  2. Forgive me if I am asking the trivial questions here:

     

    My wife came from Canada and we got married last April 2018. I did an AOS in May 2018. She received her EAD and AP in September 2018. However, there is no update on her I485. She did her finger prints way back but the case is only updated to say Fingerprint Fee Was Received. It has been almost 8 months. We are located in NY/NJ area.

     

    What can I do at this point? Thanks

    By what basis does AP guarantee entry into the US? Only USCs are guaranteed entry.

    CBP has no say on the I-485, nor to determine the validity of a marriage.

    They won't deny entry unless there is a cause (i.e. criminal activity at the border or while abroad).

    the entry with an AP is solely on the discretion of the officer. say the officer denies entry for whatever reason Does this mean all the effort for AOS is wasted? 

     

    i understand  its rare but it’s still wrong that CBP has the power to ruin someone’s chance purely on based on their “discretion”

    unless you DID something to cause it.

     It’s a hypothetical question. If AP denied. Then is AOS automatically rejected. If so isn’t the CBP over reaching?  Given the current climate. Wouldn’t it be easy for the current administration to use this as a loop hole to reject immigrants who have traveled abroad while in AOS

    I submitted AR-11 via CoA online for I485 I131 and I756.

     

    so the only thing left is I130 via I865 which has to be done via mail correct?

     

    Do I also need to do the change of address online if I am the sponsor? Your advice is appreciated

    I never understand the American pasttime of having a mailing address completely separate from your physical one, unless it's PO box.  How are you getting all this mail that's being sent to California?

     

    Does 865 not have an online version?

    Just to make ale sure I get it right. Looks like my wife will need to file AR-11 and both of us will go through the online address change correct? 

     

    my mailing address is still the same. Will I be able to preserve the old mailing? When I looked over the online change tool it seemed like it didn’t specify physical vs mailing but it did have a special field for “mailing addeess”. I plan to fill in the old mailing address there - does it make sense?

    My wife and I are both moving. My wife is the immigrant.  and yes I am asking for both - I thought we only needed to do it online so I wasnt aware of the 865 and AR-11 

  9. I am moving from NY to New Jersey - my mailing address is not changing since I anticipated this move and used my permanent address in California where my house is as the mailing address on I485 and I130

    I am in NY/NJ for the next 6 months or so.

    Do I need to report the address change for my 485 and 130? My wife already received travel authorization and EAD. just waiting on interview appointment now. advice is appreciated!

I subsequently took a job in Albany, NY but I decided to keep my case in PHX mostly due to the fact that my living arrangements in Albany were temporary. I had my interview a week ago in PHX,  It was disclosed to io that we now lived in NY and also had drivers licenses from NY. The was no issue with it what so ever. Only mention of it was weather related.

     

    There in nothing in the law that requires you to file in the district you live in when getting a green card.

     

    Thank you so much for your clarification. so you flew back to Phoenix just to take the interview? If I can use my california address, I will be more than happy to!

    Not accurate. California is your permanent home and all others are temporary living situations. As long as somebody can always check your California mail then no issues here.  You will only encounter geographical limits on naturalization and not on green cards.

    to further clarify,

    I took a job in new york permanently and its just that I am keeping my california property.

     

    I read it online if you tell the interviewer that you are working and living in new york, they will stop the interview and transfer your case to NY jurisdiction, which translates further delay processing. please advise

  12. So I am getting ready to file the whole package (I 130, I485, I131, I765, G-325A, i-865) very soon.

     

    However, I do have a complicated address issue. please advice

     

    1. I will be moving from California to New York. in about 2 weeks. Should I mail the package after I arrive in new york? If so, do I put my NY address as my mailing?

    2. In new york, I might move again in 5 months. am I risking anything?

    3. My address in california can be preserved and accessed. should I use my california address? I consulted with a company that does this type of service, they said I CANNOT use California address. The reason is because the interview will be scheduled geographically according to the address I provided. and If I go to the interview and tell them I now live in New York, they will reject my case. Is this true?

     

    Given how unstable my living situation is, what is the best approach? (Job related, I do not get to choose..)
