    Hello there,

So my wife got here to the USA using a K1 Visa to marry me on March 2017. We got married on April and applied for AOS I-485. We applied in May 2017 and barely got our interview notice. I noticed the receipt says I must bring Affidavit of support documents. We already submit them in the pocket we sent back in May 2017. Do I need to get new ones? Or just a copy of the documents I send back in my original pocket is fine? Any other tips you recommend will be gladly appreciated. Yes we are very excited and kind of scared at the same time. i guess it's normal.

Does your I-797 notice say to "Bring the completed I-864, with all the evidence....(unless already submitted)"?

I submitted all the I-864 stuff with my I-485 application, and nothing had really changed with us income--wise, so I'm not bringing any copies of the I-864 docs. Is this unwise?

Hi, in your review you said that they always ask for Embassy letter along with a copy of your i129f. What does that

mean? Could you please clarify “copy of i129f” Do you mean the original package sent to USCIS or something else?

Sorry for the late reply. When the embassy mailed me by Packet 3/4, it contained a copy of the I-129f. Along with it was a 'cover letter' with my NVC number and and few other details. All it said was that I had to follow more steps to get the visa. It was basically a letter of notification saying that they had received the case and I had to start the visa application process.

Has anyone used a co sponsor for K1 visa at Mumbai ? I sent an email to Mumbai counsulate but they directed me to USCIS as they cannot give any info on that .

Assuming a co-sponsor for the I-134. Yes, I used a co-sponsor for the I-134. The co-sponsor filled up the form and have his latest tax form, letter from his employer and his bank account details, as listed in the I-134 instructions. All they asked me at the interview was how I knew him.

  4. I'm on a K-1 and prepping the documents for the AOS. I didn't get any  vaccinations in my home country, so I'm getting them here, including the medical exam (because no civil surgeon in the state is willing to transcribe just the vaccination stuff). My medical exam and doctor's appointment is 4 weeks away. It could take upto 6 weeks (depending on when the test results come). My main objective of sending the AOS stuff as soon as possible was so I can get the EAD as soon as possible and start working. So, I'm thinking of sending the AOS paperwork (I-485, I-131, I-765 etc)  without the I-693. I'm thinking I'll get an RFE and when I do I can send the I-693 but will that affect the processing of the EAD? Is this a stupid idea? It could save me a month.

  5. I know this thread was from a while ago but was there any resolution?

I did my K-1 medical a month ago in India and the doctor said I didn't need any vaccinations and hence, my DS-3025 is blank. Now I'm in the USA and not only do I need the vaccinations but need a USCIS civil surgeon to fill out the vaccination part of the I-693. There are 4 such places in Anchorage. No one wants to fill out the Part 9 (vaccination part) of the form without doing the entire medical (costing upto $1400). One wanted to sign me up for the 'Immigration Package' and when asked what it was, she didn't know and then said they don't do vaccinations. Anybody from Anchorage and the surrounding areas have any experience with this?

A couple things I caught. Note, I didn't do an AOS from a K-1 visa though, so not sure what additional documents are needed there.

    • Assuming you are also submitting I-130? If not, you need as supporting documents which you did not include in your list
      • Husbands' birth certificate
      • Husband's tax returns (at least one year, up to three years) and ideally last 6 months of pay stubs for his I-864
      • Evidence of bona fide marriage (e.g., photos, joint bank accounts, joint lease, etc.)
    • You only need one G-1145, attached to the I-130
    • Do you have any past EAD cards? If so, need front and back photocopies of all
    • Don't need marriage license with I-131
    • Include translation of birth certificate if not in English (seeing you're from Romania)

While adjusting from a K-1, is the I-130 required? It's not mentioned in the guide. Does one need to attach documents like the marriage certificate, I-94 etc to each form or just one copy in the entire package?

This is my two cents on it.... I just did my vaccinations today. I needed an MMR shot. You only need the I693 if your DS3025 is not "complete". After seeing an USCIS approved civil surgeon they gave me the sealed envelope of the I693. So I will send that in the AOS package. The original Vaccination Documentation Worksheet you got form your overseas medical is just a copy of the original which you turned in at POE. (It was in the package)

Btw it's hard to find a good civil surgeon around here who knew whats going on. Called like 5 from the website, some wanted to redo the whole medical, some didn't know whats going on even if I found them on the USCIS website.... So if you need one don't give up, call several until you feel they know what they are talking about....

