  1. My husband’s current EAD/AP combo card expires at the end of December 2021. We had our AOS interview end of April 2021 and still haven’t received a decision. We were waiting to renew combo card as we were hoping to hear back on the green card before combo card expires, but now it’s cutting it close so we are applying to renew. The work permit can now apparently be filed online, any experience with this vs paper app? To renew work permit and travel permit, I know we need to resubmit applications as well as copies of NOAs and proof our I-485 is still pending. Are we required to also send all of the original supporting documents (passport photos, I-94 etc)? It’s my understanding that we will just get a receipt extending another 180 days, is this correct or should we expect another, updated combo card? Thank you for any tips!

    I think there is one fine print... we had a DS 3025 completed .. but it had no flu shot on it.  So out of abundance of precaution, we went to see a local approved doctor to get the vaccination record on I-693 part 10.   Paid like $40 and doctor said.. flu season, need flu shot, another $50.

     

    Then doctor gave us a sealed envelope which we brought to interview on 2/8/21.

     

    Officer said our medical was good before accepting the sealed envelope, but he said the more the better, easier for him to approve.

     

    So... well... I can only conclude, do more better, u dont want a silly medical RFE to delay anything because of a officers error .

    Do you happen to know where on the USCIS website it states this? I would like to print it to bring it to my husband’s interview. He had his medical abroad for K1 (6 months before we submitted AOS), completed DS-3025 and provided a copy with our AOS (stating we were omitting I-693). I’m just concerned at our interview they will request I-693 and would like to be prepared. Thank you.

  4. Hi, my fiancé arrived here a couple of weeks ago on his K1. We have until 2/22/20 to marry and adjust status. We’re having a formal wedding in April, so just the technical one (courthouse style) will take place soon. We’re moving cross country in February and will have our new permanent address as of 2/10/20.
     

    Here’s my question: is it best to apply for AOS from my current location, and then notify USCIS of our address change? Or would we be better off waiting until we move and then sending everything in from our new address before 2/22? 

     

    I was hoping to submit AOS right after marriage, but I’m worried the change of address once we move will screw everything up and could possibly delay things. Does anyone have any insight or experience? Our original K1 petition was lost for 5 months in the government shutdown, so I don’t have much faith in the system. 
     

    One more unrelated question, does anyone know if it’s possible or have experience traveling to Puerto Rico before receiving AP? I assume since it’s a US territory it’s allowed, but don’t want to risk anything.

  5. Hi, I’m sorry if this isn’t the correct spot to ask this. My fiancé has his interview in Sydney this Tuesday. He has an Australian federal police check, but he has the “name check only” one, not the finger print one. Is this ok? I can’t find it now, but I thought I read on here that they want the fingerprint one. Does anyone know which is correct or can direct me where to find it? Please and thank you so much!

  6. Hi everyone, I’ve been having a hellish time with this process (K-1). Received my NOA-2 on Dec 20, 2018 with an expiration date of April 20, 2019. My petition was lost by the government and I was told it never reached NVC. I hired lawyers to help me in mid February and we’ve been given the run around by uscis. First after months of them saying we just had to wait for it to reach NVC, they told us in early April it was located at a “field office” and would be sent back to California service center. Today when my lawyer spoke to them they said it’s on it’s way to the California service center from the NVC for unknown reasons. They ordered expedited processing once the NVC receives it again. This all sounds like BS to me. Has anyone else had such incredible waits? I mean I’m still at the exact point I was on Dec 20 when I received my NOA2. I’m so mad and sad and upset!!

     

    Here comes my main question, we’re trying to prepare for the NVC so that we are ready whenever they finally receive it. I have questions regarding what police certificates will be required for the NVC

     

    My fiancé was born in New Zealand and moved to Australia when he was 10, never going back to live in NZ after that move. He’s lived in Australia since then, except for when he was in the UK from 2007-2009, when he was 21-23. He has no criminal record or convictions from anywhere at anytime.

