  1. My original conditional card had a typographical error and both the "Card Expires" and "Resident Since" dates were backdated by a year.  I submitted the I-90 application and here's the timeline:

    • June 6, 2019 - Received application (without erroneous card)
    • June 8, 2019 - Biometrics appointment scheduled
    • June 25, 2019 - Biometrics reviewed
    • May 21, 2020 - RFE for original card
    • June 10, 2020 - "We received the information we requested from you"

     

    Any ideas as to how long it'll take hereon?  Should I have submitted the card back when I filed the I-90?  Would this delay it by another year?  Am I eligible to travel with a "pending I-90" letter?

Hello!  I received my Green Card last year with an incorrect date.  It's really supposed to expire on May 30, 2021, but the date was misprinted as May 30, 2020.  In June 2019, I made an Infopass appointment and also filed I-90 to get a replacement card.  The application is still under process, and my temporary stamp expires in June 2020.

     

    Seeing that USCIS offices are closed and processing time for replacement cards is very long, what are my options?  What would happen if my card expires?

  3. My wife and I just had our interview on May 31, 2019 after having filed our paperwork in April 2018.  Here are our (mixed) impressions:

     

    • We arrived on time and our very nice female IO called us in about 15 minutes after.  She started with asking us to take the oath and immediately said we may receive the card in a week's time or maybe a month.  This is before she started asking us anything.  She also mentioned she hadn't reviewed our file in detail, yet, because she'd had a busy day.
    • She asked general questions: how we met, what we're doing after the interview, other casual stuff
    • She then went over the paperwork and asked basic questions like dates of birth, parents' names, SSN
    • She asked me, the Beneficiary, simple yes/no questions from I-485.  To one of the questions, I said, "well, I received a traffic ticket once but that wasn't in the US."  IO said that's fine but proceeded to change the answer on the form from No to Yes.  She clarified that if there are no criminal proceedings, this is not a problem.  So, I wonder why she'd mark at as yes, then?
    • IO reviewed our originals for our passports, my birth certificate, our driver's licenses and our marriage certificate.  She did not ask for my latest I-94 or EAD, but asked to see the latest stamp on my passport.
    • IO then asked us if we have any updates to submit.  We had an updated I-864 with the latest tax return information.  This included newer bank statements with both of our names and our new address.  We also had newer pictures and newer lease agreement that we simply forgot to bring up in the easy flow of conversation.  Our original submission had several pieces of evidence (~100 photos, bank statements, older lease document, utility bills, etc.) but for our older address.  I hope us forgetting to submit new information doesn't cause an issue.
    • I then asked whether this is an approval.  She said she still had to review the new form and check the originally submitted documents.  She didn't give us any paper or any stamp.  I still have my existing EAD.

     

    Thoughts?

    Regarding (2), it's just that the interview notice spells out twice, "spouse's (petitioner) birth certificate and proof of US citizenship."

     

    We didn't submit spouse's (petitioner) birth certificate originally so not sure why they'd mention it now. 

     

    The keyword (and) had me worried.

  5. I-485 Received Date: April 27, 2018

     

    I-693 Signed Date: February 26, 2018

    Interview date: May 31, 2019

     

    Questions:

     

    1. Do I need to get I-693 filled out again?

     

    2. It's hard for my spouse (US born citizen) to obtain her birth certificate due to personal reasons. We didn't submit a copy with the original forms, either. However, the interview notice asks for it.  Is it really required?

     

    3. We filed I-130, I-485, I-693, I-765, I-131 and I-864 concurrently.  The affidavit of support information on I-864 has since changed (positively).  Do we need to fill out a new I-864 along with new supporting information?

    For the record & future readers:

     

    No it does not show my TN entry date and this is one of the confusing factors. I have one I-94 (white card) issued to me at time of TN application (land border) still stapled in my passport. This is a multi-entry I-94 and it is my understanding that multi-entries are not surrendered when departing until the end of your TN visa stay (the ultimate departing). It has never been removed despite my many travels to many countries over the years. My online I-94 number does not match this I-94's number. Also the dates of entry differ. They both correctly reflect their respective entry dates, the online one from my most recent plane trip. I have checked against some old online I-94's from previous flights in that I had printed off for my records, and they each have unique I94 numbers. This leads me to believe that indeed a new I94 is issued for each arrival, regardless of whether you have a preexisting multi-entry I94 issued in your name. I have had at least ten issued to me electronically over the years. Also all of the expiry dates on all my I-94s match as the date of the expiry of my TN visa (this also makes sense).

     

     

    I have been trying to get in touch with a deferred inspection site through email and phone to no avail, but I'll keep trying.

    This was the case with my I-94 as well.  The I-94 I initially got was the paper one.

     

    Mysecond I-94 issued for my second TN status was electronic.  The I-94 number changed automatically after a few visits to Canada.  So, I attached the latest one I had online and the older one I had a PDF for from when it was initially issued.

     

    Iwouldn't worry about this whole thing at all and just attach as much documentation (all I-94s, travel history, stamps) as you can, using the latest I-94 number you see online on your immigration forms.

    Wrt Shakeyy's comment, as long as what is accurate on i94? Date of entry or date of duration of stay?

     

    The issue here I think is that the online i94 date of entry will not match OP (or my) most recent entry at a land border because CBP doesn't update the electronic i94 file based on land crossings. 

     

    I simply sent all of my travel history from the I-94 website + all of my I-94 print-outs + all of the stamps in my passport.  My case is now "ready to be scheduled for interview" and I haven't received any RFE (yet?).  Frankly, I believe they understand Canadian passports aren't always physically stamped.

So you can update the I-485, I-131, I-765 together with the person about to receive the GC as petitioner and then separately update the address for I-130 with the USC as petitioner.

    Awesome! Do you think they'd ask about my TN?  I'm just worried they might bring up non-immigrant intent of a TN status holder vs. the fact that I now definitely have an immigrant intent after filing for AOS.

  10. I'm a Canadian married to a US citizen and was in the US on TN status.  I had TN status well before we got married and we got married in Canada.  I just got my EAD/AP combo card and we're planning to make a trip to Toronto. 

     

    I understand my TN status is now no longer valid.  Would re-entering the US using my Canadian passport and EAD/AP card be an issue?

  12. We did concurrent filing of I-485, I-130, I-130A, I-864, I-131, I-765 and I-693.

     

    Timeline:

    • April 27, 2018 - Priority date
    • May 25, 2018 - Biometrics
    • May 31, 2018 - Case is ready to be scheduled for an interview (I-485)
    • June 24, 2018 - Fingerprint review was completed (I-485)

     

    Fingerprint review was completed after the May 31 status.  Is this unusual?  Also, there have been no updates for any of the other forms.  When can I expect to receive my EAD/travel authorization?

As per the previous post, the beneficiary’s income can only be considered if the source of the income will continue after the granting of LPR status.. hence the important of demonstrating with the supporting documentation 

    The employment letter says current and full time.  I'm not sure if any employer would be willing to write that employment will continue except that it's full time.  Would you agree?

    Petitioner's 2017 income is well above the requirement but petitioner is currently unemployed.  Beneficiary's income has been included for that reason.  The employment letter shows current income, employment status (current) and employment type (full time).
