  1. 08/19/24 - Mailed I-131 paperwork to USCIS

    08/22/24 - USCIS received I-131 request

    08/28/24 - I-131 Approved

09/03/24 - 2 Letters received in the mail via USCIS. One stating the approval, the 2nd stating they would use the biometrics from the previous I-131, so no need to take them again.

We were approved and USCIS used biometrics from 31 months ago. Just waiting for the new document now. Thought I would post an update in case anyone is in a similar position trying to apply for a 2nd I-131 while the current one is not expired. And just to re-iterate, we sent in the current travel document that did not expire for an additional 6 months. As stated in the instructions, this is a requirement and likely helped with the quick approval.

  2. We messaged USCIS through the chat and they said to go ahead and apply. The instructions say we can apply if we send the current re-entry permit. (see attachment) We read different accounts ranging from 180 days to not being able to apply until the current one is not valid. However, it seems like all of the information is outdated as much of the material is written when the re-entry permits were taking 3 months, not 15+. We have gone ahead and sent in our information as well as the current re-entry document. It's extremely unfortunate how little guidance USCIS has on this subject, 15+ months for a re-entry permit is ridiculous. Very much appreciate the reply! Will try to post updates if anyone has this question in the future as we found almost zero guidance on the subject.

  3. Hello,

I noticed there is a new question on page 4, part 8. The question is about Operation Allies Welcome, which clearly does not apply to a our re-entry application. My question is, should we simply answer the question "no" or leave it blank. Obviously N/A would be the best answer to this question, but it only gives a yes or no option.

    Thank you!

  4. Hello,

Was wondering if anyone had any advice when applying for a *new* I-131. Some background info; Our current I-131 travel document is set to Expire end of February 2025. We have not needed to use the I-131 as intended, we were planning to be in Japan for a lot longer, but that just did not end up happening. Because the I-131's are still taking a very long time to process, we are wondering if we can/should apply right now for new one right now. We have read many pieces of conflicting advice online on when to apply for the second I-131, I'm hoping someone could help us with this problem.

Thank you for any and all advice!

  5. Hello,

Was wondering if anyone had any advice when applying for a 2nd I-131. Some background info; Applied for current I-131 on 11/2021, was approved around 01/2023. Due to our life situation we are not going to end up using the travel visa as intended. My wife (who applied for the I-131) will be spending *more* than 6 months per year in the US during the duration of the travel visa, we will also be filing US taxes during that time. I think we have a good chance of being approved for a 2nd I-131 because of this, but I'm not 100% sure.

    My question(s) are as follows.

    1. Does anyone have any experience applying for a 2nd I-131?

    2. Any advice on when to apply for the I-131? Due to how long the i-131's are taking to process, we aren't sure if we should go ahead and apply right now as they are taking 1+ year to complete.

Thank you for any and all advice!

  6. Hello,

We recently filed for an 1-131. We are trying to figure out when we might hear back about the Biometrics appointment. We received our NOA1 back on October 24th. Any help would be very much appreciated. :) Not sure if it matters, but our local USCIS office is Portland, Oregon.

    Filing Date 10/21/21

    NOA 1         10/24/21

  7. Sounds like a lot of us are in the same boat.

I re-submitted on February 4th, still waiting for DQ as well. (Been at the NVC level for 5 months now)

Unfortunately it looks like the wait times to be reviewed are pushing 9+ weeks now. It's a pretty bad system to have people wait in the same line over and over. However, I don't think the current office is in a rush to be approving Visas, so maybe to them the delays are a good thing. 😔

It will be interesting to see if the wait times increase even more due to Covid-19. They can certainly use that as an excuse...

Current case review time: As of 2-MAR-2020, we are reviewing documents submitted to us on 26-DEC-2019.

One more thing, when I wrote the letter I added a bulleted list of the things that had done to prove that I was making concrete steps. I had always kept my driver license and my mailing address so I didn’t add that info. I added new things that showed I was working on going back just like I had to do things or make changes in my life to move myself and my son overseas 8 years ago.

Thank you for the additional information. It sounds like you are building a "plausible" story to re-establish domicile. This is very helpful. Unfortunately the US government has a harder time believing self employed people with no kids. More reasons for us to just run away again I guess lol

  9. Hello Trav,

The NVC lists their current processing times on the link below. It looks like it's currently taking about 8 weeks to review documents, but this is just an estimate.

Current case review time: As of 27-JAN-2020, we are reviewing documents submitted to us on 25-NOV-2019.

Thank you for your reply. Unfortunately I am self employed, showing a job will be difficult for me. I used my parents to Joint sponsor the financial portion, so far they have not rejected that part. We also do not have any kids.

Do you remember how long it took for them to view your document support? It's really disheartening if we truly end up back at the end of the line after waiting 8 weeks to say "give us more info"

  11. Thank you for the reply, I've actually read this link and a few others.

Unfortunately these lists appear to be rather ambiguous in their definitions of proving domicile. I provided a current drivers license with a permanent mailing address on the first submittal.

