  1. Hey everybody,

    My husband'S (USC) parents immigration visas has been approved on Jan 14th.

    I have a few questions about the activation of the visas.

    Am I correct in saying that they have to enter the US within 6 months of the visa being issued?

    Then the next question:

    Could they enter the US for a couple of weeks and then return to South Africa to finish up things there and then re-enter without any problems? If so what is the maximum period they can be out of the US?

    Can anybody point me to a website where I can get this info?

  2. So we are getting ready to file the I-751 and I just had a question about how to answer #7:

    Have you ever been arrested, detained, charged, indicted, fined or imprisoned for breaking or violating any law or ordinance, or committed any crime which you were not arrested in the US or abroad.

    So i got denied entry and was allowed to voluntary withdraw my application, had to return to South Africa to file for a K3 visa, got the K3, came to the US and filed the I485 and received my conditional greencard in Dec 2007.

    So I would answer yes to this question? Seeing as i was 'detained'. Is that right?

    Don't want to make any other mistakes with the USCIS.

  3. The next step is to apply for Adjustment of Status (Form I485) which will grant legal residency.

    Remember that she has no work authorization until approval of AOS unless she applies for EAD. (Employment Authorization Document)

    Fortunately there will be no need for AP (Advance Parole) as a K3 is a multiple entry visa.

  4. I read about what happened to you guys, i am so sorry!

    The differance between the CR1 and K3 timewise, is if you apply for the CR1 you have to wait for everything to go through the NVC, which could add an average of 2 or 3 months (just a guess-timate, you might want to research this) to your wait outside of the US. However when you enter the US you will not have to wait for work authorisation, as you will be entering on a green card which is valid for work.

    If you apply for the K3 you are allowed to enter the US to adjust status. ( like you were in the process of doing).

    If you enter on the K3 you are not permitted to work and have to apply for EAD , but wont need advance parole, as a K3 is a multiple entry visa :-)

    The K3 can only be done once you have a NOA1 for the I130.

    So i guess the consulate said that you should go the K3 route because it will get you back in the US quickest (supposedly).

    Our K3 visa and I130 application were both approved after 6 months (this is longer than average though), that was in May 2007, my interview at the consulate was end of June 2007 and my flight into the US early July 2007.

    Our adjustment of status was filed end of July 2007 and I received my greencard the end of December 2007.

    So it depends on your circumstances- whether you need to earn an income or whether you need to be with your spouse, this is what really will determine which route you should follow.

  5. My husband applied for an ITIN number in order to file our taxes jointly for 2006.

    I was not in the US yet, and had to have a copy of my passport notarised at the US Consulate in my country, which was accepted by the IRS and I was issued an ITIN number thereafter.

    The first time round I just sent a copy of my passport notarised by an notary from my country, but that was not accepted by the IRS.

  6. My mom passed away and i need to travel back to South Africa. :crying:

    I entered on a K3 visa, which is a multiple entry visa, i am just concerned about the procedure to follow- we just received notification for my biometrics which is scheduled for 19 September. I will be back in time for this.

    What happens with the I94 currently in my passport? Do i hand it in when leaving the US? Will i be issued a new one upon my return?

    We already received our NOA1 for the AOS, (i will be travelling with this too if it will help)- i really dont know what happens when i re-enter the US? (I dont have another magical brown envelope....)

  7. OK -- this is interesting to read about -- and painful to read about -- how can a USC spouse help?

    Awwww. That's so sweet of you to ask.

    In my case, it's to be aware that your spouse is far from home and everyday things can be a struggle at times. It's not that this is the case all of the time.... it's not. Sometimes just a hug is all that's needed. Or a nice flower for no reason. Tell them "I know you're far from home and you're probably missing your friends and family, but I want you to know that I love you and I appreciate you." Or "I know you're used to a certain product or item and it must be frustrating trying to find something comparable here in the US." The little things you say and do go a long way. :blush:

    I just spend the better half of this week overwhelmed by loneliness, it is like you have to start life all over again, and everything you where and did suddenly means nothing, and all your friends and family are going on with their lives and i am stuck looking at 4 walls, unable to work and that is the most frustrating thing ever. I talked to my husband about it, starting off by saying- this is how i feel, and it is not your fault, i just need you to show me that you understand how i feel, and the words above were just so spot on. I think i actually said that right now i need more nurturing than i ever have in my entire life, and on the flipside i also understand that suddenly being responsible for my every need can be frustrating in itself.

    But we love each other, and i would not be here if i didnt. Nobody said it was gonna be easy adjusting, but the loneliness really kills me. :crying:

  8. This might be a silly question, but i emailed the Johannesburg Consulate indicating that i had the following items in regard to evidence of support in order to confirm that nothing else was needed:

    I864 completed by my husband in May 2007

    Letter from employer

    Payslips for a few months

    Tax returns and W2's for previous 3 years.

    They replied and told me that the I864 does not need to be submitted to them during my consular interview, but will be needed for AOS in the US.

    My question then what is classified as evidence of support-what is the burden of proof for my husband and I?

    Any help, appreciated!

  9. Received an email from the Johannesburg consulate today.

    We received the packet 3 on saturday, but had all the documents ready, so just signed off the checklist and completed DS230 part1 and emailed it to the consulate. Then I faxed it, and yesterday i paid two hundred bucks to courier it via DHL to the consulate. Well they must have gotten it because i have my interview letter in my hand!

    Neurotic, i know, but i just want to get to the part where i have my visa in my hand and my new life which has been suspended for 10 months, 6 of those months spent waiting for approval of our petition.

    My interview date is 28 June 2007!!!! Yeah. And if all goes well i will be on my way to the US the first week of July. I cant hardly wait, we have a wedding to attend in Alabama on July 7th, so that would be great if there was no further hiccups!

    At least it is only 3 weeks that i have to spend stressing until the interview! :blush:
