Hello, I have a friend that may marry a gal that is currently visiting the U.S. without a Visa. She is from a country that participates in the Visa Waiver program. She did come to the U.S. with the intention of seeing more of America. They met, and it was love at first sight My question is, what would be the process if they decided to marry while she is in the U.S.? Can they marry and have her stay in the U.S.? What forms are required to get the ball rolling?
Any input would be greatly appreciated.

I made absolute sure that all my "t"s were crossed, and my "i"s were dotted before I sent anything in. I double and triple checked every document that went to USCIS, and I never received a RFE.
Maybe I am one of the lucky ones?!?!.......

I was just wondering if we will need all the photocopies of documents and letters from USCIS in the future. We have spent the last year and a half keeping documents, stressing about paperwork being correctly filled out, and all the rest of the jargon that comes along with working with the immigration folks....
What do all of you do with your paperwork?

My wife also got her Green Card today! We had our interview in Seattle on the 11th of October, and we received the card today!

The reason I ask when i may expect the first interview is because next month, my wife and I are going back to Turkey until September 10th. I would HATE to miss an appointment set up by USCIS while we are away from home.
This will be my wifes first trip back to her country since she came here in December. She is very excited to see family and friends!
I hate to say it, but a month after you file for AOS is a very bad time to take a long vacation. During the first few months you will be receiving lots of mail you need to pick up and will most likely get at least the biometrics appointment in that time, which cannot be missed.
Worst case scenario question...If we get the appointment notice for the biometrics while we are on vacation, is there any way I can reschedule the appointment?

Well, I thought I read something that stated you send the AOS for K3 visa holders to your home servicing office, unnless you lived in one of like 20 states (and I didnt think Washington was one of them). Sorry for the confusion. Now, I just hope everything runs smoothly.No, that is incorrect. You did the right thing by sending to Chicago.

Biometrics, interview, or anything that would require us to come in to the office in person?You'll get receipt notices for your applications in a couple of weeks. A couple of weeks after that you'll probably get a Biometrics appointment, which you will have to attend personally (the person getting the Green Card that is). After that you may or may not have to be interviewed.

My question is, what will happen next? Will they process it in Chicago? Send it back to me? Forward it to the correct office for processing? Any info would be greatly appreciated!

Dude, you sent it to the correct address! Well, you sent it to the LaSalle address which is meant for couriers, instead of the PO Box, but I doubt that makes a difference.
You're good, family based AOS applications should be sent to the Chicago lockbox, unless you're in a DORA area (you are not).

Hello all,
My wife and I are sending in our AOS documents in the next few days. My wife is here on a K3 Visa, and her Visa is good for another year and a half. In the AOS documents, it states we need to send in the I94 card. We are planning on going back to Turkey in the next month. I thought that the airline requires the I94 card to board the plane. At the same time, I think USCIS wants the original card.
I guess my question is a) does USCIS really need the original I94 card? or can they take a photo copy? B) If USCIS does need the original, can the airline use a photo copy when she leaves the country?
Any thoughts would be greatly appreciated.

Hello, we will be going in to the USCIS office because it has been well over 90 days since we applied for our EAD. It says we need to bring some passport photos; does this mean they will give us a Temp EAD on the spot? Or will we need to wait for it to come in the mail. Also, can we use the Temp EAD to get a SSN from the social security office? Thanks for all of your input!!!

One more question.... Is there a certain amount of time one must file the AOS if they have a K3 Visa? The Visa itself is valid for 2 years. Please let me know,

So my wife got her K-3 Visa on 10/19/06 and came to the U.S. on 11/30/06. We decided to file her Authoraztion for employment first, then file the AOS after we received the Employment card. Was it a bad idea to wait to file the AOS?? Or is the route I took ok?? Also, on the K-3 Visa, it says something along the lines of "this is related to a petition ending 2/28/07." We would like to know what that means...any help or input would be great!

I am sorry I am making this so hard. The only thing we have done since she came to the US is file for the EAD. That is all.

My wife came in on a K3 Visa about 2 weeks ago and we moved in to our own place a week ago.

Hello all,
I have always filed taxes in the single category. My wife will be here in a few days and she will not have any taxable income by the end of this year. Also, I am assuming she will not have a ssn before the end of the year as well. My questions is should I file something other than single (like head of household, married filing separately or jointly, etc.)? I am thinking that my status will need to remain single for this years tax purposes, even though we married in February. Thanks for your input!

I just found these boards the other day and they seem to be a great resourse for information about the whole Visa process. Too bad I did not find this sooner:)
My wife will be here on a K3 in a few weeks. I had both the K3 and the CR1 processing at the same time--I think--but the K3 was faster of the 2. I went back to visit my wife before she had her approval for the K3 and before I left, I paid a 380.00 fee to get the CR1 stuff sent over to Ankara. I think that I shouldnt have paid that fee because when she gets here on the K3 we will adjust the status and apply for the Work Auth...is that correct? Did I just waste that 380.00??? I am thinking that I will not be able to get it back. Or would I have had to pay that fee regardless if she came on the K3 or not....I am just not sure. Any information would be greatly appreciated!
Also, when she does arrive on the K3, I am correct in saying that she will need to file the Adjustment of status and can apply for the work permit at the same time arent I?

And if any of you are wondering how long all this took, we married at the end of February in Istanbul and she had her K3 around November 1st.
