Online USCIS status has been updated to say we have an interview date! Just need to wait to get the actual letter to know when it is!

My impression has been that when envelopes arrive, they get put into a pile for "initial processing". Some envelopes end up at the top of the pile, some at the bottom.

Envelopes then get pulled and opened (they can sit there for many days first). The check is cashed, the file is marked paid, and sent off to an adjudicator.

The adjudicator sticks it in a pile. They are supposed to process the file in order of receipt, but as you can see from timelines, it doesn't quite happen that way.

So.. I would expect one of the following:

If AOS processing is in the same location as N-400, the initial processor will simply route it to the proper adjudicator. No problem.

If AOS processing is in an entirely different location, your package would either be returned, or could sit in limbo in some pile for days or weeks until someone finally deals with it.

What I DO remember happening to a few people with K-1's is that if the check is not for the absolute correct amount, the entire package gets returned.

So if AOS is a different fee, even if they are not smart enough to simply send the package to the N-400 adjudicator, they would just return the package. This seems the most likely.

Of course... none of us REALLY knows what goes on at USCIS, but maybe this can put you a little at ease.

I understand how frustrated you are, but no need to worry.
There are two ways of handling this, neither will get you deported:

1. Refile as instructed by the IO. (this is the easiest, and maybe quickest, option... but will cost you another $680)

2. Fight for a reversal of the original decision. (lots of stress and frustration, might take longer... might save you from paying another $680)

I'm not quite sure the best way to fight would be, but the Ombudsmen seems like a good bet.

I would DEFINITELY NOT leave the country until this issue is resolved.

If you left now, and then tried to return to the US before resolving this matter, there is no way you would be allowed back in.
They would think "Oh well, he deported himself. Case closed."
Once you leave, you lose all leverage. If you feel you have a valid case to fight, stay in the US and fight for it.

Also, if she is giving you the runaround, maybe it's time to get a new lawyer.

Alright, time to jump back into the saddle and do this thing all over again again. Off to the post office in a few minutes to mail hubby's N-400 petition.

The fact that it is today makes me happy... it is the 7th anniversary of when I first fell in love with him.

So... I know that if you had Biometrics done less than a year ago that you don't need to get them redone. But, how do you decide if you should send in the $ for it or not?

DH had his done 3/8/2011 for ROC. He is eligible to apply for Naturalization now, and we will be mailing his N-400 sometime in February or March this year (when tax refund comes).

I hate to send in $ for nothing, but it would be worse if the application was rejected because of it.

The fee we paid was something ridiculous like $75, but then we wouldn't have seen any of the money if we had not paid that.

It could definitely be because it is a credit union. They probably aren't set up to handle those foreign transactions. The bank I worked at was one of the biggest multi-state banks. Maybe try opening an account at one, even if you just close it after you get the check deposited. You would be taking a hit in fees, but it's better than not being able to cash it and seeing NO money at all.

BTW...to avoid any issues with foreign checks again, I opened a separate Free Checking account (and keep $10 in it). this is my "transfer account". I felt bad that my kids would get birthday checks for small amounts, and that we couldn't deposit them. We gave the account number to a trusty relative back in England, and if anyone wants to send money as a birthday or holiday gift, they can wire us the money to that account. Cheaper, easier, and we never have to give out the number of our main account.

One more thought... would it be worth it to contact your former employer and explain the situation? Perhaps they would be willing to put a stop on the check and wire it to you or something.

At the large American bank I worked for, this situation would come up quite frequently - including when it came time for us to cash my husband's last paycheck from England.

The only way banks today will handle foreign checks is for it to be deposited into an account at the bank. You will not be able to "cash it" and walk out with money in your hands the same day.

If I explain the process, you will understand why (prepare for a lot of bank speak here). Essentially, if the bank accepts the check for deposit, the funds do not get deposited into that account in the normal timeframe of 1-4 business days. The check must be sent to the "overseas control department" of central processing, who then will send it out to the foreign bank in question. If the foreign bank accepts the check, the money will be credited back to the overseas department, who will approve it for deposit into the account. The whole process takes about 6 weeks, if not longer (depending on the foreign bank). The bank charges a fee for this service, too.

If the foreign bank decides to get funny about it and not honor the check, you and your bank are out the money.

