    My point exactly! Is Gary/Mark the USC? If Gary has a legal name change then this is all a mute point because he would have simply submitted that along with I-129F. Did you submit the BC (for Gary) with the name discrepancy without any legal justification? This could cause a problem/delay for you guys down the line and I would not be surprised if you received an RFE. Good luck!

    As I said before, I am the USC. My husband Gary is a UK citizen by birth and has been a UK resident all his life.

    There wasn't any legal name change. When his mother unofficially changed his name, he was about a month old, and she didn't realise she was supposed to report the change.

    His birth certificate has not been submitted yet because we are only in the petition stage of the process. It isn't required until his interview.

    And I have no idea why they issued him a UK passport that was not in his birth name. It was over twenty years ago, and perhaps the law was more lax then. I believe they ended up ringing his mother to confirm his story. Perhaps the fact that he used his birth name Mark as his middle name was in his favour. Maybe they flipped a coin.

    I'll tell him to look into geting an affidavit from his mum. Thanks everyone for your comments. :) If anyone has other suggestions, please let me know.

    I'm going to go pull out a few more fistfuls of hair now. :wacko:

If the name on the birth certificate doesnt match the name on the application, you might expect an rfe, your case sounds like it could get very confusing for USCIS, I would prepare for the worst better safe than sorry. Now as to how exactly you would prepare I have no idea. Maybe call the USCIS and explain the situation to them and see what they say, and/or if nothing else go ahead and redo the the applications with Mark listed as the main name and Gary listed for other names used, this way at least if they do ask for corrected forms you already have them done.

    I should have mentioned that I'm the USC. As I understand it, he won't need to show his birth certificate until the interview in London, so I don't expect an RFE during the petitioning part of this process, though I could be very wrong. I posted in this forum mainly because I am worried about his K-3 interview. His police report, employment records, passport, marriage certificate, and school records all have his name listed as Gary. The only thing that doesn't is his birth certificate. He has effectively been Gary all his life; I don't think we could have used Mark as his main name on the forms without appearing fraudulent.

    There was never an official name change, though. His mother never amended his birth certificate; I doubt she had any idea that she should have. I'm not sure what sort of evidence we could provide that proves he is the person listed on his birth certificate beyond a statement from his mother and siblings. I don't even know if this is something that should be a cause for concern.

    Ah, well. Just another worry to throw onto my mounting pile o' worry.

  3. You should be filling out the immigration forms with his name exactly like it appears on his birth certificate and passport. You can put any other names he uses under "other names".

    The problem is that his birth certificate says his first name is Mark while his passport and every other legal document says his first name is Gary. This is why we chose to put Mark under 'other names', since he has never actually been known as Mark.

    His mother never told him about his early name change, and he didn't discover it until he applied for a passport. It came as a bit of a surprise.

  4. I'm not completely sure what forum to put this in or if anyone will be able to offer advice, but I thought I'd give it a shot.

    My husband's current name is Gary. It appears on his passport, tax records, and other legal documents. However, on his birth certificate, his first name is Mark. His mother decided when he was barely a month old to call him something else because, and I couldn't make this up if I tried, she was afraid kids at school would tease him and call him "Dirty Mark". Needless to say, she is bonkers and we love her. ;) He has used Mark as his middle name all his life.

    When we filled out our petitions for the I-130 and K-3, we did list 'Mark (last name)' under other names used. He had a bit of difficultly years ago when he first applied for a passport as 'Gary Mark', and I'm concerned that it will be even more difficult with immigration.

    Any advice? Is it laughable that I'm even concerned about this?

  5. My I-129f has been sitting idle at CSC since being transferred from Missouri. Is it normal to receive this update? Does EVERYONE receive this when they begin to work on your petition or what? Or does this mean a longer delay? ANY replies would be so much appreciated. I just want to know how common this is and if it is standard???

    Um..., huh. That does seem odd. Was that all there was to the message? Perhaps it was a mistake, because they can't possibly be re-transferring an already-transferred K-3, can they? I really hope not. :/

  6. We got our NOA1 October 13 for a K-3 and we are still waiting ... not very patiently. We were touched in November but that was probably because our address in the UK changed. If you search timelines there are still plenty of Octobers unapproved even though Novembers are getting approved ... don't understand how they can process apllications so randomly. My husband is arriving next Wednesday for a 10 day visit. It is what keeps me from total melt down.

    So you're who's ahead of me in the 'K-3 from the UK' queue. Hurry up and get approved already, would you? ;) It is a bit frustrating to see so many K-1 approvals while there have been no VJ K-3 approvals out of CSC since before Christmas. There are still VJers waitng for K-3s who filed in September and before. :(

    K-1's, be optimistic. CSC has been approving K-1 petitions both last week and this week; your approvals will come soon. We poor already-married-type persons will have to content ourselves with knowing that at least someone is doing something in California. ;)

  7. I wonder if it would be better if we couldn't check the status of our petitions online. When I filed for a UK fiance visa years ago, I didn't have the option of checking its status online. I was anxious about an approval, but not obsessed with it like I seem to be with the K-3 petition. Of course, the entire process took about six weeks, so I suppose it isn't a fair comparison.

