2018 the divorce process was finalized, I sent the final decree (divorce) to the office in California

    ·         In November 2018 I got a letter asking me to amend my form to waiver, I signed and the document was sent back.

    ·           I got then the following message:

    Case Was Transferred And A New Office Has Jurisdiction

    On November 2, 2018, we transferred your Form I-751, Petition to Remove Conditions on Residence, Receipt Number…, to another USCIS office. That office now has jurisdiction over your case. We sent you a notice that explains why we moved your case. Please follow the instructions in the notice. If you do not receive your notice by December 2, 2018.

     

    Then I received a letter explaining that my case was sent to benefit center and now they can schedule an interview.

     

    I did not hear anything back since then, also I’m trying to change my address and I tried online and over the phone with the representative and somehow, they are sending the notification to Texas. In my last call the representative transferred my case to a supervisor who told me that my case is in the California center. After that a ticket was open inquiring why I did not receive my approval. Nothing was done. Then another representative open a ticket inquiring why my case is taking too long. My local office informed that is under the normal processing time

     

    I’m assuming that because I amended to a waiver the process time started all over again.

     

    Do you guys have any ideas? I’m more than 2 years waiting for an answer and I don’t know what to do :(

    I applied for the remove of conditions last year and in March 2018 I started my divorce process, my divorce was final in May and I sent the USCIS the final decree.

    I got 2 weeks ago a letter asking me to amend my process into a I751 with  waiver, I signed the doc and I sent to USCIS. Today i got this update:

    Case Was Transferred And A New Office Has Jurisdiction

    On November 2, 2018, we transferred your Form I-751, Petition to Remove Conditions on Residence, Receipt Number WAC17xxxx, to another USCIS office. That office now has jurisdiction over your case. We sent you a notice that explains why we moved your case. Please follow the instructions in the notice. If you do not receive your notice by December 2, 2018, please go to www.uscis.gov/e-request to request a copy of the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

     

    Do you guys have faced that before? I believe that means that I will called for an interview.

I filled jointly for my I751 in June 2017 with many documents to support such as: credit card statements, bank statements, photos, utility bills and other documents that I can’t remember, since we claimed our taxes married but separated the paralegal that helped us asked me to send more documents in February 2018 ( taxes filled jointly).

    In May 2018 unfortunately my relationship was over. We filled for divorce in March 2018 and in May 2018 we were legally divorced.

    I sent the final divorce decree and more support documentation as a letter explain why the relationship was over, medical documents ( I was having some counseling with a psychologist) and the amicable term that we filled with an attorney.

    Today, I received a RFE asking me to amend the application. No other document was requested.

    Of course this is new for me and I have a thousand of doubts. I called an attorney and explained the situation she said that I should just sign the document and send it. She also said that they will call me for an interview and they may contact my spouse to investigate.

    I would like to know if someone has been through something like this?

    our relationship is over and I don’t have contact to my spouse anymore, the relationship was bonafide but turbulent in the end. Now after talking to this attorney I’m feeling really bad because I need to rely also on whatever my spouse will say.
