Hi all! I'm new here and writing this post for my friend. Any help is greatly appreciated!
She is an India citizen and her husband just became USC (through Naturalization). 3 months ago she applied B1/B2 visa to travel with her husband in US (at the time her husband was an LPR). During the interview, she tried REALLY hard to convince the consular she had no intention to immigrate to US but rather starting her life with her husband in India. She explained that her husband would be transferred to India and they would reside in India . Her visa got declined. About a month ago they started CR1 process (her husband did not transfer and convinced her to move back with him).
1. Will the visitor visa be a problem for their CR1 since they changed their plan in such short amount of time?
2. Because her husband never transferred, would that be "misrepresentation" or visa fraud? (though he did consult with management about the transfer)
She answered questions truthfully at the interview but still worried about the negative impact on CR1 :/
