  1. Hi

    I received my biometrics appointment yesterday for next Monday. I am removing condition for me and my 7 years old son. He got a letter too, but he just traveled out of the country and will be back in a month and a half.

    Do they really fingerprint minor children? Do I need to re schedule both appointments for when he is back? or just go for mine and reschedule his? I just want to avoid delay since the process is already that long.

    What also puzzles me is that he received 2 appointment letters same name, but different case numbers for the same appointment.

    Thanks for any info.

  2. Just an update on this topic.

     

    My money order has been cashed so I guess they have accepted to study my case. I feel so relieved. One lawyer told me it wouldn't a problem but I've been stressing since I sent the package. I would look at my mail box from far away when pulling in everyday expecting my whole package back. But it's a good lesson for the future, to follow instructions and double check. I was going through so much back then, divorce, moving to a new house, kids back to school that I just wanted to get done with the paper work.

     

    I'm just waiting for their conformation to renew my documents.

  3. I'm in the same boat too. My GC expired September 9th. And they (California SC) received the ROC packet 30 days ago. Thank God my work hasn't asked for anything so far.

    I guess I have 2 or 3 more weeks to go before they cash my money order or I hear from them. I check every week if the money order has been cashed or not.

    My driver's license has expired too and I m stressed because I still drive to go to work.

    I just talked to an immigration attorney and he said that I should be fine even though the money order was not made out to Homeland Security. It's just one opinion though

     

    I am filing with a divorce waiver and was waiting to have the judgment of dissolution to file. My green card is expiring on Sunday and I've been stressing a lot.

     

    I read that there wasn't really a deadline and late applications were acceptable for those filing with a divorce decree. I don't know if it's true. I'm just hoping, in case they send me back the whole package late and that I am not able to send it back by Sunday.

     

    I will definitely let you guys know, it could help people who made the same mistake. Fingers crossed.

  5. Hello 

     

    I'm about to submit my ROC form I751.

    I have a son who obtained his green card at the same time and who entered the country 1 month after me.

    I read that I can include him under part 5 but I'm confused about the fees.

    Do I pay $595 + $85 for each of us or just once?

    And is it a big deal if I submit the form 2 months before my green card expires instead of 3 months? I'm waiting for my divorce decree. The court appointment is in a month.

    I have posted here before about separation and ROC. I came in the US from Europe with CR 1 in October of 2016. But my husband and I separated because we did not manage our blended family. We each have kids and opposite parenting styles and living all together was difficult.

     

    We separated in  November of 2017 and each moved to different houses. Since I have to remove the conditions this year, at first he wanted us to pretend to still be together and that I just add his name to my lease and I refused, and you all advised me not to do it and just tell the truth that we are separated, which I intend to do.

     

    Right now we are trying to make it work but agree that right now, we should just stay in different houses and see how it goes after a couple of months. I still want to divorce just for the situation to be easier for immigration. Now he believes I have chances to renew my GC if we tell the truth that we are still married but separated, and are trying to make it work but it works best for us to stay in different houses.

     

    What do you think chances are to get an approval while separated? Since we were not back together yet I have filed my taxes separately. My kids and I are still on his health insurance, we have a shared bank account but he hasn't used it since the separation, and I am the beneficiary of his life insurance. After the separation, I took my own car insurance. We don't own a house together. 

     

    I still believe it's best to divorce right now and re marry in the future if we want to. I'm just trying to have other people's opinions. Usually couples don't divorce for immigration purposes LOL.

     

    Like I said I had a diversity visa green card in the past and I gave it up, so I'm not after a GC at all costs. Since I gave up everything to move here, I just want a stable life for my kids and I already have a good job.

    Thank  you all for the information and for the advice. Yes you are all confirming my idea. I will tell the truth (tell them exactly what the situation at the time of ROC is) and have peace of mind.

    We should be able to file jointly by then (if not I know what to do to file alone) as we are not planning to divorce yet. I just want a quiet life, keep working, take care of my kids ( they are fluent after just 1 year here and the oldest is exiting the English for foreign children 's class already) I don't want to risk losing that for not telling the truth.

    I’m wondering about ROC. I’m in the US after  CR1 procedure that was quick, less than 7 months.

    I joined my husband here a year ago. But things are not good and we are separating next month, each moving to a different place. It’s just that we never managed to lead life as a blended family and we each have kids. Because I don’t get along with his teenaged daughter he said he cannot keep living with me. We are not mad at each other nor fighting.

    I left everything and sold my belongings to move here from Europe last year. I have a good job and my kids are doing very well at school. So I would rather stay here for now.

    When time comes for ROC in 7 months, I just want to say the truth and state that we are separated. I  read as long as the marriage was entered in good faith, that’s what matters, I have a chance to renew my green card. And that is our case. But we don’t own a house or significant assets.

    He said that since he brought me here, and feels a little responsible, we should just fill out the ROC form together and  pretend we are still together. That I should add his name to my lease, keep the joined car insurance, he is the beneficiary of my 401K and I am still the beneficiary of his life insurance; his name is still on my account but he doesn’t use it, it’s just my salary and expenses. We have the health insurance from his job and he will keep it that way. We are hesitating and are not filling divorce yet.

    Note that I had a diversity visa green card in the past and gave it back to the embassy because at that time, I could not live here most of the year. So I’m not interested in the green card since I had it before for 2 years. I just want a stable life for my kids.

    What is your feedback on that? I’d rather say the truth because I have more to lose but he keeps saying I’m stressing over nothing that he knows people who did it while separated and it worked.
