  1. OK so if it's legal have them answer at the POE when asked the purpose of their visit, it is to adjust status and obtain a green card. If it's legal there should be no problem with the POE allowing them in the US. Also there would be no reason for anyone to have to file for a CR-1 visa since their spouse could just come on a tourist visa and them adjust status. So I guess all of us are really stupid and filed for a visa we didn't need.

    If you can get your family to come to visit you in the US with a B2 visa, then yes, you will do the same thing what I want to do so that you do not have to deal with the waiting time and the harassments of the CR1 process (CR1 is for marriage, the worse choice when people cannot do K1/K2)... The purpose of the B2 visa is to visit me and yes, in the interview for the green card my mom will tell them that she wants to live with me here in the US longer without coming back for another visa interview and she can travel to other countries easier without visa interviewing. The US only concerns the poor people who come here and be a burden (have a lot of kids, ask for medicare, well fare, unemployment....) for the country and people who commit felony/crime. I make good money, paying tax every year, donate to poor American and organizations, etc. My mom visits the US regularly and does business to contribute with the GDP, I do not consider that we are doing anything illegal here.     Check this out, it is LEGAL people. If my mom can make a LEGAL ENTRY to the US, I can file concurrent I-130 and I-485 for her, I might have to do I-20 for my brother and get him the F1 visa while he waits then. My mom and my brother never overstay their B2 visa or their I-94's permit in the previous entries. I think when they let people in the US (especially when they know the people who have relatives, immediate relatives) might stay in the US with their relatives, so they allow the concurrent filing to cut off the procedure of I-130 and I-485. I thought this forum might give me some extra experience and useful information but it seems I will not gain anything by following up this topic. I will hire a good immigrant lawyer to handle the case for me then.

  3. Hello all,

    I am a USC and I want to sponsor my mom with my 14 year-old brother to the US. They have been visiting me in the States for several times under B2 visa. Since I am naturalized US citizen now, I want to file I-130 and I-485 concurring for my mom and my brother when they come to visit me again this summer. My concern is that I might not be able to file for both of them at the same time (or my brother has to wait for a long time until visa is available for him). I wonder if any of you has the same situation and has a better idea of how to speed up the process for my little brother (I know that my mom for sure can get the green card and apply for my brother later on) because I do not want my brother stays in the US when his B2 visa expires and he has to go to public school here "illegally" while waiting for my mom to sponsor him.

  5. We went to the inform pass this early morning... and yes, we are all in the same boat with FBI name check and there is no way for us to know when it will be done. The longest time the immigration officer knew for this process was 4 yrs (no longer) :blink: So, I guess we are really in game and it has just started. I will keep updating any time I have new status on my case. Just want to wish you guys the best luck!

  6. We were end up with the same with you guys as well. The officer said we were lack a document which was called "security clearance" and he would mail us the notice... then he asked us to sign the signatures on some forms, explained the green card would be good only in 2 yrs.... then we were done. Now I am preparing to go for the inform pass at 7h15 today. Will update to you guys. I think FBI name check and Security clearance are different, I mean very similar process but different agencies.... They did tell us that if we did not hear any thing from them for 60 days, check back with them later. So I have no idea... Good luck to all VJs!

  7. Hello VJs,

    Quick question about wrong name in the approved document. We sent I-131 form with the AOS and EAD in June, we got the approved document for the I 131 (Advance parole) yesterday, but my middle name was printed incorrectly, called the USCIS this morning, they asked to submit proof which demonstrated that it was their mistake and it would take 3-4 months to get the new approved notice without repaying fee if it was really their mistake.

    I was wondering if there is some one here in the same boat, we have plan to travel to Mexico soon in this year and it is really a "pain" if it takes so long to get a new one. Anyway, hopefully they approve my green card in September 4th (our interview date) so I will not need that paper anymore.

    Any advise appreciates me! Thanks a lot

  8. I could not sleep last night, waiting for her news from the interview. At 1AM, she called me and told me the good news: they granted her visitor visa. We did some papers, wrote an invitation letter and filed the I-134 for her, she made it finally. I am so happy because we have been apart for 4 months now, we will see each other again soon. So happy to share with you here!!!

  9. Uhmm... I think American who has US passport still can get in the Consulate. My husband went to the interview with me (he stayed in another room) and he went with me to get the visa also (we went together this time with no problem). I do not know why they did not let you in, :unsure: Well, at last your wife got the visa! Good luck to your life in the States.

  10. I was interviewed by that handsome CO at cash 8, too. The Vietnamese lady translator was not so nice to me at first but after 1 question he asked me, she smiled to me. I did not need her at all in whole my interview. I think she is kind of "trouble maker", he he he... Yeah, totally agree with Hang that the female CO in cash 8 is really nice and handsome, he smiled with me a lot, too.

  11. CK&Tydi, I agree with you. I miss the food in Sai Gon to death eventhough I eat Vietnamese food everyday here. I miss BANH CUON TAY HO, hi c hic hic... Miss my family and friends there a lot too.

  12. Did you get new CMND yet? Hope yes.

    It was a pain to me to lose my ID in Sai Gon twice and it took 3 weeks for me to get new one after a lot of suck procedure. Anyway, I keep my ID as a "precious" asset of mine in the cabinet file at home in the States now. Good luck to you Hang. :dance:

  13. Hello VJ,

    We just got the ASC appointment notice today, we got one for AOS in July 12th ( we will be out of town for traveling in Indiana and Ohio until July 15th) and one for EAD in July 19th. We are wondering if we should ask them to make both of applications for only one ASC appointment in July-19th so we do not have to reschedule the one for AOS. If we do "have to" reschedule, any one has been in the same situation like us has idea how long it will take for the delay?

  14. Hang, HCM Consulate might require you to show his 2007 tax because the tax due date has been over for months. My interview was in March (before the due date only 1 month) but we prepared everything and they did get the 2007 tax papers, no need for the tax of 2004 and 2005. My advice is pls prepare the 2007 tax as soon as possible. Do not let them have any chance to say "no" or delay your visa! Good luck to you.
