    No decision 1 yr+ after filing I-751 -- how to avoid out of status?

    We filed I-751 last May and received with the NOA letter a notice that status has been extended for one year. We complied with an RFE request in November and traveled to a USCIS field office for an interview in March, but still no decision on the case. We are worried about falling out of status while we wait for USCIS to make a decision. Customer service won't give us any useful information, other than that our case file was last touched on May 5, 2011.

    Is there a form we should be filing to ask for a further extension while USCIS processes this? Or a better contact than USCIS customer service? Clearly our case has far exceeded normal processing times for some reason.

    Last saturday I received my Green Card!!!

    I never got the EAD.

    I had biometrics. Later, my case was transferred to California.

    It is nice to be a resident now!!!

    How long does it take to receive the green card after it is approved?

    Probably a month. However, I had to call the senator of my State because I had a job offer at one of the universities of my state. They couldn't start classes because we were waiting for my EAD (it never arrived) so the senator's office called USCIS and my Green Card came after two weeks of that call. Probably USCIS didn't process my EAD somehow. I guess it is happening.

    Hello VJ's!

    I applied for AOS and EAD at the end of may.

    There is a good job position for me. I applied and I was accepted!!! :thumbs: However I am still waiting for my EAD. :unsure:

    My future employer wants me to sign a contract next week... It is a good oportunity to work in my career.

    What should I do? Can I sign a contract? WHat happens if I do it? If they give me a check for moving bonus or milage, is it a crime to accept it? :wacko:

    Does anyone passed through this situation?

    According to VJ my EAD will arrive September 7th....

    Any piece od advice is very welcomed!!!

    Hi all, he had interview in Havana and recieved the visa the next day, July 18th! We are getting confusing info about the Carta Blanca. He had to file some papers with Cuban Immigration in the city of Trinidad, they said it had to be sent to Havana and back, about 30 days before he had to then pay a fee(anyone know how much?), get a ticket and the carta blanca. When does he actually have to get the ticket, and if I book it for him electronically how can he prove he has it? He'll be flying Air Jamaica from Havana-Montego Bay-JFK.

    To all of you out there I initially filed the peteition December 20th, 2008, and he received the Visa July 18th. The Cuban Passport took him 45 days to get.

    I am hoping he can be here soon! Any advice or replies are welcome!

    You wont be out of status, your status is now AOS pending, you will receive NOA1 letter for the I-485 which will prove your status.

    SSA is correct, they cannot issue a new card until you either have EAD card or green-card. You need to handle things with SSA within 76 days of entry.

    Hrm, so it was my understanding that the marriage certificate was required to change name with SSA. But if we weren't married within 76 days of her entry and didn't have it, we are stuck until AOS NOA1 proves she has her status again? Or it was possible for us to change the name on the SSN for another reason?

    My wife entered on K-1 on 3/3, expires on 6/1, and we were just married on 5/25. I sent AOS documents certified priority mail today (5/30) to the Chicago lockbox.

    She had already obtained an SSN 2 years ago when she was in the US on a J-1 visa and went with our marriage certificate to have her name changed. However the SSA office refused to do that saying that according to her I-94 her stay is almost expired. Similar situation at the DMV to issue a state ID card.

    We are worried about her being out-of-status, and not having any identification with our new married name on it for any travel, bank accounts, etc.

    What normally happens in this strange time between marriage and action on AOS for K-1'ers???

    Medical Examination, again?

    Hello VJs...

    I am getting married this weekend and we are working now in the papers we need to file for AOS...so I have a question:

    Do i need to have another medical examination in US? I arrived a month ago and I am withing the 12 months since my medical examination at Peruvian Embassy for my K1 Visa.

    We are not sure if I have to ask for an appointment and have the same examination again. Since i already had the vaccinations and exams for HIV, Tb , etc.... i dont know if i need to have them again... The US Embassy in Peru had the results in a 'mysterious' envelope that i gave up at the port of entry and as far as i know they sent it to USCIS...

    Help please...
