  1. What do you mean by employment certification, the EAD and if so, did you apply for the EAD before submitting AOS?

    I'm referring to the letter from the employee stating that my hubby(petitioner) was working for them for _years. It is mentioned in the I-864 checklist, along with the pay stubs. We're thinking if we have to submit those or only the tax transcript.

    Sorry, but I'm not familiar with EAD. Can you tell me what it is? Thanks...

    Id like to ask if anyone here has the same my case. I filed I130 for my wife when i was resident, now i am american and updated I130 (of course I130 been approved and has a case number). Does anyone know how long it will take for my wife to get a visa to come here (because i want to go back there and visit her this Xmas :) )? Should i try other way like K3 visa? Another one, how long do they send stuff for me to fill out, like finiancial support or stuff like that? If anyone knows please advise.

    Hi. We're on the same boat. Have you sent an upgrade letter to the NVC? We sent it last week of May, and my case was upgraded on June 21. My hubby already received the DS-3032 form and AOS Bill last June 27. You have to check the NVC from time to time so that you will know your case status.

  3. I am from the Philippines and my husband (my petitioner who resides in the US) will be sending a letter of upgrade to the NVC together with a copy of his naturalization certificate and the approval notice.
    Must've been a long time since your husband petitioned you.

    hi aloha spirit, my hubby petitioned me way back 2004. I'm glad he was finally a US Citizen, he'll be upgrading my petition next month... Thanks for taking time reading my post...

    My husband filed a petition for me while he was an immigrant, and it was already approved. Now that he is a US citizen, he will be upgrading it from F2A to IR1. He will also file a separate I-130 for our child. As soon as our child's I-130 is approved, is it possible for us to have the same interview dates even if we have separate petitions filed at different times?

    In my case it took less than 1 week. My case is in US embassy in Pakistan and was on F2A catagory and waiting for my priority date. I sent the proof of my wife's passport copy to embassy and they upgrade it within a week.

    few days back i receive packet 3.5 from embassy.

    I hope someone can asking my question.

    My sister USC living in Florida and Iam a UKC. So I have to wait for a visa to become available under the fourth preference which could take a number of years. At the moment I've only been waiting just over a 1.5years.

    What I want to know is while I am waiting for that can i apply for a B2 Holiday visa which allows me to stay in the states for 6months and with luck you can have it extended ???

    also is there anyone out there from UK who is in the same situation and if so, how long have you been waiting.

    Hi Karen,

    I am a Filipino under petition of a US immigrant husband. He's staying in the US for 5 years and have just finished fingerprinting for his naturalization.

    Last year 2005, I and our child applied for B2 visas, hoping to stay in the US for the holidays but unfortunately, we are denied. The immigration officer just asked my husband's name and checked it in his computer and found that we are under an immigrant petition, a fact that we disclosed too in our B2 application. He also asked me how long he is residing in the US, and tell us he's sorry we can't have B2 visas.

    Even if we really have no intention of staying in the US illegally, we are denied of the visas. We have shown some evidences to prove that, (bank accounts, property titles and school records (since I'm just on leave from school), the immigration officer didn't bother to ask for them, the moment he knew that we are under an immigrant petition.

    You can apply Karen for a B2 visa but there's is no guarantee that anyone can have it, most especially people like us who are petitioned. You will never know, unless you will try... I have only shared my experience. Hope this helps.
