Have you filed tax returns on the rental income?   over $100,000 exclusion but you still need to pay into SS and medicare at time of filing

have you paid into SS and medicare when filing ?   If not ,  you owe for these

you need to look up IRS requirements

you can't owe anything to IRS when you interview

You put K1 visa here which is fiancee but say your husband and I 130

You will need a US address for the paperwork

that will be asked of him in an interview and at POE

    living with family is ok

look into using assets for the affadivit as you say you own the house

and don't trust the lawyer completely / they may know immigraiton laws but most don't know what the Casa embassy expects to hear for immigrant and that they want to see commingling of finances to be approved

I updated my profile but it wasn't updated on here- we are now married. Our K-1 was denied so I moved to Morocco in Dec. 2018 to marry him- haven't filed taxes for the rental property yet as the lease started in 2019. Thanks

  2. anyone have any experience with the I-130 affidavit of support while living abroad? I am currently living with my husband in Morocco- so had to quit my job. My parents have agreed to be our financial support for the affidavit of support, and I do own a home (currently being rented) but I am worried that since I am currently not working in the US that our case will be either denied or stretched out. My lawyer didn't seem to think it would be a problem, but I have heard other people with concerns.

    Thanks!!!

Others may disagree, but I do believe the officers at the Casablanca consulate do have an idea of whether or not they will approve the case or not just based on what is included in the I-129F packet. They never look too much (usually not at all) at any additional evidence that is brought to the interview. If the fiance does well at the interview and the I-129F packet is strong with a lot of relationship evidence, the CO is more likely to approve the case. It isn't unheard of for the CO to ask very detailed or sometimes seemingly irrelevant questions. They are trying to see if the beneficiary can confidently answer, or at least seem honest if they truly do not know the answer. Sometimes language barriers are an issue too (if the interview was done in English).

Unfortunately you are hearing about all of this now instead of before you filed the I-129F petition. On the bright side, you all of this information still applies to the CR1 visa petition (importance of including A LOT of relationship evidence from each trip). This will allow you to prepare a stronger petition that will hopefully result in an approval.

Yes, I agree, I would have sent a lot more evidence then with the application. I assumed that was what the interview was for, and was wrong. My best friend married a man from Morocco 7 years ago and that's actually how my fiance and I met- through them. Their experience was much difference so I was expecting the same results. I guess I learned a hard lesson. I will visit with the immigration office here in MN and go from there. Thanks for your help.

  4. I honestly never thought our relationship would be in question because it's real- I was more worried about showing support financially and having a reliable job here in the states. I didn't think they would question the relationship- so frustrating when we've waited almost 9 months just to get this answer....it's people's lives.

  5. No big age differences and no other red flags; we both have never been married and neither of us have children. The only thing then maybe is the length of our relationship. I've visited Morocco twice but I thought it was more important for me to have enough money to support him here in the US then traveling to Morocco. I gladly would have gone more then. It's so hard to know- I was trying to save for our future. They didn't even ask to look at the documentation for our relationship either so not sure. So frustrating. I'm fine getting married in Morocco, just wasn't my first choice. Thanks for all your help.

  6. He said they didn't tell him anything, just no. They didn't ask for more documentation and we haven't received notification from the USCIS. The letter just said Returned to USCIS under section 221(g) and for me to contact my local USCIS office. He said they asked him a lot about his travel to Turkey and Saudi Arabia so I'm thinking there was some suspicion there.

  7. My fiance had his interview in Morocco on June 28th and they told him no and said it was due to 221g. Anyone else have these issues? We aren't sure why and what caused the suspicion as they do not tell you. I was finally able to make an appointment in a few weeks at my local immigration office, but wondering if others have gone through this and the timeline. I am very discouraged as we have been waiting 8 months and are living apart. We thought it best I stay working and maintaining a home in the united states. Needing some encouragement.