Which is why the Bank Branch Manager needs to approve taking the check on speculation. They assess the trustworthiness of the bearer and the legitimacy of the check when deciding to approve taking the check or not. Long-time well-known account holders have an edge here. Even as an employee I had trouble!

End of Story is... if you have a bank account, go in and talk to the Manager about how to get it deposited into your account, and prepare for a wait to get your cash.

It took us two trips to the DMV yesterday, but hubby got his license renewed!

Got a hassle at the first agency (Randolph), so we left and drove all the way our to rural Warren County to another agency, where they were nice as pie. They guy even jokes that this means the GC should turn up tomorrow. Hopefully soon, no doubt it will when we are away on vacation!

Well... now you need to go out and CREATE opportunities to have proof! And quick!

What I mean is you have to go to unmistakably Mexican locales and have someone take a picture of the two of you together there. Like under a "Welcome to Mexico" sign, or in front of a famous landmark. Pictures celebrating birthdays and holidays with family work well, too. Don't worry about photos being imprinted with the date, just write the date and a description on the back of the photo. That's what everyone does. It's great if it is obvious what the date is in the photo, like holding up a newspaper, or standing by holiday decorations or a dated sign. Go to events where you will have ticket stubs and receipts (concert, movies, show), and take pictures there. Or stay one night in a hotel. That way you will have paper and a photo (and it is important to have paper). Even brochures or menus with a photo of you at the place can help prove you were there. You may have to spend some money to go to places or events that will give you tickets or receipts, but its just what you have to do at this point.

And at some borders, if you ask nicely the US Officer will give you a souvenir "Welcome to the US Customs, whatevertown, USA" stamp, since people collect these.

Let me remind you now that when it comes to to Adjust Status after you are married, you will have to show proof AGAIN that your marriage is legit. So always be on the lookout for "photo & proof opportunities". Wherever we went, Hubby and I had a lot of fun with our "Visa photo op" moments!

Don't miss your RFE deadline, and don't even THINK about photoshopping!!!!

Here is the part where the delay at VSC causes hubby and I additional financial outlay and probably a HUGE headache. All because hubby's NJ Driver's License expires in a few days, and we need to renew.

But it's not that simple...

NJ is NOTORIOUS for having a difficult motor vehicle agency. Since many of the 9/11 hijackers had fake ID from NJ, they have toughened the process up to the point where it takes a minimum of 2-3 trips to accomplish anything. My big worry is that the know-nothing worker behind the desk will wrongfully not accept the NOA1 letter as proof of extention for his 2-year green card. Don't say it won't happen, it's exactly the type of thing that happens! When he first got here, he went for his DL, only to be told in error that he needed additional documents and that it would be no problem to return the next day. We did, only to be told that he never needed the additional documents, but now he couldn't get a DL because he needed to have 60 days left on his I-551, and today there were only 59! If the worker hadn't screwed up the day before, we would have been fine, but now he couldn't drive until he had adjusted his status and actually had a GC in hand. Now do you think that 60-day policy posted or printed anywhere? No. When we complained we were told it was not publicized on purpose, to "thwart potential terrorist". Well, all that meant to us is that he was now housebound for 7 months with no way of finding or getting to work.

So as it stands now, instead of using a 10-year GC to get a license that will expire in 4 years, he'll be given one that expires in less than a year and will have a huge red "CONDITIONAL" across the top. Then we'll have to go through the cost and process again. That is, if they decide to renew him at all. If they don't, his license will expire, and he will have to pay and take his driving test all over again when the 10-year card arrives! Sheeesh.

Wish us luck. I can't not have him able to drive again.

Finally got our Biometrics appointment. Hopefully this means they are getting caught up from the snow closures. We need more super-quick approvals!!

Are you asking if she risks being caught and deported by taking a roadtrip from California to Virginia?

Well, I would simply say that any encounter has with police, or any authority, puts a person with illegal status at risk. A roadtrip across the U.S. on major highways includes the risk of being stopped for speeding, traffic accidents, etc. I don't know of any immigration checkpoints in the eastern part of the U.S., but I don't know about out west.

When deciding what to send, I always assume that they DO check everything.

That way, whether or not they do check, they won't find anything fraudulent in our case!
