  1. Hello,

    Someone I know received an RFE for the I-130. They lost 2 of the 3 pages of the original RFE. Luckily, they had scanned the originals right when they received it so they still have those scanned files on the computer. The RFE mentions to send it in its original form along with the response but now since 2 of the pages are lost, what should be done? Can they call the CIS to reproduce them, keeping in mind that the due date for the response is only 3 weeks away? Or just print out colored copies of the scanned orignals and explain in a statement that they were lost???

    They should print out copies and send the copies in with the RFE along with a statement.

For what it is worth, I entered the US in 08/2005, married in 10/2005 (still intending to return to Canada at that time and have my husband file a K-3 application), then we filed an I-130/I-485 concurrently in late 2006. The immigration officer didn't ask me about my intent and seemed to be pleased that we had such a straightforward application.

    We had been in a relationship since 2001 and my now husband had resided with me in Canada from 2002-2004 (which we recorded on our biographical part of the AOS package).

    If your friend is denied due to her intent at entry, I'd imagine that she would find out either at her interview or shortly afterwards. She'd then be asked to leave the US and they'd for sure need an attorney at that point if she wanted to go about attempting to immigrate to the US.

    Maybe your friends should consult with an attorney, who can look over their application and let them know if they will need help with their interview. I did contact an attorney during my own process and he told me that my case was straightforward and that no attorney should be needed (perhaps my country of origin made my process more straightforward).

  3. You entered the US legally and are now married to a USC. It is perfectly legal and acceptable for you to concurrently file an I-130 and I-485 from within the US.

    If you are really worried about the intent issue, you may want to contact a lawyer who can help you with your interview process.

    According to USCIS policy, marriage based AOS applications are not to be denied based on "intent to immigrate" alone. If you have a valid marriage, and didn't lie when you entered the country, personally I don't think that you would run into a lot of problems.

    Then again, I'm not a lawyer, but I have adjusted status from a tourist visa, and have done a lot of research on the topic.

If you wanted to stay in the US, and remove your conditions without your spouse, you would A> need to be divorced (separation is not good enough), B> or if still married, prove that you were battered or subject to extreme mental cruelty (need all kinds of documentation, check the removal of conditions application for a complete list) or C> your spouse would have to be dead.

    I don't know if that is helpful to you, but at least you will know your options.

    As for success rate - I would think that those who entered their marriage in good faith and can send in documentation proving a legitimate marriage probably have a pretty good shot at self filing once divorced.

  5. Hello everyone, sending back my medical RFE argggghhh!!! any ways to send the medical back meaning what should I include? I have my sealed envelope...anything else?? also they gave me a PO box to send it too, is there another address? which is the best method to send this back!! Thanks so much!

    Also include the RFE letter (so they know whose RFE it is).

    Send it to the address on the FRE letter, sending it elsewhere would be dumb as it could cause you issues. I send mine through regular USPS mail and it got there in a few days. Good luck with it.

  6. You need to show income 125% of the poverty line (or use assets as well). It appears to me that they are asking for your cosponsor information. So you need to get your cosponsor to filll out an Affidavit. If the income is over the 125% of the poverty line, then there is no need for bank statements of information about assets.

    I don't know what your husband sent in, they may also want his......

    W-2's, 1099s, and/or all schudles submitted to the Internal Revenue Service (IRS)- a copy of his/her Federal income tax return was submitted and/or the sponsor or joint sponsor requested an extension to file his or her Federal income tax return. as indicated on the RFE.

  7. Hmmm, if a guys fiancee just lost a child, would he be so nasty? You would think he would be saddened a little. Makes you wonder doesnt it?

    ETA: Just thinking out loud of course. Im sure the story is true.

    You'd think someone who just found out his wife was cheating on him wold be a little bit less subdued.

Theft by Check: A person commits theft when property, services, or cash is obtained by deception through the use of a check which is invalid because of insufficient funds or because the account is closed. In this scenario, the property, services, or cash is exchanged for the invalid check at the time the check is presented. If not, then the scenario is considered an extension of credit only and therefore not a theft case. Further, a theft by check case can also exist when a check writer issues a stop payment order and refuses to either pay the stopped check or return the merchandise within 10 days after proper notice is given.

  9. Did you bother to inform them that you were "stopping" the check? They are entitled to a NSF fee is the check wasn't honored. Is there service poor? Put yourself in their place. They probably get a lot of patients who don't pay their bill, which is why they are agressive about collecting.

  10. He's waiting for that one special person to come along and offer the perfect answer. This is hardly a black and white situation and requires serious thought. If the thread was closed, the poor guy would not know what to do, seeing as he has no one else in the world who he can discuss this issue with (and that includes his wife!).

    Ok, another suggestion....Maybe you should call the friend's husband and see how he feels about it? He's pretty much in the same spot as you are. See if he went for the threesome or not.

  11. Is the cat male or female? I understand the trauma you must be going through to discover such a betrayal of trust but from what I have read elsewhere on this forum the emotional pain isn't so distressing if the new partner is of the same gender... now I can't think where I read that... Still I can see where your husband is coming from, I mean, cats are just so warm and fluffy, it is hard to resist their irresitable charms and when they start purring... oh boy...

    You're right! Whew. The cat is a male, so it's not ALL that bad.
