  1. Hello,

Thankyou all for taking the time to read this.

So Great news. I had my medical a few days ago.

I’n little worried as I have had Depression for 6 months and also Doc decided I was BDD. As I have had plastic surgery procedures. Which again is more down to vanity and insecurities.

Will this afffect me at my interview. This is giving me a little anxiety.

I know a lot of people have and do suffer with depression / anxiety.

It’s the stigma of the word depression that worries me.

They have asked for a detailed report from my doctor regarding my depression. The doc seems to think BDD is self harm. Which is a shocking label to put on plastic surgery. It’s a form. Maybe. But he classifies it as such.

Has anyone else had to get this detailed report from the Doc.

  2. Guys,

A Few Questions if I might,

    1. What's the best country to get married in?

    2. Where do I stand with the lawyer giving out the incorrect advice? That's Huge to get it wrong on these levels. 8 months away from my partner to having to do IT ALL AGAIN. 1800 Dollars later in fees.

    3. What's the way to cancel the K1?

Ps. All of you whom are with your partners are SO lucky. This is hugely depressing time.

This is where you are wrong.

You CAN get denied for having a wedding ceremony EVEN IF IT IS NOT LEGAL. There have been plenty of people who have gotten denied for this very reason.

Here are a few threads on the very topic...

Thankyou so much for sending me these. Much much appreciated. You all have given me better and much more correct advice then my own immigration lawyer who is taking thousands in payment, but not advising a single correct. Really Makes it difficult.

Sorry Rabia looks like K1 will be denied if the topic of your religious marriage comes up and very likely it will.  These are the rules whether we agree or not.

you will have to get legally married and apply for Cr-1.  Another year wait after filing.

:(  sorry but it is what it is.

Solicitor is stating it is correct. So frustrating. He is sticking to his story. I advised him can my hubby come over and register our marriage. He states he won't get accepted for visa. As he will need a visa to get married????

I am surprised that the airline let you fly on an Esta with no return ticket..... What airline was this?

Hello, they didn't. They asked me to book return and that'll be fine. I didn't know the rules (stupidity) I then again foolishly told her I am

going US as I just got married and i'll complete my paper work there. ( under the incorrect advice from my "husband") she then took me over to the officer and he rejected me on the basis of I'm not going for travel. Now I cannot apply for ESTA ever

You are too married for a K-1 visa, so get married by law and apply for the spousal visa.

Lawyer is staying that my husband ( fiancé ) will have to apply for UK VISA to marry me????

Even though he visits me every few months. But he is stating he will not get accepted by the Uk to come and marry?

I think we may have just picked the wrong lawyer. Any more bad luck is unbearable.

  7. According the the solicitor the UK wouldn't auth. He didn't say any more then that.

When my husband originally went to them for help in our case he stated I am unable to do a spouse visa as a religious wedding does NOT count as lawfully biding, so you and your 'wife' will need to do K1 instead. We was pretty taken back as we were under the impression it was Law bided. ( incorrect advice from my parents, this is the case if you marry In India/Pakistan and then apply for UK visa, the religious ceremony will suffice. But we soon discovered we are not actually married. Reading this thread what my husband should have done, was come back to UK, ( as I was banned on Esta) and register our marriage and apply for CR1. But instead we followed the incorrect advice of a immigration lawyer. He said the quickest option is K1. Fully knowing we are married ( we thought we were), until he saw our religious paper work and said he does not recognise this. And it's unbinding. Then saying you are Left with K1 visa only. It's now been & months. No news back. Judging by every comment it's the wrong visa. But this immigration lawyer is adamant it's the only one as we are not officially married. Now is he abusing our kind nature to make more money. Is all I can think of.

Legally religious ceremony does not count. Unfortunately, sometimes USCIS or even after getting approved at the interview stage people get denied because of a religious marriage.

Customs won't do anything, your rejection from entering also won't affect it. but the ceremony may affect.

There are many cases we saw here that even a engagement ceremony caused a denial (it is possible that it may not too, but we usually hear the denials)

You can marry, but if you are legally married, then you need to stop k1 and apply for CR-1

overall your esta denial will not affect any of these processes. And definitely research more on how to and what to do when applying immigration visas.

The immigration solicitor has stated that IT IS the correct visa. I'm not sure wheather he is giving the incorrect advice in hope that when it does get rejected we will have to use him for the CR1 visa. I emailed him now asking for clarity. He was very blunt and just it is correct as as a relgious ceromony is not law abiding which means you can ONLY use K1 visa

I then asked if I could stop and start an CR1 visa, to which he informed me my US citizen Husband/Fiancé will not be granted visa for the UK to marry?

    Why not?

He visited me in the Uk every few months. But is stating he will not be eligible to go UK to get married as he wouldn't get visa.

I'm set that the solicitor is mis leading in order to make more money on fresh applications later down the line.

If it is a full marriage, again your k1 is out.

k1 is a fiancé visa. why would you apply to k1 if you think you are married?

At the interview so many people get rejected for being married because of this, even if it is not legally binding.

    Hello,

yes by law we are not married. Religious. Ceremony does not count. I.e. Why I've applied for K1 and not change of status. If I had known that we was not officially married, I would have done that part and then applied for spouse visa instead. Now I'm applying for K1. Been 8 months. Do you feel my intuek rejection at Customs will deter my K1?

Unfortunately, you have made some serious mistakes.  Although the ESTA denial won't affect your K-1, the religious ceremony you had could.  Many couples here on VJ have been denied for that very thing.

Of course you were denied entry to the US......you have immigrant intent and no return flight......

Good Luck on the rest of your journey.

Thankyou For your reply , much appreciated.

Could I ask, How will having a relgious ceremony affect the procress?

Some years ago the religious ceremony sufficed as a lawful patership. When my brother married I that I assumed was the case many years ago. Me and my husband assumed that was also the case. I understand I will now never be able to apply for an Esta.

if your intention was to finish the second stage of religious ceremony, then why did you book a one way ticket?

    Hi,

one way due to thinking I could apply for marriage registration in US. I was under the impression i'll have to go back within 90 days. I was planning on booking a return later down the line. Also at this stage me and my ( husband ) were under the impression that our religious ceremony included a Full marriage under law. As we had a religious scholar give us paper work. When in fact that just actually only means you are married by Relgious customs.

  12. I did a religious Ceremony for marriage in may. I was under the impression that was a marriage by law too ( mis advice by family ) I then booked a one way flight to USA as I didn't know which date I would return on within the next 3 months.

The lady at the airport asked why there was no return flight and that is a term with an Esta visa. Which I was not aware. She then called the me to go to the homeland officer.

Upon arriving at customs I was rejected by homeland due to not having a K1 visa. We was all mis advised on which visa could be used just to travel to the USA and spend time with my partner. I was ovisly planning on going back within 90 days. My sole purpose was to complete our second stage of our religious ceremony in the USA, so his friends and family could attend.

Since I have applied for k-1. Its now been 8 months and NO REPLY.

Yesterday I re applied for a Esta and was rejected. My fiancé sister is having a baby and I am missing out on big family moments.

Would that Esta rejection reflect  poorly on my K1 visa application?

This has been a very depressing time for me and my partner. Spending all our money on visiting on other counties in order to be with each other.

Any advice would be much appreciated.

    Thsnks in advance
