  1. What I originally meant in my original post, that stirred up all this "being armed" talk, is that those people that have guns/weapons in their homes, when attacked, are usually injured BY THEIR OWN WEAPONS. Do you have experience shooting it? Probably not. So when a tense situation arrives, someone barges in, they'll rip that gun, or whatever it is, right out of your hand and use it against you. In crazy situations stuff happens fast. Either know what you are doing, or don't set yourself up for an even more dangerous situation, that's what I was getting at.

I don't know where some of you live, that it takes cops 2 hrs to respond to an "emergency". Even in Chicago it doesn't take that long. When you call & tell the 911 dispatcher your SO is just getting his/her things, that may not ring the "emergency needed" bell in their mind, unless you specifically tell them you are in grave danger.

  2. Restraining orders are just papers, do not count on that for protection, if the temper is that bad, arm yourself for anyone breaking into your house

They are not just papers, they are powerful. The cops will come and drag his ### out and arrest him if he comes near her. Will the papers stop him? Of course not, but they are enforceable and the OP should get them.

I'm not sure what you mean by "arming yourself" but most armed people get hurt by whomever it is entering against their will with that armed weapon.

  3. My apologies if this is the wrong forum for this, but I couldn't find a better fit.

I will soon be sending in a K-1 petition for my soon-to-be fiancee, but it's been around a year since she last tried to get here on a tourist visa (to visit, not to marry --- we know that's a horrible idea) and she has a fair amount more evidence and ties since that last time, which was denied. We know that the K-1 process can and will likely be several or more months, and therefore she plans to apply for a tourist visa somewhere at the beginning of September.

We are wondering if this has the potential to screw up either the tourist visa or the K-1 visa; for example, would they be able to see that there's a K-1 on file and deny her the tourist visa, assuming she'd be trying to go there to get married illegally? Or, if she applied for a tourist visa and said she was going to visit her friends (which she is, not just me) and then the K-1 meeting arrived, would that sort of ####### on proving a past relationship, since she would/should(?) have otherwise mentioned seeing her boyfriend, not just some friends?

If the latter is so, would, in practice, stating that her intention for the tourist visit is to visit her friends and her boyfriend hamper her chances of getting the tourist visa? She's been denied repeatedly before because nobody told her they'll send you right back out the door if you try again, say, a week or two later. "You can re-apply as many times as you like," my ###.

Thanks for any help you can give, and apologies again if this is a little loosely tied to this forum.

People visit their fiance on a tourism visa during the K1 process.

She should be honest if she applies for it, say that she wants to visit you because you don't want to wait for the visa to be approved to spend some time together. There is a risk however that they won't approve her, but that is with any visa application and it is up t the embassy staff.

The reasons why she was denied before might give you an idea of her chances to be approved or not.

If you think the chances to get it are strong then have her go ahead and do it, but make sure she provides enough proof that she will be coming back to her homecountry to finish the visa process: letter of employment saying when she is due back at work, appartment lease, return ticke, car ownership document, bank document, etc.

If you think the chances are low, then why don't you plan to visit her in her country? Of plan a vacation together in a country you can both have access to easily.

I agree, the most important part is to prove ties to the home country and that you have something to return to, ie job/contract, home or condo ownership in your name, anything that would make need to come back. I heard that students in college near graduation have higher success rates for tourist visa's because the counsel beleives they'll return to finish up school & get the diploma.

Also as Cecy stated, she should be honest and say what the intent of her visit is, to visit you & friends. She doesnt have to go into details of the K1.

    Good luck :star:

  4. You have these feelings after a year of being into the marriage? I would assume if you'd feel them not acknowledging your marriage, it would be sooner?

If your dad makes the cha-ching, and you feel as you do, what about putting together like an anniversary ceremony say a year from now at your next wedding anniversary? Ask your dad for some help, and remind him how this would bring the family together :) and of course make you feel better. You have a year to plan (if I read your timeline correctly)

I kind of know what you are going through, because when we got married we did the civil ceremony and it was rather private. I didnt do the big church wedding that is customary for my family/religion. So some of my family never gave us a real "congratulations", and it does still make me feel sad. Hence, I do plan on doing a church ceremony... somewhere down the line :)

  6. Niki,

Wiadomo jaka oni tam maja super organizacje

Mysle ze w "commingled financial resources" tez licza sie rachunki. Wyslala bym im to samo i jeszcze dodala jak cos jeszcze masz.

  7. Hello there. Anyone could answer me? I came here as K1 and after a week got married we immediately filed my AOS and now I already have ASC appointment notice for I-485 this July 02, 2008. I just want to know if its fine to go to the USCIS Center by myself (i mean without my husband presence because he has work)? Is this appointment is only for me?

This is YOUR application not your spouse's and only you are required to attend. Anyone who comes with you will not be allowed past the waiting area anyway.

