    Thanks for your reply mate. One more question, I had my shots one year ago today. I was all up to date with them. Tetanus and MMR etc. Are they still good? Will I have to pay for more shots aswell as the physical? 

  2. I came on a k1 and about to adjust my status. My medical I had in London has expired now as it’s been over a year. Do I have a new medical before filing for aos or wait until it’s approved? Do they send the results off themselves or do I send the results they give me in the envelope myself when I file?

    Under Matter of Sesay, you can actually complete AOS without an ongoing relationship/marriage to the original petitioner, so the I-864 is also basically a stick in the ground to prevent somebody from coming on a K-1, getting married, then finding somebody else (presumably their original intent).

    Ok thank you very much. I just don’t see why my wife would have to be primary sponsor, when she can’t prove she can fianancially support me right now. My mother in law can, which is why I wondered if she can be primarily sponsor. Thank you again.

    Your wife is your primary sponsor.  She must file an I-864 even if she does not meet the financial requirements.

     

    Your mother in law can be your Joint Sponsor.  She can not be your primary sponsor since she is not the petitioner.

    So do I have to wait until my wife finds new employment before I can file?

    Anybody in the US without a valid status or authorized stay is subject to deportation. An overstay in itself is not a priority for removal, but it's not impossible either.

    I will file for AOS, as soon as I have the filing fees. Asking family back home to help. Just worried about my AOS being processed while I’m out of status

  7. Hey everyone, just looking for some info. 

     

    I came to the USA on a K1 from London, England in January. We got married last month in March, within the 90 days. My K1 expires 26th April and we still haven’t filed to Adjust my status. We haven’t had the filing fees so couldn’t afford it right away. Just worried about me being out of status soon, more than likely before my AOS is processed. Can I be deported?

    Strongly recommend filing for them both at the time you submit the i 485.... they should be processed 4 to 5 months after submitting, but the actual AOS can take up to 18 months. 

     

    The I 765 allows you to work as soon as you have it in hand. And the i 131 allows you to reenter the US if you travel overseas..

     

    If you dont get them, you cant work or reenter the US until the GC is approved and in hand, 

    Thanks for your reply! So i just need to file an i 485, an i 765, and an i 131. Pay the filing fee for just the i485 and file it altogether?

  9. Looking for some advice if anyone can help!

     

    I arrived from The UK on a K1 back in January. Me and my wife married two weeks ago. Now the time has come for me to adjust my status using form I-485. I thought it seemed pretty straight forward but now Ive read out i need to file an I-765, an I-131 too. Each form cost more in filing fees and money is tight at the moment. I am worried that i cant file before my K1 expiry date in two weeks because of a lack of funds. Is there a bare minimum that i can file? Maybe just the I-485 alone? I think I read somehow that the others are optional. Or is there any problem adjusting status after the expiry date of my K1?

     

    If anyone has adjusted status in the past and can give me a list of what they filed exactly, that would be so very appreciated.

  10. It’s best just to get them done. Hey it’s free here so he might aswell! I wanna say, what I said before about only needing to present half the stuff I took to the interview, don’t think “oh well he won’t have to take much himself”. Every case is different. We had good proof of a genuine relationship, with four visits worth of pictures and stuff. I think our case was easy for them to decide to approve. Not saying yours isn’t as genuine, just wanted to say! Take as much stuff as you can get. Income, letters from employers, tax returns, any kind of proof of assets. May not even need it all. Off all this, they only wanted to see w2 tax returns. It’s just good to have more than less you know? 

     

    Yes we we are both super excited! I swear the feeling of having this done if epic. I wanted to cry when he said I was approved haha. I called my fiancée to tell her, walking her up at like 5am American time!

I didn' realize that was still a huge problem now a days. Or are hey testing for like diabetes and stuff. 

    To be honest I’m not sure. I thought it was maybe testing for drug use maybe. I’m not actually entirely sure what the urine test was for! I don’t use drugs or have stds so I was cool anyway! But yeah the medical itself was pretty straight forward. Chest X-ray, blood test, urine test, and discussed what vaccinations I’ve had/need. Your fiancé will need a print out of his vaccination record. You don’t need them done at the time of medical, just need to have them by the time he adjusts status in the US. I was told by the nurse there I needed a tetanus shot, a flu jab and a second MMR. I’ve had them done since. 

     

    One small issue I had, I’ve had depression. The doctor there wanted a brief history of it and confirmation that my mental state now is ok. I got my doctor to fax a statement over saying I’m ok now basically.

    Congrats! That’s the longest wait out of the way now! 

     

    We sent the 129 pack on March 08. It was approved on August 07. I can’t remember when we received the NOA1, but the NOA 2 was recieved in August 23rd. Just had my interview yesterday, 01 December. Could’ve had it done a lot sooner but other stuff going on prevented me. So all in all the whole process from filing to approval was 9 months, tho it could’ve been done a lot sooner. 

     

    Fyi, the London embassy is very relaxed and easy going. I didn’t need half the stuff I took with me. I was interviewed for about five minutes. The waiting was longer. Good luck and all the best! 

  13. I had my interview successfully earlier today at the London Embassy and had my K1 granted! 

     

    I just wanna take the time to thank everyone on here that has given me information and answered any questions or given me any kind of help! Much appreciated and me and my fiancé are forever grateful. Good luck to anyone going through the process now. It seems like a long way to the finish line but it’s such a good feeling when you’re here! If anyone needs any help or advice about the interview or anything else, please ask. You can do this and good luck!

  14. Finally got my interview booked at the London embassy! So excited that the finishing line is in sight now. 

     

    Just wondering, I’ve seen it said recently that I should take photocopy’s of every document I take at the interview, except my passport and photos. Is this true? Has anyone else done this? And why do we need to?

We received the NOA2 in August saying our petetition was approved on the 7th. I believe it expires, as in I have to get the medical and interview done before then, four months later on December 7th. I’ve had my medical and now have to book the interview asap. If I can’t get a date before the 7th December, are we screwed? Thanks for any help

    You could wait until you have all documents before booking an interview, the but Letter of Intent must be signed with 30 days of that interview, and again, interview dates aren't always all that flexible or available. Booking a few weeks out will give you PLENTY of time to get things sent over.

     

    You have 6 months of validity on the medical. You'll be fine.
