  1. Hi friends.

     

    I wanted your counsel and experience about my situation, I`ve been reading the forums in order to not repeat my question but I think my case is very particular.

     

    I was born in the US, when I was 1 year old my parents moved back to Venezuela. I`ve been living and working in Venezuela until now, the situation here deteriorated to a point that last year my husband and I decided to move to the US. We have an I-130 approved for my husband and my 7 years old daughter. Neither my husband or my daughter have ever traveled to the US.

     

    Now we are in the process of the I-864, I`m using a co-sponsor because I don`t think I have enough money to serve as a sponsor for both. At first, I thought I didn`t need to file an I-864, but then after researching and studying carefully the instructions I know I need to file my I-864 alongside the I-864 of the joint sponsor.

     

    At the moment I am stuck in the tax section, I have never filled any taxes in the US, I didn`t know I had to (Now I know that is not a valid excuse). I tried to file my 2017 taxes using HR+Block but then it gets stuck in the part when it asks for my husband`s SSN.

     

    I am very confused, I cannot file as single because that is a lie, on the other hand, If I select married jointly (which I understand is the best option for tax savings) or filing separately it will ask for my husband`s SSN.

     

    Furthermore, there is form 2555-EZ which is an exclusion of foreign income, my only income has been the wages paid by the only company I have worked for in the last 14 years, I completed this form yesterday for 2017, but reading the forums I have come to know that there is also something called FBARs and some suggests that I have to file 6 years of that. Some say not to complicate and to instead write a letter to the NVC alongside my own I-864 stating that I never filled any taxes because I have never worked or earned any money in the US and I`ve never been there more than 3 weeks on a year.

     

    This is what I think I should do.

     

    Backfile by mail my 2015,2016 taxes and file by mail the 2017 taxes, including a 2555-EZ FEIE for each year.

     

    Then write a letter alongside my I-864 explaining the truth about why I never filled any taxes in the past.

     

    I don`t know about the FBAR.

     

    Please, friends, if anyone knows what is the best course of action for my case please help me. We really need to get out of Venezuela, our situation here is critical.

    Apparently yes, we are approved!! Thank you all guys for your advice and cheering up. Anybody can help in what the next step will be? Will I be receiving something on my mail for NVC pre-processing?

    Yes, I understand you, but I still consider that it won't hurt at all your case. I think is good changing a little the strategy this time by asking during your request for expedited, how do you send the evidence, and making sure the person at the phone explain to you. Otherwise I really don't understand how sending the evidence works.

    And have you considered about your wife going to the US embassy in Caracas? Idk if you guys are in the city, and I understand that more likely she won't get any kind of help, but I would still try. 

     

    My husband has never been in Venezuela, I was always afraid of him getting targeted by the government because of his nationality, that's why we never tried with the embassy in Caracas.

     

     

    Thank you for your continuous Help @ASMS. We live in Maracaibo, the people on the embassy at least on the phone are not very helpful, they are very direct and instruct you always to work thru the USCIS, I have suggested my wife that we all go to the Embassy and ask for some help, assylum or something, but we are not sure if that would work at all. !!! I will try the expedite request once more and see if we have any luck this time. Thank you so much for you kind help. Good luck.

    About the expedited, it won't hurt your case at all. I tried once, but I never got the chance to send the evidence (they never requested it and I didn't do where to send it), so it was denied in 5/7 days. But that was in August, things are bit different now in Venezuela, and you have a family.

    I think you should try, its worth the chance and I really hope you get approved.

    Probably it's a crazy idea, but since your wife is living with you in Venezuela, has she tried to talk about your case at the US embassy?

    Thank you for you advice  @ASMS. I ask about the expediting because I already placed a request a few months ago but it was denied precisely because of lack of evidence (which the officer never told us what we should send), so if I ask for and expedite review again would it hurt my case?. Congrats again, and may soon you be able to be together.

    Theywill try to put obstacles to whatever you need, sometimes deliberately with bad intentions. To give you an example of Inefficiency: my ID expired in September, I started the renewal process at that moment. 4 months after I'm still waiting for it. Biometrics are not working, so the system can't detect anyone.

    There's people that applied for passports in 2015, and they still waiting for it.

    Venezuela is an exception when is about basics and documentation process are a nightmare

    You are absolutely right. The level of corruption and inefficiency in Venezuela defies comprehension, some simple document could take months if not years, most of the times this delay is on purpose in order for you to give them money, and they are asking for those "tips" to be in dollars now!!!!. I don`t know how this kind of processes are deal with in Ghana, but as @ASMS wrote they are a nightmare here.

    I believe that you can request a change of embassy once your case reach NVC stage.

    In most of the cases they will allow the change only if the beneficiary have legal status in the second country, in your case Argentina.

    However, I've read cases were the embassy could consider critical situations so they agree to process your application without having legal status.

     

    In case you don't have a way to get legal status in Argentina, and you are not sure yet of going there, Peru and Ecuador are good options right now for Venezuelan people when is about obtaining legal status. In Peru, they are issuing temporary residence for Venezuelans that arrived before of December 2018.

    In Ecuador, you can apply for temporary residence because of MERCOSUR agreements.

    In both cases the permits are valid for a year. And it means you will be able to work there meanwhile you wait, giving you a relief to your finances.

  7. Dear friends.

     

    I have a question to those who have some knowledge of immigration procedures.

     

    I live in Venezuela with my wife (American Born Citizen) and our daugther. We filled an I-130 on June last year, the USCIS case track hasn`t updated and it still says the case has been received. A few months ago I followed some suggestions from other forumers to call USCIS and place and inquriy for expedite processing in view of our situation here in Venezuela (lack of food, medicine, no personal security, losing my job, etc). The USCIS answered the inquiry and they denied the request for expedite processing, arguing that we didn`t provide enough evidence (they never asked about it neither we received information on how to send it).

     

    Anyway, we feel that we need to escape from Venezuela, frankly, the conditions here are unbearable, the currency has lost all its value, food is extremely scarce. We are considering escaping to Argentina, although it will diminish considerably our funds for an eventual move to the US.

     

    I have 2 question regarding this? If we move to Argentina and our I-130 is approved, can we continue there the immigration process or would we have to travel back to Venezuela to continue the process?

     

    Please, In the name of the LORD I beg you to help me with any piece of advice.

  8. Hi friends, I hope you all are great.

     

    I have a question that I hope some of you can help me with. My wife filed an I-130 for me and our daughter, we`ve been married since 2003. We are currently living in Venezuela, our case is being processed in the Nebraska Service Center since July 7th 2017. But the situation here in Venezuela is gotten to a point too difficult for us to continue here, we are planning on moving to Argentina while our case finish processing, according to the timeline estimate our case should have a decision on April 8 2018. That would mean 4 more months in this hellhole. In the I-130 form, we choose that our case is handled by the US embassy in Caracas. My question is if we move to Argentina, do you think we could finish the immigration process in the US embassy in Argentina?.