Thanks. So, your I-693 will have your vaccination info. What about the other tests Eg: chest xray? How does USCIS get the rest of the info on the incomplete DS3025?

  8. Hi all,

I got my K1 a few days ago. We plan on getting married right after I get there, so the weekend after the next...and sending in the AOS package asap (end of July hopefully). I have started looking at the AOS forms and filling some info in. I have a few questions:

    1) My fiancee (USC) wants to change her last name. If she does that after we send the AOS package, does that effect our application? Should we notify USCIS after the name change? How is the name change done...at the SSA?

    2) Do I send in more than one G-1145 (Electronic Notification) for the AOS package or just one at the beginning? I will also be filing the I-131 and I-765. So, do I need 3 or just the one for the entire package?

    3) I already have a SSN (from previously working in the USA on a J-1). Do I need to do anything else regarding the SSA? Like get a new one? If no, then on the I-765, I don't want the SSA to issue me a social security card, right (Question 10)?

    4) My current immigration status on the I-765 is 'K-1 fiance' ?

    5) Do K-s1 receive an A-Number?

    6) I only make the payment for the I-485. The fee for the I-131 and I-765 is waived when I file them all together. Correct?

    7) Regarding the I-131, Application for Travel, am I applying for a Re-entry Permit or Advanced Parole? What's the difference? On the I-131, regarding Part 2, No. 1, am I a conditional resident applying for a re-entry permit (1a) or am I applying for an Advance Parole Document to allow me to return after temporary foreign travel? Is it ok if I wanted to travel for non-humanitarian reasons and its also not a personal emergency i.e. a holiday?

    8) In the I-765 instructions, this is written, "K-1 Nonimmigrant Fiance(e) of U.S. Citizen or K-2 Dependent--(a)(6). File Form I-765 if you are filing within 90 days from the date of entry. This EAD cannot be renewed. Any EAD application other than for a replacement must be based on your pending application for adjustment under (c)(9).  " I thought the EAD could be renewed especially since they give it for only 6 months, right?

    9) During my K-1 medical, the panel physician did not give my any vaccinations. It looks like I'll need to get them done in the USA. So, is this what I should be doing? Go to a civil surgeon who will give me the required vaccinations and fill up the I693 form...just the vaccinations part. The results will be in a sealed envelope that I submit when I apply for the AOS. This is assuming I find a civil surgeon who agrees on doing just the vaccinations and not the entire medical. So, this also means, I will have to submit the DS3025 from my medical in India and the I693 from the civil surgeon when I apply for the AOS. Is this correct? My DS3025 is not going to be sealed as the sealed envelope that I get from the embassy will be opened at the POE. Is this a problem? Do other folks just send their DS3025 unsealed?

    Thank you

  9. I have a few more follow up questions, now that I have researched the AOS process better.

I plan on getting the vaccinations in the US now. So, these are my options, right?

    1) Go to a civil surgeon who will give me the required vaccinations and fill up the I693 form...just the vaccinations part.

    2) Get my vaccinations done for cheaper at a public health department and get a record of it. Then go to the civil surgeon and the get the above done.

    Is the above correct?

    Thanks.

Hi @SMcNally  Thanks so much for the tips . It will help people like me a lot !!!

I have a question regarding the I-134 Part 3 question 38 what should my petitioner check -  "I intend" or “I do not intend”

If he checks " I intend" then what should be the explanation for that in Part 2 of the question ?

I did stress over this question a little bit. In my fiancee's form and our co-sponsors form we ticked do not intend...because we didn't have a specific plan of money being given. I'm sure when I go to the USA my fiancee will pay for a few things for me and I'll pay for a few things for her but since there are no specifics, we checked do not intend. Of course, if you're fiance is going to pay for rent, food etc, then you may want to check the other box and write some details down on the last page.

