Itineraries only show you booked a room doesn't show you actually stayed, it definitely doesn't show you both stayed.  What about boarding passes?

I am sure we could rustle up a few boarding passes on flights that we were on together... but we have always paid for them separately.

Jeez you've got me pretty worried about providing more proof. For 2 people who live together, I can't really think of much concrete evidence to prove anything.

What do you think of what I have supplied other than this sort of proof? I am looking for all-round feedback.

You can sign a lease or any other document and it doesn't mean you were face to face together.  Remember the purpose of the petition is NOT ongoing relationship.

I would provide copies of both your Canadian passports.  Do both your passports show entry stamps into the USA for your trip to Disney?

No they don't. As a Canadian, I don't believe I have ever had my passport stamped on an entry to the US.

But maybe I should search through my emails for flight/hotel confirmations with both of our names on it, if you think this would be better proof?

  3. Hey guys,

After 1-2 months of researching and gathering documents, me and my girlfriend Hannah are about ready to send in our I-129F. We are trying to be as thorough as possible to avoid getting an RFE... we want to get this right on the first try. Just hoping some people on here wouldn't mind critiquing what we have put together... everybody has been so helpful already, and I am hoping I can count on you again!

First, some background. Hannah was born in California to a Canadian father and American mother. She moved to Canada at a young age and has lived here ever since. She holds dual citizenship. We met here in Canada in 2015, and have been together ever since. We have been renting an apartment together since August 2017.

Recently, she has expressed a desire to move back to her state of birth to attend school, and eventually live/work in USA full time. I couldn't be apart from her, hence why we are filling for a K-1 visa so I can go along with her, and start our lives/family in America. We plan to live in a house there that her parents own (at least for the short-term.)

I originally had concerns about our eligibility for a K-1, since she has been domiciled in Canada for the majority of her life, but I have been assured by other users on here that it doesn't matter (at least at this stage of the process). As long as she can prove her American citizenship (her birth certificate), we should be fine.

So anyways, onto what we have assembled so far:

    - Cover letter (detailing the purpose of the application, along with a list of the contents of what we are submitting.)

    - G-1145 form (with my email address/phone number given.)

    - Fully filled out I 129F form (13 pages... LOTS of "N/As" given, as a lot of the questions do not apply. Neither of us have been married/have kids/been convicted of a crime. I have visited the US before, but I am not currently there, and I don't believe I was ever issued an I-94... do I need to clarify this? The form specifically states to only fill out items 38.a. - 38.h. if the beneficiary is currently in the US.)

    - Signed/dated Fiance letters of Intent (one from each of us)

    - Proof of our ongoing relationship & meeting within the past 2 years (includes a copy of our current lease on our apartment which ends in August 2018. Both of our names are signed on it. Next are 7 pictures of us together with locations/dates printed ranging from 2016/2017. Includes a photo of a trip to Disneyland in Anaheim, CA. As well as photos of us together with some of her friends, and one with my brother.)

    - Screenshots of our first few messages to each other. (We originally started communicating on Facebook, and met in person a few days afterwards.)

    - Also planning to include a page that has a few paragraphs of "our story". How we met, trip we have taken together..... anything that indicates us being together.

    - Proof of her American citizenship (a copy of her long-form birth certificate which she requested 2 months ago. On it, it is indicated it was issued MAR 2 2018. Also, a photocopy of a birth certificate that was issued by the hospital where she was born, and a photocpy of her SSN card.)

    - 2 sets of 2x2 passport style photos (enclosed in plastic bags, and staple to a sheet of paper.

That is what we've got so far. The whole thing is enclosed in a nice little report-booklet that we picked up from an office supply store. I saw videos on YouTube where others have presented it in this way.

Sorry about the long post, but if we can get any feedback of what we have that would be great! We want to be approved on our first try! Thank you in advance!

  4. We absolutely have intent to marry... we just don't want to rush it for the sake of immigration. But we absolutely would marry once I am able to successfully arrive on a K1 visa. I have this grand idea of giving her a ring when we arrive at the airport :)

There is just so little information on my specific situation... but if it is possible to begin the process while we both live in Canada, that would be amazing.

  5. I have searched high and low for information about this situation, and couldn't find any.

My girlfriend is a dual US/CAD citizen. She moved to Canada at a young age, and has lived here ever since.

She is applying to school in California, and hopes to start in September. We are trying to find out the best route for me to be able to join her without being apart for too long.

And before anybody asks, she is going to back-file her past several years of US taxes for the interview. We also have family in the US who would co-sponsor for the affidavit of support.

So my main question is, is it possible to begin the process for a K1 visa when we both live in Canada?

She has full intentions of being a student in the states, and we would even have her class schedule to use as proof in the interview, along with her parents allowing us to live in a house they own down there.

We do not want to rush marriage for the sake of immigration, so I am asking about K1 visas only.

My spouse also had not lived in the US since he was young. Unfortunately it will be an uphill climb to convince a consulate officer if she has never lived in the US as an adult. Most people who are able to re-establish domicile are people who have been temporarily gone from the US. They want to see concrete proof like a job, house purchase, lease, etc. We moved my spouse ahead of us and we visit regularly.  I am not sure if your spouse has been filing US taxes but that is also a requirement. The number one reason why Canadians are denied is lack of domicile. Your wife will also have to show she can financially support you.

I have not read anywhere that filing US taxes is a requirement. That is impossible for us, as she has never worked in the US. She moved to Canada as a small child. What options do we have?

I just don't understand how her applying to schools/having a confirmed place to live isn't enough evidence for them. So frustrating.

We want to be apart for as short of a time as possible... and I have not found any info online from people in a similar situation to us.

My girlfriend and I both live in Canada. She was born in California, and holds dual USA/CAD citizenship. Her family moved to Canada when she was a young age, and she has lived here ever since. We hope to marry, and live & work in the US as soon as possible.

From what I have read, Canada no longer offers Direct Consular filing for green card applications. In our hopes to not have to be apart for any extended amount of time, would she be able to file for a K-1 fiance visa for me while she lives in Canada? Ideally in this case, we would both be able to continue living together in Canada while the visa is being processed. Once processed, we would move to the US, and marry within 90 days (likely just a courthouse marriage for times sake.)

Is this allowable? We understand she would need to establish her intent to restore domicile within the US when it comes time to file the affidavit of support (she is planning to apply to school there)

Any advise on whether or not this is a solid plan? If not, what options do we have?

Firstly, I just want to clarify... it is my understanding that my girlfriend would only have to show her "intent in good faith to reestablish domicile in the United States no later than the date of the intending immigrant's admission" in the affidavit of support. She would not move back to the US before knowing whether or not I could join her.

As proof of her intent, we would be able to show her applying to schools/jobs, and a letter from her parents (who own property that we would live at in the US)... what else would we be able to prove?

We would likely use a co-sponsor (I have extended family who live in Arizona) to meet any outstanding requirements.

I understand that, once I am admitted to the US on a K-1 visa, I would not be able to work until I file for permanent residency, or a work permit. I would be able to support myself with my savings during this time.
