  1. My wife and I had our combo I-751 and N-400 interview today with similar outcome. Her paper stated that she passed the N-400 exams but a decision cannot be made yet. The office told us that since her biometrics were taken so long ago, they will have to re-run them and then a decision will be made for the I-751. Does anyone know how long this process will take and how soon we’ll know an answer for both?

    Starting Sept. 4, 2021, USCIS is extending the time that receipt notices can be used to show evidence of status from 18 months to 24 months for petitioners who properly file Form I-751, Petition to Remove Conditions on Residence, or Form I-829, Petition by Investor to Remove Conditions on Permanent Resident Status. We are making the change from 18 to 24 months to accommodate current processing times for Form I-751 and Form I-829, which have increased over the past year.

    Conditional permanent residents who properly file Form I-751 or Form I-829 will receive a receipt notice that can be presented with their Form I-551, Permanent Resident Card (also known as a Green Card), as evidence of continued status for up to 24 months past the expiration date on their Green Card, while their case remains pending with USCIS.

    Additionally, we will issue new receipt notices to eligible conditional permanent residents who properly filed their Form I-751 or Form I-829 before Sept. 4 and whose cases are still pending. Those receipt notices will also serve as evidence of continued status for 24 months past the expiration date on their Green Card.

    As a reminder, conditional permanent residents who plan to be outside of the United States for a year or more should apply for a reentry permit by filing Form I-131, Application for Travel Document, before leaving the country. For more information on International Travel as a Permanent Resident, see our Green Card page.

  5. I received my NOA on Saturday 6.27

     

    Filed April 30, no NOA.

    Called USCIS after May 30 - they said they can't do anything and to email Lockbox

    Emailed Lockbox everyday for 15 days. Got one response on the last email saying Lockbox doesn't print notices and to contact the service center.

    June 1 put in an online inquiry. It is still not assigned for processing. Response was due on 6/23.

     

    06/15 I contacted all senators and congressman for my state. One Senator's office was very responsive and I believe it is because of them I received my NOA on 6.26

     

    Contact your senators and congressman/congresswoman!! It helped my case.

     

  6. Here's my story...

     

    04/29/20 I sent my package

    04/30/20 It was delivered

    05/05/20 I got a text message with case #

    05/06/20 The check was cleared.

     

    No correspondence after then. I never received an NOA notice. I submitted an online inquiry on 05/01 which still hasn't been assigned to an officer for processing. I called USCIS and chatted them but they tell me to contact lockbox. I have emailed lockbox almost every day, but no response still. I ended up contacting my congressman and senator. I got a quick response from both of them saying that they will send off a request. Hoping to get an update soon. GC expires next month.

    Any one received the notice recently, after filing the non delivery and calling USCIS?

     

    How do you track the status of online inquiry? I have request ID SRxxxxxxxxxMSC but I cannot figure out how to track the status of it. I have asked this question multiple times, but haven't been successful. I can track my I751 case that starts with MSCXXXXXXXXX but cannot figure out how to track the online inquiry.  I do have an online account with USCIS but I don't see an option there either for tracking.

    How do you find case status  or history for the inquiry? I have a case inquiry number starting with SRxxxxxxxxxxMSC  but can’t figure out how to track it.

    Did you read the part about how to enter prior tax income?  It's pretty direct and clear how you do that.  In the tax section, they will have the total income from the tax return on both forms.  The only thing separated is the current income, which may or may not be anything like what shows on the tax return.

    I reread the 864 instructions and still do not see in the instructions what you are talking about. Can you point me towards where to find out what you are trying to explain?

    I've read over the instructions a few times already. I want to do this right the first time so I don't get any delays. I wouldn't be asking on a forum if I still was not sure of how to proceed.

    Thank you so much for helping me on the AOS question about qualifying income for sponsorship. I have a followup question if you do not mind me asking. Since I will be filling out the I-864 for me and I-864 for my father and an I-864A for my mother I was wondering how to go about the 864 and 864A for my parents. They file their taxes as married filling jointly so their incomes are combined on their 1040. When the 864 and 864A ask for current income and past incomes, how do I answer those questions to show what my dad made and what my mom made? Or would both forms show the same numbers for both parents since the 1040 married filling jointly combines the incomes?

    Technically, you qualify on your own based on current and 2017 income.  However, the Consulates in India almost always want to see three years of qualifying income.  I would provide an I-864 from your, the same from one parent as joint sponsor and an I-864a from the joint sponsor's spouse.  You are not part of your parent's household, so you cannot combine income with them.

    So would I find out that they want to see three years of qualifying income at the interview or would I know beforehand? Let's say I send off my AOS package with just me being as a sponsor. If the three years of income were to be an issue, would they let me know now and send me a checklist or could it be a problem later during the interview part?

     

    Also, I live with my parents still. I have always lived with my parents. Would I not be able to use their income as household income for sponsorship?

    I have filed an I-130 for spousal visa. I am currently at the AOS stage trying to determine if I need a household sponsor, joint sponsor, etc or if I would qualify to sponsor on my own. Some background:

     

    On my 1040s, my total income (line 22) are as follows:

     

    2015: $7,358

    2016: $9,613

    2017:  $26,000

     

    For a household member of 2 (me and my wife) would my income of $26,000 made last year and $26,000 annual income that I will be making this year in 2018 be enough for me a sole sponsor for my wife or should I include household income (both mom and dad) sponsorships?

     

    Which forms would I need to fill out? Any tips or recommendations would be helpful.

  15. I have a question regarding a question on the DS-260..

     

    Question: Do you have any specialized skills or training, such as firearms, explosives, nuclear, biological, or chemical experience?

     

    My wife has obtained a Bachelor's degree in Chemistry and a Master's degree in Organic Chemistry and has never worked anywhere or has had any other training in chemistry other than pertaining to her degree. Do I need to answer yes or no to this question?

    Eligibility Requirements

    If you petition for a fiancé(e) visa, you must show that:

    • You (the petitioner) are a U.S. citizen.
    • You intend to marry within 90 days of your fiancé(e) entering the United States.
    • You and your fiancé(e) are both free to marry and any previous marriages must have been legally terminated by divorce, death, or annulment.
    • You met each other, in person, at least once within 2 years of filing your petition. There are two exceptions that require a waiver:
      1. If the requirement to meet would violate strict and long-established customs of your or your fiancé(e)’s foreign culture or social practice.
      2. If you prove that the requirement to meet would result in extreme hardship to you.