WHAT?! For the AOS interview?? The spouse is required to go. Tell your husband to get off of work. If you go by yourself you are going to have problems, or get denied all together. You are there to prove you have a valid marriage. Only 1 of you being there won't prove that.

Please read more carefully... The question is regarding the ASC appointment for BIOMETRICS

Check out her timeline, she had biometrics in June. 7-2-08 is the date she entered for AOS interview date.

  9. i would happily pay 10 dollars a gallon if it meant i could avoid the constant barrage of discussion about gas prices.

it's all i hear all day at work. i turn on the radio and they're talking about. get home the tv is the same.

can we just shut the ####### up about gas prices?!

fine, i have to spend about 20-30 dollars more each week than i did a year or two ago. if your budget is broken over 20 dollars a week then you have bigger problems. you need to fix your lifestyle and quit complaining about this.

I'm with you on the part, that people are complaining over spending $20 more a week. I'm so sick of it. No one complains at $7 for a box of cigarrettes, so stop complaining at the price of a gallon, or do something, call Exxon or Shell.

But I am not with you on offering to pay $10 a gallon. I'm not insane.

  10. As long as they approve, and stamp the passport with I-551 stamp you should be fine to travel, if "Approved pending name-check" then if K-1 visa you will need AP to travel, if K-3, then the visa it self is multi entry, and can use the K-3 visa to re-enter the USA.

I am wondering the same thing - we need to travel within a week of the interview

    BUT, I have heard that:

A - They take your 1-94 and AP at the interview

    B - They don't give the I-551 stamp anymore

I have heard that if you wish to travel right after the interview and before you receive your card, you now need to make an infopass after the interview to get the I-551 stamp.

    Anyone know/have experience with this?

They did remove the I-94 out of my husbands passport at the AOS interview, and DID NOT give the I-551 stamp. We asked about travelling between interview & GC receipt, and the immigration officer said its best to wait for GC in hand. She said in the system it may already show them one thing (meaning approval & GC produced), and you trying to get back in the US with AP will not work.

  11. We didnt have a similar experience, but at our AOS interview, me the USC, I was asked about my job. I dont know if our IO was real interested about my field, but she did go into asking about the firm I work at, what I do there, how long I've been with the firm etc.

Just be prepared for anything & everything. You never know what kind of IO you'll get... or their mood :)

  12. Something to consider:

In a lifetime, you are only permitted to apply two times for the I-129F. I have heard of a petition to file a third time, but that petition was rejected. Anyone have any more information about this?

This is not true. There is no limit to the amount of times you can file the I-129F. You just have to file the waiver if you do more than 1 within a 2yr period.

  13. Hello Arrest records are on the computer. Judicial records come later. Cant hide much from immigration these days. everything is computerized. its all about FINGERPRINTS and thst is what they do b4 your booked and b4 you see your lawyer !!!

She shouldnt have called cops on him if she didnt mean to get him arrested. tricky chic

I don't believe the OP said that the wife was the one that called, he really didnt say who. They could have been so loud the neighbors called. Oh well, no need to speculate. Seems OP isnt coming back for more advice on how to evade being a wife beater.

  14. I think that its just ridiculous that Immigration doesn't contact each applicant to remind them to reapply as they do at Australian Immigration. I am certain that many people miss their date for various reasons if not simply as an oversight.

    Thanks for the info

I think its ridiculous you think they should contact YOU. It is your responsibility to maintain your status, not theirs.

They are busy enough processing applications, and have soooo many delays, if we added on a team to call & remind people with delinquent cards, we'd only increase fees, and processing delays.

  15. My wife came over on a K1 visa recently and all was going good. I was making about $25,000 per year etc... To make a long story short, I lost my job and don't have the education / skills to get a job (that I can find anyways) paying that much. I found a position making $9 per hour and barely can get by. People keep telling me about all these programs for government assistance, but we havent files AOS yet.

Since I sponsored her, will we have no shot of obtaining assistance? We did use a co-sponsor aswell when we filed. We are desperate. some help with rent or food or anything would be nice. I am looking for a 2nd job now, but no luck. Any ideas?

You can file for whatever assistance you require as you are the USC. Aren't you getting unemployment since you lost your job? That should help with the bills at least temporarily.

If you file AOS your wife will have EAD in about 90days, and then she can go out & work to help out also. Don't despair, just pick yourself up and research ALL your options. Good luck :)

  16. ........im feeling that something is not right about this......something is lacking

Something is totally not right. Whatever he did, he did something wrong to his wife (police didn't stop by out of intuition) ... and he's not concerned with his actions, he's only worried about his status. I'm not worried about helping out a wife beater.

He mentions in every post that his wife will not press charges...as if that makes a difference. I'm glad to see that the option of pressing charges in domestic battery situations is taken out of the hand of the victim...at least in the OP's home state. I think there are some states where prosecution is still not automatic...it should be. IMO

    -P

I think not only should prosecution be automatic, but for those scums that come here to inflict pain on USCs, deportation proceedings should be also. :)
