  1. Well it turns out she did receive it and either didn't tell me or maybe she did but I had forgotten since the biggest concern is her being allowed out of the country to visit her sick mother.

     

    I'm looking at it now and it's the EAD card alright. It says at the bottom: "Serves as I-512 Advance Parole".  She didn't receive the turquoise I-131 travel document but I assume this I-512 means the same?  Is it safe for her to travel out of the country given her current status?

Hello, we filed an I-485 last summer and in February we received an I-797 stating that her I765 is approved and that they would be mailing an EAD card or Form I-760.  We also received a second I-797 approving her I-131 to travel out of the US and that he document would be mailed. The I797 states that it's active and the validity is until 2020. 

     

    It's now July and we haven't received any of the listed documents.  I imagine they have our correct address because it's the same address they sent the I-797 documents.  We have travel planned mid-August out of the country and it would be great to have at least the I-131 in hand.  Is it normal for these documents to take so long to be sent?  Is there any action we can do to find out what's going on or expedite this process?  She's on a student visa, she's taken her biometrics but we don't have our interview scheduled yet.  Is it safe for her to leave the country either before or after receiving the EAD or I-131?

  3. We field I-864, I-485 among others to file for AOS and I received a letter today stating that insufficient proof of income was determined based on what we submitted.  I (the sponsor) had only supplied my last year's tax return and current month bank statement.  They're asking for:

     

    - All supporting tax documents (W-2s, 1099s, etc.) for the most recent year.  The petitioner/sponsor must submit all supporting tax documents for the recent year. 

    - Based on documents submitted with Form I-864 the income did not meet the poverty guideline.  Submit evidence of assets that meet the standards below (etc...)

     

    They also talk about how I used line 1 of my IRS Schedule C instead of line 22 for total income.  I assume I need to amend I-864 and resubmit?

     

    - The petitioner/sponsor lists their current income as an amount to be considered sufficient, however no evidence has been submitted as proof.  Such evidence should include:

       - pay stubs for previous 6 months

       - evidence of other income including dividends, etc...

      - Letter of employment, etc..

     

    The questions I have are:

     

    1. Should we fix I-864 to use line 22 for total income based on my tax return?

    2. I will get my letter of employment, pay stubs, bank statements, all brokerage account statements, etc.. which i will submit

    3. Since I'm the sponsor with the income (she can't work), what evidence should she submit?  My assets and income meet the guidelines, I think I just didn't support enough evidence which is why they are asking for more info?

    4. I assume I will need to enclose my tax return again (even though they already have it?)

     

    I want to make sure I submit this properly so there aren't further correspondences of this nature.  Please let me know if the above should be sufficient or if there are other things I should do?

Our current date became current and we filed all of the above documents.   She's on an F-1 visa and I'm a permanent resident.  She checked one of the UCSIC websites and it says it will take 13 to 28.5 months to process the I-485.  I assume this means to get a green card?  The wait time for I-131 and EAP (for employment) seems to be only 2.5-5 months.  If my understanding is correct, she will be able to freely travel and work after ~5 months or so?  She's worried that she is stuck in the US without being able to safely travel outside for another 2 years.   Any advice is appreciated.   Thanks.

    This is meant to read that we filed the I-130 + I-130A and our priority date is current.

  6. I'm confused by the existence of 2 separate visa bulletins:

    I'm a permanent resident and we filed our i-130 2 years ago for my f1 visa wife. Our priority date is 05AUG16.

     

    One bulletin says dec17 and the other july16.  Which one is the proper one to follow for sending in i-485 and other forms?

  7. So we realized (from another thread) that we are late for filing and since we have all the documents ready, we would like to proceed to send everything in.  She's on an F-1 Visa now and in good standing.  Some quick questions:

     

    1. For I-131, we checked Advanced Parole but will not attach any supporting info since we're sending it in with I-485.  I assume this is fine?

    2. Should we use her ITIN number in all of the SSN fields?  It's not really a SSN so we left it blank.

    I-693 Medical Examination - we didn't do this yet but will send separately as soon as it's complete!

     

    We plan on using paper clips to hold each form together separately and then a rubber band to tie everything together, then send to Chicago.

So re-reading the Visa Bulletin, it's still unclear if our priority date is current.   https://www.uscis.gov/visabulletin-aug-18 shows 01DEC17 for F2A and since our priority date is 05AUG16, does that mean we are over a year behind and should have filed a year ago?  But https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2018/visa-bulletin-for-august-2018.html

     

    shows F2A     22JUL16 which indicates our priority date is only weeks away.  Is there an error on the website?

  9. Hello, my wife is in the US on an F-1 Visa and our Form I-797C shows a priority date of Aug 6, 2016 and notice date of Aug 5, 2016.  The latest Visa Bulletin https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2018/visa-bulletin-for-august-2018.html

    only shows FINAL ACTION DATES FOR FAMILY-SPONSORED PREFERENCE CASES of 22JUL16 for F2A and "DATES FOR FILING FAMILY-SPONSORED VISA APPLICATIONS" of 01DEC17.  Does that mean we're able to file now?

     

    Sorry if I'm missing anything obvious but it seems as though they changed their Bulletin format and that we were a month or two away previously.
