    Hi, I made the same mistake when I filed and refilled under C9. You will get the receipt for C9 and your work permit will be issued. USCIS will do nothing about the C31 until VAWA is approved. So don’t worry your C9 will be processed as long as your attorney filed it. 

    You mark C9 around the same portion you marked C31. The receipt for c9 will come since he filed it. You probably got c31 first because they received that before the c9

    He sure does not know what he is doing because he is wasting your time. This is your life pls go ahead and insist that you want a new one filed under c9 or if you can file it yourself!

    C9 category is issued while VAWA is pending so that petitioners whose abuser is a US Citizen can work while their application is being reviewed ( the reasoning behind this is such that the petitioner can be put in the same situation he/she would have been if there was no VAWA).

    c31 is issued after the approval of VAWA so that the person can now start to work before the adjustment 485 goes through and the green card is issued. 

    If your c9 ead has expired or expiring soon just file to renew in the same category c9 and continue to wait for your VAWA to be approved. 

    Since you filed March 2017 I believe your approval should come soon because people in this forum filed around your dates are now receiving approval.

    No that is wrong. C9 will be issues while VAWA is pending and c31 after VAWA approval. So since you have a 485 pls go ahead and file in the correct category with all supporting documents. Like I said I did the same and I have my ead now. All the best!

    I had exactly the same issue. I mistakenly filed under c31. What I did was to file another 765 in c9 and included a note telling uscis to withdraw the earlier one which was a mistake. Include all relevant documents that should go with 765 and prove of pending VAWA and 485. The new one will be processed. I Filed with VAWA a 765 in c31 in feb 28 realized the mistake and sent a new 765 in c9 March 1(receipt date march6) with the note. My EAD in c9 was issued June 14 and I received it 2 weeks ago. So go ahead and refile in the correct category. As long as you have a pending 485 if not please file a 485 application together with 765 if your abuser is a US Citizen.

    The money you paid for the first 765 application will only be used towards that form even though it appears you chose the wrong designation c31. So if your spouse/abuser is a US citizen you are eligible to file 765(work authorization) under c9. Since you hava e pending 465 you can refile the 765 Application under c9 and include with the application a fee waiver form 912 I believe( please check), use this form to tell them you are unable to afford the fees perhaps because you don’t have a job etc. and your work authorization should be issued from  3 months of filing. Good luck! Please stay positive and keep talking to God. He will surely make a way!

    You need to send a new I-765 application using the correct class and also write a letter/note with it explaining you are now re-filing in the correct class. Support it with all relevant evidence that should accompany 765 including all your receipt notices from VAWA, showing you have a pending 360 and 465

       My husband did applied i130 and did sponsored i864 for both my children and me . I filed AOS based on his sponsorship. 

       We are divorcing now . 

        But my attorney is not good at immigration law . She does not agrees to send my I-360 and I -485, I -765 , also she said I can not  file I-485, I -765 for my children at the time . My children are living with me at USA now and they are very young.

        She said I only can file I -360 and I-765 choose c31 for EAD

       At that time my children and my AOS were pending . 

       

    She just wasted my 4months time and messed up my case . I got notice that USCIS denied my AOS I -485s that my husband did sponsored for my children and me , also revoked my EAD card . Deined my I-130s they my husband applied for me and my children. 

        I faird my attorney because I feel like she wasted  my time and messed up my case . I gave her my documents in Feb but even now she does not has good plan how to organize my case and just want to send I-360 for myself . But never send my case out only said I will be done it next week ! 

        I forward the notices from USCIS I got today to her and she said that is good . So she can purpose to file my VAWA . 

        

       I am looking for other attorney but since I am in the hospital give my baby birth , I don’t have time to find good one in short time . So I am thinking to send my case by my self . 

        Anyone of you please help me , what I can do ?

       Can I file I-485,i765, I 864w for my children same time with my VAWA together? My children are living with me at USA and my husband is a US citizen . 

       Can I file I-360, I-485,I 865w ,  I 765 choose c09 for my self ? 

        Is USCIS putting my children and my name on the removal list since my husband withdrawal his sponsor today ? 

        I do ask recommendation for a good attorney who is good at VAWA case and can take care of my case sooner . It would be good if attorney is in  MN or closer to MN . 

        I am totally lost ! Help me please !

    Yes, you can file everything by yourself just make sure you read the documents carefully and include all that is necessary. This forum will help and guide you if you have any questions.

     

    you can file 360,485,765,865w choosing c9 if your husband is a citizen. Pls ensure to include evidence of his citizenship. You can also file for your children at the same time. Send all applications to VAWA all at once with all supporting documents.

    I got an update on my I-360 application saying they received the letter I sent them. I did not send them any letter and do not know what they are talking about. I hope this is just a fault in their system and it is not that my husband has sent them something in my name....i’m Wondering

You have a strong chance. Include all the documents you have with you together with the pictures. If you don’t have your baby’s Hutu certificate, you maybe able to get a copy of that. Pls do further online research. For any documents you don’t have and you need you maybe able to get copies of those documents from relevant authorities. I wish you God’s best. I didn’t submit it with my petition because they say they only want it from places you have lived for 6 months or more. Not sure why they asked for it. Seems like a mistake to me. 

    Did you submit moral character from the US with your application earlier?

    Yes you are correct. You can keep working with your receipt notice that gives you extra 180days

    The rule I mentioned above is if the person didn't  receive the GC yet  but if the person divorced after receiving the  GC then the person has to file form l-90.

    To receive the GC with your maiden name file the AOS using your maiden name but  If you submitted already the AOS with your married name  then change your name in the S=social security card, state ID/driver's license  etc., and  at the time of the adjustment interview ask the officer to issue the GC considering your maiden name.

    Thanks a lot @sandranj for all your help and guidance. I’m wondering is it possible to also change my name on my work permit that I already filed. It has not been issued yet. Can I send a letter or something to Vermont telling them to issue in my maiden name? Will that work?

I withdrew c31 coz it wouldn’t be approved until vawa is approved. So I lost all the money. I came to find out a lot of lawyers don’t know about this vawa thing.

    Please how did you go about withdrawing the c31 application?