I don't think it really matters what you check as long as there are no inconsistencies for example if your fiance earns $25000 a year and she's paying $5000 rent a month for you...there's an obvious point here where she and you will be broke at some point. To me it seems like the consular officers are looking for the story that you present with your paperwork, and if there are holes in that story, then that's a problem.

  11. Since I started this thread, I just wanted to post my experience here for other folks in case they have the same questions:

    - We got our NOA1 on 11 September 2017. Based on the timelines, I applied for my PCCs (I needed 4) in January 2018. It's good to get this out the way, in my opinion. My India PCC experience is here: http://www.visajourney.com/forums/topic/661388-pcc-experience-in-bangalore-2018-split-topic/

    - I also only have a birth certificate from the hospital and my government one doesn't have my name. So, apart from my school leaving certificate, I also got an affidavit from my parents stating that I was their son and when I was born. This was done in January too.

    - We got our NOA2 on 13th March after 183 days. We waited for 10 days or so and then began to call the NVC to check if they had received our case. The third time we called, the case had been received (26th March). A couple days later we had our case number.

-Now we went to the CEAC website and waited till it said our case was ready. It was a few days later.

-Once the case is ready, do not wait for the embassy to contact the foreign fiance. Just fill the DS-160 and pay for the visa on the US Travel Docs website. All this takes a few days. Once all this is done, you can look at interview dates. Getting the dates you want requires patience. By the first week of April, I was looking at dates. Due to our circumstances, I was looking at an early July date. After a couple weeks, I got the date I wanted.

    - In the meantime, we got our I-134 stuff ready, and our photos, tickets and statements of intent (not signed until just before the interview). You'll have to bring the original copy of the statement of intent and I-134, not photocopies.

    - I wasn't home at the time but maybe the end of April, the embassy sent me a letter (by snail mail, not email) along with a copy of our I-129f. Keep this letter and take a few copies. You'll need this at the medical and the consular interview. To ensure you have this letter, try to get your interview at least a month after the case gets transferred to the embassy (or just call the embassy and see if they can expedite the sending of the letter).

    - And that's that. Do your medical, VAC stuff and the consular interview.

    - If your case is strong, you might think about buying your plane ticket beforehand. It could be cheaper buying a ticket months in advance and changing the date (in case you have to) than buying a ticket one week before you leave.

  12. Thanks for all the replies.

I went back to collect my medical paperwork yesterday and on the vaccination sheet, it says that I "didn't elect to take vaccinations", which is totally not the case. They also gave me the wrong CD and I had to go back and get the actual one. Since I traveled 560km for the medical, I'm not going back there for the vaccinations. I am unsure if I get the vaccinations at any other hospital in India, that they would be valid once I get to the USA. So, I think I may wait and see once I get into the USA . Maybe with the public health clinic and getting on my future wife's insurance, it could turn out cheaper.

  13. I just finished my K1 medical today in Hyderabad, India. I was expecting to get some vaccinations. I've received them all as a kid but have no record of receiving them. The panel physician told me that vaccinations are not required for K1 visas (and a quick search on these forums confirmed that). He also said, "I'll write you a waiver so that you can show that to immigration when you enter." What does this mean? Will I still need to get all the vaccinations when I file for the AOS? I rather do that here than the USA...wayyy cheaper. And do I go to any doctor to get the shots or does it have to be a USA consulate appointed physician? Anybody else who's not been required to take any shots despite having no vaccination records?

Hence, I wanted to know what other people have responded to the above mentioned question.

My answer is going to be:

    - Traditionally the wedding happens at the bride's place.

    - We wanted to choose a place that was special to us, which happens to be the place where we met, began dating etc, which happens to be in the USA.

I think having an answer that shows a decision made from a social or efficiency (for your life) point of view than a procedural visa point of view could be received better. My fiancee and I maybe talked about an Indian wedding for 30 seconds, and then I said, " Normally in Indian weddings hundreds of people show up." Decision made! ;)

Yes I know but they all still keep asking for it at the consulate

That sucks. I may have a problem with the birth certificate too but have all the backups. My plan is to to have a printed copy of the Packet 4 to show them what their requirements are...Of course, that may not work.