     

    Everything I can find on the uscis site says he needs police certificates from everywhere he’s lived more than 6 (or maybe it was 12) months since age 16. Today my lawyer said something different than what I’m finding on USCIS website. He said this;

     
    • Records of any arrests or convictions since Adam turned 18;
    • Complete records, even if clean, for any place he lived for six months or more in the last 5 years;

     

    That seems pretty conflicting to the USCIS website. Since I have yet to receive ANY correspondence from NVC, I’m wondering what the NVC actually asks for when they acknowledge receipt of your petition. According to my lawyer just Australia will be sufficient, does anyone know if that is correct?! Any NVC specific advice from experience  would be greatly appreciated. Thank you!

  7. Not that interesting when you’re trying to get as much info as possible to plan your life! I asked this before we ever submitted a visa application. Just trying to weigh our options and make informed decisions.  This question was specific to whether or not the k-1 approval permits you to work while waiting for adjustment of status. Turns out you can, but it is another form and fee to apply for this privilege! Good to know, which is why I asked. 

  8. Thank you! That is encouraging. He was randomly selected from customs line and then when they pulled up his entry/exits they got suspicious because he was here the same time last year. They were accusing him of being here for the weed culture/trimming, apparently that’s a thing at San Francisco airport this time of year...I don’t know. He did disclose the pending K-1 and he said they pulled it up. He did not attempt to mislead, but eventually after a long time of interrogation he told them what they wanted to hear, thinking he would be let go. He does have strong ties to home. Hopefully we can move forward. Thank you for your insight. 

  9. I have submitted a k-1 visa for my New Zealand fiancé to come here to the USA. We received noa 1 in July, and are waiting for the next step. My fiancé came over to visit this week and was denied entry. He was randomly selected out of customs line at SFO and interrogated. They accused him of being here to work despite him telling them he was here to see me and I was there to pick him up. Eventually he signed something saying he was here to work, he said it was traumatic and he felt coerced into admitting this-being promised he’d be let go if he confessed. Anyway, he was immediately returned to Australia where he lives. He has had his tourist visa privileges revoked for the USA, and now I’m horrified for the fate of our k-1 fiancé visa. 

     

    Does anyone have insight or advice. I assume I need an immigration lawyer, what kind? So far the ones I’ve contacted have said they specialize more in setting up businesses and assisting with green cards etc. I don’t know where to start.

     

    This happened Wednesday, I couldn’t talk to my fiancé until Friday because his phone was taken and not returned until he landed. So now it’s the weekend and I won’t be able to talk to anyone until Monday. Any ideas where to start? Thank you for any insight or advice.

  10. Hi, thanks for your quick response. I am the petitioner, my fiancé is applying to come here and had his mom’s surname as a baby for just under 2 years. I have already had my I-129f application accepted by the drop box center. I did not include any name change info or supporting documents in the application because I was unaware (so was my fiancé) that he had held his mom’s surname for a brief time. I guess there is not much I can do now except hope we can clarify with proper documents at the next possible stage. Thanks again for your time and response, best of luck to you!

  11. Hi, I am currently in a similar situation. My fiancé carried his mom’s maiden name for the first 2 years of his life. When his parents married, they had his surname changed to his current name. My fiancé didn’t even realize this until we submitted our app with no acknowledgment of his previous surname-his mother told him when she was looking for his birth certificate. So, now I’m freaking out thatbwell get an automatic denial based on this. Do you have any insight, how did it turn out for you? Thank you.

  12. Hi guys, I’m new to the forum and having trouble navigating this site, so please excuse me if this is a common question, and thanks in advance for any insight. 

     

    My bf (Australia) and I are just beginning to look into visa requirements for him to come live in the USA. I’m wondering if the fiancé visa (once theoreticially approved) would allow him to work once he arrives, or is he not allowed to do anything during the 90 day period? 

     

    Would we we be better off just getting married now and then applying for a greencard while he’s in Aus and I’m in the USA? Anyone with any experience or insight to this? Thank you!
