It's too late to correct the issue.  I would definitely gather all the documents now in preparation of a possible RFE.

Thank you. I did read the part of Criminal History on the K1 packet and it says there Citation, Arrests, EXCLUDING TRAFFIC VIOLATIONS unless it’s drug or alcohol related or paid 500 usd fine. And he simply had a traffic misdemeanor..

He left the scene but there was a camera that he was the one driving. They were in parking spot and when he was trying to park he accidentally hit the car behind which leave a small dent to the car. Nobody was in there

I asked him and he said he simply had a citation and paid the fine

What was he charged with?  Leaving the scene of an accident?  or was he simply issued a citation?

  4. Hello everyone. Me and fiance are currently waiting for our NOA2, we received our NOA1 on August 3, 2018. So we were having a conversation about something which led to his Violation 7 years ago, he’s currently 27 years old. He said that he was parking on a certain spot and he accidentally hit a car behind which caused a small damage to the car. He said that he got scared and drive off. Later on, a police officer called his family regarding the incident, they reached the court but paid only for the fine.

He completely forgot about that and we are a little bit worried now because we forgot to include in the packet regarding the violation. Would we get an RFE? Would it be a problem?

    Thank you so much!

Agreed...it can be a red flag if it looks like the "set up" is a means for family members to immigrate to the US. Meeting through a fiance of an aunt has no immigration benefits for either of them, so that's not even on the table. Even if it were, a strong relationship overcomes that.

True, we have all the proof of having a bonafide relationship. Thank you

I don't believe so as long as you have evidences of bonafide relationship. I am from Philippines as well and I didn't have any issues. Met my husband through my aunt.

My uncle (aunt's husband) is a co-worker of my husband back then. We are now happily married and immigration processes has been smooth sailing so far. No issues with my K-1 visa and No issues with my AOS. I am due for ROC next year.

Wow! We have a similar situation on how we met our fiance. Thank you!

    Catherine.

Thanks, I asked because I saw in the VJ about being denied and it looks like that meeting thru a family member was considered red flag.

  7. I came from Philippines and I sent the packet to my Fiancee (USA) with my signature in it. So I used A4 size in printing those documents.. My Fiancee on the other hand wanted to make everything sure. He asked our Agency what size of paper were gonna use and they say 8.5 x 11 and A4 is not allowed. Is it true? Because I have to send again documents using 8.5x11 to him. :(

Was he an employee for them or was he self-employed and did jobs for them? If it's the latter, then he can just list that it was self-employment and provide his information as the employer. I would still list any longer-term jobs he remembers, but I don't think that's actually required. If he was an independent contractor, then he should check his 1099s.

If he was an actual employee, then he should have W-2s and reported it on his taxes, so he can check those as well.

    Thank you for responding. :)

No he was working for them and some jobs takes only a month or so that's why he could hardly remember. Anyway i'll just tell him to trace his previous employment as best as he can.

Have him do his best to find out that information. Look up previous W2's and see if can find all proper information. If he can't, just have him fill it out as accurately as possible.

Thank you for the response. Do they still ask for my fiance's W2's, pay stubs or other proofs indicating he was employed since January 2013 or only the recent ones?

  10. Hi everyone.

Me and my fiance just started to process our K1-visa. In the employment of the petitioner, it says about previous employment for the past 5 years (from January 1, 2013 - now) but he mostly forgot his employers on the year 2014 since he is Pipe Welder and he moves a lot from one job to another. Does he need to list down everything and also submit all his papers from January 2013?
