You can file for naturalization one year after you were required to file to remove the conditions on your green card (your i751 application), anytime after the 90 days before the third anniversary of your green card.

You can naturalize 3 years after you receive your original green card if you are married to a USA citizen the whole three years.

You can naturalize 5 years after you received your green card if you are not married to a USA citizen.

You are free to apply for a n400 even if your i751 is still pending but you can not be approved for the n400 until the i751 is approved. There is a good chance both the i751 and n400 will have a combo interview at the same USCIS appointment.

Biometrics will either be reused if USCIS has one that was taken in the USA if not you will get a an appointment notice to collect one at a local USCIS office, you will need to wait and see what USCIS will do.

Thanks yeah we are planning for file for n400 on May 10th. hopefully get biometric soon.

n-400 and i-751 are completely different petitions. as long as you meet the requirements you can file n-400

Travel is your choice. there is no restrictions on anything

thanks for the clarification . what is the timeline when we can file for n400 while i751 is pending. also my wife did not receive biometric invitation when we filed I751 so would there by any waiver for biometric ?

  3. Hello,

we have filed for I751 and its pending for approval. We have not received any communication besides 18 months extension letter.

We have 18 months extension letter from June 2020. My question is should we go ahead and apply for N400 on May 15 since on this day it would be 2 years and 9 months completed. Another question we have is can we travel to india during covid 19 period or should we avoid. Our Travel date is July 15th and coming back on August 15.

    Thanks

  4. I am in a situation please help. My wife CR1 interview visa is scheduled at Mumbai on June 11 th. Her Bio metric appointment is also scheduled on 8th June. However in her Chest Xray some finding has came up, the doctor has advised for sputum test. She never had positive TB in her life. She completed 3 day sputum culture test. The Medical Vaccination results will be sent to embassy on July 14th. At this point should i still let my wife go for her interview or reschedule at a later date. If so how can we reschedule the date? The doctors advised her Medical reports will be send directly and they would put her in Administrative processing stage. I have emailed ustraveldocs support for Mumbai embassy and yet have to receive any reply.

I am in the same situation as you. My wife had 3 day sputum test completed on May 14th. Her CR1 interview is scheduled at Mumbai on June 11th. Did they deny your visa for not having medical? How was the interview did you reschedule or you went for the originial interview as scheduled by NVC? Please kindly reply.

I have the same status and i am not sure Please follow the instructions you received from the National Visa Center (NVC) that list the six steps you must take before NVC can schedule your visa interview appointment. This includes submitting to NVC various fees, forms and documents.?? what does this status mean

    Hi

I'll be applying for reissue of passport with surname changed and adding spouse name to it. However in my ds application I didn't mention of any other name. Should I keep my current name and surname on passport or can I change it to new one? I just don't want to delay my process or want any issues during interview.

    Did anyone have similar situation.

Yes better to change the surname and add your spouse name to it. As long as you have it change in the Indian passport before your interview. Do you have police clearance certificate done ?

are you sure you're talking about the ds 261 or the ds260. Because the AOS does not usually open until after the ds261 is complete. You send the package with the full checklist requirement (with other stuff including the i-864 package) at any time. most send it after they have filed the ds260.

I have an attorney so it usually opens up both at same time and i paid the fees. I mean to say DS260. What are the next steps and how long does it take to get an interview once nvc stage is complete?

  10. Hi All Just a Quick Question regarding NVC process Cr1 visa

    TSC I30 Approve Date Jan 4th 2018

    NVC receive Date 9th Feb

    Case number assigned 12th march

AOS & IV fee paid same day 21st march

DS261 :- Waiting for 26th march. Do i have to wait until DS261 is reviewed by NVC is there any Dependency at this point?

When do i start sending I864 package & Send IV package . I collected all documents and did my taxes as well, and send to my attorney. Just curious what are the next steps.Any help or guidance would be appreciated.

you need to call to have ds261 reviewed over the phone or it will take several weeks for them to review it on their own. It must be reviewed before AOS will open up.

I am going to Submit DS261 form coming monday. I paid AOS Fee & IV fee, it says it will take 2 to 3 business days. Do they review ds261 after i fill it out online on the phone and send I864 package or before that? I am a little confused about the timeline?

  12. Hi Everyone i am in the NVC processing situation. Just trying to get the case number and Invoice number has been a challenge. I am all set with my NVC documents, and ready to go with my attorney.

    NOA 2 approved date : Jan4th.

But I am in a dead end situation. NVC received my case at Feb 4th. They told me that they backed up with all new uscis cases and will update on system by Feb 23. Then i called them and got it escalate to supervisor level where they took down all my info. However it is 11 th march still no case number or invoice number by NVC. Did anbody else face this same issue with NVC.
