  1. So if you are a resident of us and she has tps am pretty sure she can adjust status because when she got tps she is admisible in the us. You need a lawyer. Good lawyer. And stop ###### up so much lol. Hey check if you or her have parents that had the 245i. If u or her have it, she can adjust status and get her papeles here in the usa son. I hope u can stay with one woman lol

    She can, if she is not the main beneficiary. If one of her parents have the 245i than she is grandfather. Only the main beneficiary had to be here before december 21 of 2000 and applied before april 30 of 2001. But i dont think this is her case. She has to do consular process

    Am from honduras and have daca too. No 601 waiver ok. All this is avaolable in the uscis.gov

    Maria never mind, I miss read, you dont have 245i, so you will have to do the 601waiver.

    The i 601waiver is a consular process, that is not what you doing. You will do adjustment of status. I130, i485, i485 with supplement A. Affidavid of support and medicals. Your us husban gets you a visa right away but you did not come here legally so typically you cant adjust status but in your case you have the 245i. You can adjust with ur husband and 245i. Make sure you are grandfather under the law. I did this process and am waiting on my greencard now.

    I expect to be with my current employer in 4 years and 9 months. With that said, on my I-485 my lawyer and I agreed to list this same employer for the past 5 years of employment history. 

     

    I did AOS and used 245i grandfathered benefit which means I would still be eligible  to get the PR if I ever worked unauthorized in which I did and my lawyer recommended to put YES on that question. I agreed. IO did ask me some random YES/NO questions from my I-485 and I got all answers correct to match my application including if I ever worked unauthorized.

     

    So my question is if I would be still covered under 245i if I decide to file for USC since I have to include my hire date which was before I approved for EAD/PR. Would the IO who looks over my application as well as the IO interview have any concern over my past unauthorized employment?

    Hey are you a permanent resident yes or no.I dont really understand your question. Am grandfather under 245i too and I applied for Adjustment of status because I have a us citizen wife. Am waiting for my green card now. 

    An employer can sponsor you and you can adjust your status if you have the 245i. (You must be latino or came here like me illegally because only when you dont have a legal entrance to the us you use the 245i) make sure the principal beneficiary of the 245i meets all the requirements. Did your father file an i130 or labor certification before april 30 of 2001? Was he present in the us before December 21 of 2000. He has to meet both of this for you to be grandfather under 245i

  6. Hello to everyone that reads this. 

    Does any body knows about 245i law. I applied for adjustment of status. My wife is a us citizen but I dont have a legal entry to the US. I came here as a minor illegally and remain illegal as an adult. Typically you cant adjust status just because you have a US spouse if you were not allow in the US. Now things get tricky here. The famous 245i law. My father meets all the guidelines of 245i and grandfathers me under the law. He had an employer file a labor certification  for him before the end date(because the end date was april 30 of 2001) and was present in the US before December 21 of 2000 ( because the law requires this too). This law granfathers me and my family. Now that I have a US spouse she can help me adjust my status. Here is my time line

     

    I-130 and I485, I485 with supplument A and

    Affidavid of support received Nov 11 of 2017.

     

    Biometrics 1 of January of 2018.

     

    Interview Oct 16 of 2018.

     

    In the interview the officer did not know anything about 245I, her manager had to step in, they say they dont receive more of this cases. About marriage not much we have 3 kids and been together since 2008. Now at the end of the interview, NOTHING, a piece of paper saying allow 120 days for a decision. Is March 2019 now and nothing. I been calling USCIS, nothing from the robots answering the calls. Trying to do info pass but impossible. DOES ANY BODY KNOWS HOW LONG THIS WILL TAKE? By the way no mistakes on the applications and they dont need any info from me at the moment. Aaaaaaaa am so fustrated, this is so hard. PLEASE ANY BODY WITH ANY INFO. THNX

    Hey, My wife applied for me in December 11th of 2017. I did my biometrics on Jan 10th, 2018 and now im just waiting for interview. We been together 10 years and 8 married. 2 kids. Hopefully I dont have to do it. She is been us citizen since we been together, and Im using the 245i law to adjust status in US. Do you have any updates??