    At least CSC seems to be working again. There have been a lot of K-1 approvals over the last week, some even with November NOA1 dates. Let's hope they decide to work on the K-3's next.

    Please-oh-please-oh-please work on the K-3's next, CSC! I'll give you a cookie if you do. Promise! :yes:

  8. I see they still make Razzles. "First it's a candy, then it's a gum!" It's a wonder I got through childhood with any teeth remaining because I used to go through three or four packets of those a day. What were my parents thinking! ;)

  9. I really like Lip Venom, a cinnamon-spiced sort of lip gloss/treatment. I look stupid in lipstick, which I can't keep on for more than five minutes anyway (even the long-lasting stuff), but love the blushing color and plumpness Venom gives my lips. It's about $15 and the most expensive beauty product I buy, but a little vial lasts a long time. Be warned, though, that it's sting can take a bit of time to get used to.

    My wife received her K-3 without any issues in October. We both arrived in US last week. Now I've to apply for her green card. I understand that I should now apply for her adjustment of status.     it mentions filling for I-130 and I-485. My question is:

    - Since I already applied for I-130, based on which I then applied for I-129F and she got the k-3 visa, I DO NOT need to apply I-130 again, Correct? I should simply file for I-485 at this point, right?

    You don't have to apply for the I-130 again. You will need to send a copy of the I-130 NOA2 approval you received in October along with your AOS applications.   11. That would make sense but look at garyandkris' timeline. They're a UK petition and the UK is our biggest ally - that is assuming we still have one now. Must resist rant on Bush... :lol:

    Don't rant about Bush online or USCIS will send your petitions to the bottom of the pile too. ;)

    It does seem that, in general, spouses from countries that have good relations with the US get faster approvals. A lot of that has to do with the time it takes to perform name checks, one would think. I haven't noticed Canadians getter markedly faster approvals than everyone else, though. It seems most of it is luck of the draw and whether or not you fall under Vermont's umbrella.

    Can I whine a tiny bit more about how I wish I lived closer to Vermont? Vermont, Vermont, Vermont! Argggghhhhhhh! ;)

  12. Is this the thread where I can moan about CSC and state how I wish my application could have gone to Vermont instead? Because I really feel like moaning. I'm having a day of impatience. I may return to being patient tomorrow, but today, not so much. Argggggghhhhhh! (No, I am not a pirate)

    cartman12, I hope you get a touch soon. Or, even better, an approval. Partly because you have been waiting longer than I have and partly because they have to get through your petitions before they will get to mine. ;)

    Maybe once I get an approval I can start using complete sentences again.

  13. Thanks I am sorry I posted this in the wrong forum I am new to this and don't know what goes where I just see one big headache heading our way. I am very happy that she is worth it though.

    This isn't the wrong forum, but I thought that the waiver forum might have more and better information for you.

    All the headaches and hassle will be worth it in the end. :)

  14. You may want to post this question in the waiver forum. There's some debate as to whether or not shoplifting is considered a crime of 'moral turpitude' (CIMT). Was she convicted or cautioned? If she received a conviction, you may have to file a waiver, I-601, if they do consider it a CIMT. However, I read in the wavers forum that someone who was convicted of shoplifting was not required to file a waver. I suppose the best thing is to be prepared and know that you might have to file a waiver.

    My husband was convicted of and received a small fine for kicking over a traffic bollard when he was 19, over 25 years ago. I am hoping that, as this is his only conviction, he won't need a waiver, but we are preparing one just in case. It seems insane, but, then, what is sane about this whole process? :wacko:

  15. I know I'm getting ahead of myself here, but I have a few questions about AOS and moving house.

    There's a possibility that my husband and I will have to move out of state in October 2007. Assuming he enters the US on a K-3 visa in April, how long do we have to apply for AOS, and is this amount of time based on the expiration of the K-3 visa or the expiration of the approved I-130 petition? I ask because I've read some nightmare stories about moving during AOS and would prefer to wait until after we move to file for it.

    Also, can he file for EAD without filing for AOS right away?

  16. Maybe the employees at the USCIS will be filled with holiday cheer and go approval stamp crazy. I'm not expecting them to get to my petition for a while, but for those of you who have been waiting forever, I'll keep my fingers and toes and legs crossed. Or something like that. :-)

    I'm a bit happy that I've actually been 'touched' today, even though I know it only means my petition has been moved from one large pile on a desk to another large pile on some other, hopefully nicer, desk.
