Hello,

I hope that you can help me.

I am French, living in Germany and I am married to a US citizen who lives in NY.

We filled the I-130 and it has been approved in April 2018. We did not do anyhting since then, because I do not plan to move there right away.

However I plan to visit him over Christmas and NYE for about 10 days. I have a well paid job in Germany (I earn more than my husband) and I will be on an ESTA.

Will I have any problem at the border? I plan to show them my return tickets, the flights that my husband will book to visit me in 2019, as well as my paychecks, my work contracts and the proofs that I took the days off when I will be in NY.

I read so many different things online that I don't know what to think or believe anymore.

Do you have any experience with that? Is it possible to enter it if I do not plan to move there yet, but a bit later?

I thought the CR1 is valid 2 years and the IR1 10 years. Thanks in advance.

Thank you very much for those who gave me helpful answers! I will just ignore the messages that have already been deleted. And as someone mentioned, not everybody is desperate to live in the USA and it is not the ONLY existing option to be with my husband.

Those forums have been very helpful so far, so I am hoping again that you will be able to help me.

My I-130 has been approved and I received on April 28, 2018 an Email from the NVC saying that they received my case from the USCIS. They also mention at the end "If you do not log into CEAC or communicate with NVC regarding this immigrant visa case for a period of one year, by law the Department of State must terminate your visa application." 

The problem is that I do not plan to move to the USA yet. Our plans changed and right now, I work in Germany where I have a much better job, salary and insurance than I would have in the USA. Do you know how long my I-130 will be valid and what I should do to "keep" it? I also want to be able to visit him on an ESTA.

I don't know if it is relevant, but I am French, living and working in Germany. My husband is US citizen from NY. We got married exactly one year ago and filled the I-130 on September 1st, 2017.

Also if I wait longer, I will be able to apply for the IR1 and not the CR1 which is more interesting.

I would be very thankful for any advices, recommandations and/or experiences.

Thanks! We have SRC so 6 months. Could have been worst...

And yes I will apply in France and have my interview at the US embassy in Paris. But I will still translate the documents in English.

Is there a way to know where the petition went? Let's be positive and hope that it will not take that long

Yes he sent the I-130 in September to the USCIS in Chicago (he lives in NY) and we are still waiting...

Sorry I meant that I am applying for a vis FOR the USA. But I am currently in France and my husband is in the USA. Of course he is the one filling for me. But I have to provide those documents. SOrry for the misunderstanding and thanks for your answers.

Okay now I understand what you mean. I am applying for an immigration visa in the USA so I will have to translate everything in English. But I am pretty sure that I cannot translate it myself into English.

I will not translate my passport of course.

But birth, mariage and french police certificates that are in French will definitely have to be translated. The  German police certificate will also have to be translated. And all of those by a certified translator. 

But I also found this whioch confuses me "Apostilles authenticate the seals and signatures of officials on public documents such as birth certificates, notarials, court orders, or any other document issued by a public authority, so that they can be recognized in foreign countries that are parties to the Convention."

I have a question and I hope that someone will be able to help me.

I am French and I am in the CR-1 Application process. I will have to collect the supportive documents (for me those are Birth Certificate, Marriage Certificate, Photocopy of Valid Passport Biographic Data Page, Police Certificate of less than a year from France and Germany because I lived in both countries). I assume that all documents need an official translation. But do you know if all of those documents need an Apostille?
