    I am hoping i can get some great advice on this forum as i do not understand what is going on with my application. I'm aware every case is different but i feel i have done whatever i can to get my case moving.

     

    I am married but my wife and i live in different states. When i filed for i751 it took over two years for it to be processed. i was told my case was pending security checks and that there is nothing they can do. I waited and waited and made numerous inquiries. Finally, i went for an infopass and i was told my case was in line for an interview. i went to the interview with my wife and attorney and we were asked a lot of questions. A lot of my background was digged. Even an accident i got into. The interviewer was convinced and approved my case. 2 years later i applied for n400 based on the 5yr rule as my wife and i live in different states. Mind you the reason i moved out of state was to secure a better job. I had no luck securing a job in  my field in the state my wife resides. i see her from time to time and the plan is for her to join me soon. I applied for n400 in april 2017 and in two months i was scheduled for an interview.  I passed the interview and the IO said she needed to review the file a bit before she can make a decision. A month passed by and still no response. I made an inquiry and i was told that i needed to to wait till after 90days. 90 days passed and i made an inquiry but received the generic letter saying that  my case is pending adjudication. I made an infopass and i was told the same thing. i made two more additional inquiries and still received the generic response. I finally contacted my congressman  160 days after my interview. My congressman responded to me today saying that "USCIS is conducting background checks on my case and it could take years". Unbelievable!  How can they be conducting background checks when they just did an extensive one not two long ago when i was removing conditions?Something doesn't add up to me. Infact, when i went for the infopass, the person at the window said my file was lying somewhere on the IO's desk. I am aware immigration benefit is a benefit and not a privilege. However, i have followed all the rules and waited as i've been told. i have not broken the law besides minor speeding tickets. i pay my taxes and im not involved in any illegal activity. i am also not from a muslim country or a muslim.

     

    1. What steps should i take further?

    2. Has anybody been through a similar situation?

    3. Does anybody have experience filing 1447(b) as my case is way past 120days?

    4. What about Ombudsman?

     

    This is very frustrating as i went to this background check nonsense a few years back and it took over 2yrs.

    I submitted a service request late last year and they responded on Dec 20 saying my case was still pending and I should receive info in 120 days. It's not April 2018 and no word. 

     

    Strange thing is that my case hasn't been updated on file since March 2017 saying "USCIS will mail you an interview request." When I ask about this when I call they say 'sometimes it takes awhile for the system to update' - A YEAR?????

     

    The only alarm I could find in my case was that my passport was stolen in 2008 and had been sold on the blackmarket. They found the person in 2013 or so and since then I've never had a problem with customs. 

     

    Any advice? My field office is Federal Plaza in Manhattan. Understand there is a backlog but a year? Also, everytime I try to make an appointment there are never any available in the next 14 days.

    I had my n400 interview about 4 weeks ago. I passed the tests, but the IO officer gave me the paper saying that the decision could not be made at that time.

    I am divorced and the only only divorce document I brought tot he interview was a divorce decree decree. I didn't expect that the officer will ask for all divorce papers. He said he would issue an RFE very soon, but I am still waiting. I called USCIS a couple times, but was told to keep checking the website. I am very nervous due to several reasons. I am going out of the country for a few weeks soon so I won't be able to mail the papers back when I get RFE. Also, is it normal to wait for RFE for a long time after the interview?

    And finally, my ex-husband is a little crazy. We divorced because he was abusive and violent (there is a very strong evidence for that, I presented it to the IO as well). I am sure he wrote a lot of long letters to immigration asking to deport me (IO asked me some questions that made me think that)

    I am just overdoing it or should i be worried, that i still didn't get an RFE?

    Realistically, under the 5 yr rule they are not supposed to question you a lot under your marriage but these days they tend to review the whole file from when you adjusted your status.At this point all you can do is wait and hope for the best. they made you signed the statements you made so that when they do their checks they can verify with what you said and ensure that there are no discrepancies

     

    I got the same response but i haven't had a decision yet.

    Well, as stated above I didn't bring NEW evidence to the interview. Only originals of the old one.

    A couple of weeks ago I uploaded some new evidence into my personal online account as additional documents section for my case (even though it says that USCIS technically not required to look at them) - it was a recent statement from our joint bank account, lease extension, envelope to our address with both names on it and 10 more pictures.

    We didn't file taxes yet therefore don't have 2018 return. Do you think it might be useful to do it asap?

    Yes in case they issue RFE, joint tax return will be a great evidence.

    RFE's are usually issued within 30 days of the interview.

  8. I have my N400 interview next month. My US born spouse is US citizen by birth in USA.

    on the letter of my N400 one of the requirements is to bring original birth certificate of

    your US born spouse based on which I have applied for citizenship after 3 years rule.

    while I have affixed photocopy of her birth certificate We have probably misplaced the

    original  certificate. While we have applied for an additional original copy from authorities

    but  it will take minimum 6 weeks before we get it.

    what is the probability that I will be asked for original birth certificate of my spouse and

    If I am not able to produce that what could be outcome.

    please give your valuable advice as I am very worried about it.

    It is really unfortunate. Pl be after them till you get your card. I don't know why they are taking such a long time for reissuance.

I have not heard anything from them since the approval letter..........it is really annoying because they keep sending me updates about case being transferred here and there but nothing about the production of the card. WHAT A MESS!!

    Did your friend receive his? if so, how long it took him to get it?

    What does Tier 2 officer says, does he say that system shows your case as approved.

    why your conditional card took 18 months after your interview, any red flags ?
