    Thank you. What proof would they need to prove that I am still a filipino? The only proof that I can give with my maiden name still on it is my green card which is expired. I am currently waiting for an adjustment of status but all my other ids have my new name last name on it. Will the expired green card be okay as proof? Thanks

    To file a new 485 your previous status must be terminated. Based on your denial letter this has not happened yet. It may happen soon or it may not. You dont have to wait for it to happen though- you can surrender the GC yourself. Then yes, you will have no status until you get the NOA from the 485 with your spouse and then you would be in a period of auth stay. 

     

    Also you didnt really answer how you entered the US- was it as a K derivative or a CR? 

     

    So how does the surrendering GC work? Im so sorry I really don't know what to at this point. I really appreciate all your help.

    Gotcha. So the path they may want you to take is to have LPR status revoked and then an I-485 approved to get it back, instead of doing ROC (it sounds like unwilling participants).

    The practicality of this is more complicated, as I believe you will have to go through an immigration court. That is not DIY...you do want a good attorney if it comes to court.

    Oh wow. I don’t know what to do now. They told us we can file again since my green card before is no longer valid since it expired last 2019.

    A late-filed ROC is only very rarely not accepted. As for the reason, you can just note that you had an I-485 pending and were waiting for adjudication of that.

     

    Who is the approved I-130 petitioner? A parent? A spouse? Other?

     

    Unfortunately, this is very quickly heading outside of the DIY realm. The only concern I have is the lawyer(s) you've dealt with so far advised paths that you cannot do, like just filing a new I-130 + I-485 for concurrent AOS processing.

    According to this notice, you already have a green card. The I-485's purpose is to get a green card. I think you made a very basic, major mistake...this is the wrong form for you. I think you (well, your parent) were supposed to file an I-751 for Removal of Conditions (ROC).

    On what visa did you enter the US?

    The lawyers told us its safe that we just file for a new i-485. My parents do not want to include me to the removal of conditions and the lawyers said that if I remove now it will be very hard since I am filing late and my excuse was just verbal abuse from my parents and they want to deport and sue me for no reason

  8. Hello guys my I-485 got denied and here is the reason:

    My I-130 got approved but this got denied, we already talked to lawyers and they told us that we can just refile for the I-485 since I am “out of status” right now since my green card expired already.

     

    i just have question filing out the I-485 form:

     

    1. My current immigration status? Should I put that I am “out of status”?

    2. Can I still pit my alien numbers from my green card before?

    3. Information about immigrant category, am I going to be the principal immigrant now and put the receipt numbers of he approved I-130 or should I put my parent’s information as the principal applicant?

    Unless you have completely lost your residency, your i485 may be denied again thinking you are already a resident.

    My green card expired aug 2019. So I can still use my Alien numbers even though it is expired?

  11. Hello Guys!

     

    So I am filing for the I-485 again... since I got denied the first time, the reason was my mom has to file for I-751 removal of conditions but she did not include me so I figure I filed by myself for another petition with my husband now. I got approved for my I-130 but got denied for the I-485. Talked to 4 lawyers today and we decided that I file for the I-485 with my husband's petition since my 2 year conditional already expired last August 2019 and they said it is very hard to file for the waiver and late submission. 

     

    so my question is, for the I-485 part 1 question 24: for my current status do I put "no status" since my cr2 visa already expired last year? 

     

    and as well as do I put in my Alien numbers frm my visa before?

     

    What should I do? anything would help. Thank you so much

    Oh I’m sorry I was wrong I’m a CR2 Visa holder. Is it still possible for me to get married?

    I'm 19 years old and I have a CR2 visa. I moved out of my parents house and live by my own. I'm still a conditional permanent resident and my green card expires next year.  And I'm still not sure if my parents are going to file the petition to remove the condition next year because we don't talk anymore. Is there anyway that I could just remove the conditions myself?

    I'm actually planning on joining the military but I'm still a conditional permanent resident. My green card will expire next year. And I'm still not sure if my parents are going to file the petition to remove the condition next year. I moved out of the house and live by my own. Is there anyway I could change the petitioner to myself or someone else? Or is there anyway I could join the military?