Long story short, I'm just trying to be extremely clear on which documents to send considering it can take another 8 weeks to even look at them. :(

  12. Hello,

I have been requested additional documentation by the NVC as follows:

Additional support documentation is required. (I, the petitioner) might not have principal residence or be domiciled in the United States, please provide proof of domicile.

    NVC Timeline

    11/08/19  First submittal to NVC

11/26/19  NVC requests proof of domicile and 2018 taxes (or reasoning for not filing)

11/27/19 Submitted *current* US drivers license and US passport, as well as reasoning for not filing taxes in 2018.

01/28/20 NVC requests additional proof of domicile from me (the petitioner)

My family co-sponsored the financial portion of the I-864. Currently living in Japan with my spouse, waiting to be approved and then move to the U.S. after. (As is why they are asking for proof of domicile I guess?)

Additional documents I'm thinking to provide:

** Car ownership (with updated registration and proof of insurance of the last 2 years)

** Credit card accounts with the same address as my drivers license

** Bank accounts with the same address as my drivers license

** Passport stamps that shows me coming back into the U.S. 4 times since leaving

** A signed letter stating my intent to move with my spouse once the Visa is approved

    Questions:

Looking for advice on which specific documents to provide as proof of domicile. (I don't want to get this wrong again)

After submitting, will we have to wait the entire 8 weeks again to be reviewed? Anyway to speedup the process, we have been at the NVC level for 3 months now.

ANY and ALL help would be very very much appreciated. We did not anticipate this problem occurring, we thought we were in line for an interview date. It's pretty disheartening after over 8 weeks you get a tiny email that says "give us more" with no specificity in which to provide.

  13. It just took me over 8 weeks to get a response for a document. According to their website they are reviewing documents from 11/25/19 on the date of 01/27/20. Has anyone ever seen a waiting time of 8 weeks for the NVC document review? It doesn't appear to be any faster when you re-submit. Going to the back of the line every time they have you re-submit seems like a very inefficient system. Been stuck at the NVC level for 3 months now....

  14. Hello,

NVC has requested additional support documentation.

"I" (the petitioner) might not have principal residence of be domiciled in the United States. Please provide proof of domicile. (I have been living in Japan since 04/01/18)

    NVC timeline:

11/08/19 - First submit to NVC

11/26/19 - NVC requests proof of domicile and 2018 taxes (or reasoning for not filing in 2018)

11/27/19 - Submitted my drivers license and passport as proof of domicile. (also provide reasoning for not filing taxes in 2018.)

01/28/19 - NVC requests support documentation. "I (the petitioner) might not have principal residence or be domiciled in the United States.

I am self employed, and used my family for I-864 income support. Currently I live in Japan with my spouse, we are planning to move to the U.S. once her Visa is approved.

Additional documents I'm thinking to provide:

** Car ownership (with update registration and proof of insurance of the last 2 years)

** Credit card accounts with the same address as my drivers license

** Bank accounts with the same address as my drivers license

** Passport stamps that shows me coming back into the U.S. 4 times since leaving

** A signed letter stating my intent to move with my spouse once the Visa is approved

    Questions:

Will this new information be enough to prove domicile?

After submitting, will we have to wait the entire 8 weeks again to be reviewed?

ANY and ALL help would be very very much appreciated. We did not anticipate this problem occurring, we thought we were in line for an interview date. It's pretty disheartening after over 8 weeks you get a tiny email that says "give us more" with no specificity in which to provide.

  15. Hello,

I have a question about lockbox filing location. Me and my wife currently live Overseas (Japan). I looked up the correct lockbox, however, I am currently in the U.S. and will be sending the application from the U.S. I often travel to and from Japan (1-2 times a year). Currently I have my mailing address as my Parents physical address in the U.S., but my living address in Japan.... (I live in Japan but visit the U.S. often)

Would it be easier to have my mailing address via Japan or U.S.? Does this affect processing times?

    Thank you

  16. Hello,

I have been trying to figure out the answer to my question, but unfortunately haven't had any success via google. :/

I am about to file my CR1 package and am wondering about processing centers. I know that I initially send my petition to the lockbox, but am not sure how the processing center is chosen after that. I have seen that there are different processing centers with varying amounts of time. I would be filing from Portland, OR, I am wondering if I can choose a processing center, or will it just be the closest processing center to my location. I.E. California looks like it takes the longest so I'd like to avoid that processing center.

Any help would be very much appreciated.

    Thank you

  17. Hello,

I am currently filling out the I-130 form and have hit a slight hangup. My question(s) are in regards to questions:

I am the petitioner filling out this form and my wife is the beneficiary. This is the first time either of us have ever been married, we both have zero children.

    Page 6

21.a. Names of Beneficiary Spouses (if any)

    Page 6

    25.a. Information about beneficiary's family.

My question is, do I list myself as a spouse here? Or leave it blank, or put something like N/A.

    Thank you!
