  1. Re-applying a few weeks after a denial is a waste of time and money, its going to be another denial. It is recommended that you wait a year, or have a significantly different case then when you first applied...seems in the few weeks, your friend doesn't have either. I too believe entering in the visa waiver program with 2 very recent denials is going to cause for concern at POE.

    Interviews are more psychological than anything. The CO can hear a word i.e. "boyfriend" that sparks an interest and perhaps have pre-concieved thoughts/bias, which will lead to a denial. How/why was the BF brought up anyway?

    I had a cousin recently apply, she's single, no property besides a car, she did have a work contract. The CO asked her why she wanted to go to the US, her response "vacation, to see family". He never asked for any paperwork, smiled and said "have a nice time there", and bam she was approved.

    Sometimes there is just no logic in why people get denied.

  2. I just got my bio apt letter ,I noticed they misspelled my first name they typed LLONA ( double LL) instead of Lona

    can I waite till the bio apt to point this out or should I call them to get this corrected over the phone ?

    any help is apriciated thank you

    What did your NOA show?

    My husbands name was mis-spelled too. He brought his passport and I751 copy to show we filed correctly, and proof of his name was his passport. They adjusted it on the spot, and the GC came with name spelled correctly.

    When can you file for citizenship? Is it after being a permanent resident for 3 years, or 3 years of marriage?

  4. First of all, each undocumented or "illegal" has broken laws. They entered illegally or overstayed and broke the law. Some pay taxes, some do not and further break the law. Some illegals also go to the emergency room every time they have a stuffy nose, cause they wont pay for a dr office visit, and eventually we fork over the cost of this.

    We, the "legals", have been flipping the bill in numerous ways because they break the law. We suffer due to their actions. Is this fair? NO. Then why would it be in my interest to keep them, to legalize them and allow them access to eventually some more benefits like paid healthcare (on medicaid i imagine), or collecting social security one day, or heck any other benefit. I dont think that is fair. I dont think they should be rewarded for breaking the rules.

    Imagine a 19-year-old girl, originally from Guatemala, who was brought to the US by her parents when she was only 18 months old -- a baby!

    She grew up in Southern California, went through the entire school system, got her High School Diploma with honors and an excellent GPA. She speaks fluent English. Her parents, in an attempt to promote integration, did not teach her Spanish, so her knowledge of the language is marginal. She has never left the US, doesn't know anybody in Guatemala, has no family left there: a High School graduate with no income and no savings.

    She would like to attend a college, but since she can't provide legal presence, she can't even apply.

    What should she do, what should We the People do with her?

    The situation above is either very rare, or not likely. If her parents came here when she was a baby and were illegals, they most likely had low paying jobs, and didnt learn english enough that "not teaching her spanish" would be an option. Most Hispanics teach their kids the language, as its always better for 2 vs 1 to know... and to communicate with mom & pop. Her good grades would lead to think she's smart enough to research working at 16 like all other teens, and figure out at that time that she's illegal, and start planning what to do in the next 2 yrs as college would be approaching, and no real future with her status. If she didn't know this, then she didn't have an excellent GPA.

    I don't feel any sympathy whatsoever with the above situation, or any other of an illegal. You break the rules, you face the consequences. I do not believe legalizing anyone is the course to go. Why reward bad behavior? Legalizing everyone now would only send the message that the US is "easy". I think it would encourage more illegal overstays or illegal entries with the notion "ahhh, one day they'll legalize me".

  5. Requesting USCIS to hurry up because you are going on vacation is hilarious! :rofl: Haven't you dealt with them in the past? You are on THEIR schedule, they tell you where to be and when.

    They'll schedule your biometrics and send a letter. If you can't make it, you can request to move the date, but can't request it ahead of time.

    I dont know when your GC expires, but I'd wait to have an extension letter in hand before I departed. Better to be safe than sorry. But again, this depends when your GC expires.

    I'd tell you to monitor this case yourself (or your husband too) on the USCIS website. No one really has "connections" with immigration, many polish lawyers or associations say that to get you in. Its your case, so be sure to monitor it. On the website you can enter your case and see the status, watch to see if any RFE is sent, or the NOA2 approval issued.

    Like a previous poster noted, something smells fishy. I'd say the attorney/association didn't mail your packet when they said they did, 2 months is very long. USCIS says to call them if you dont get NOA after 30days, much less 2 months.

    Don't rely on what attorneys tell you, some lie to give you delays, to pay them more money, etc. Its your case, you need to take charge. All of VJ is here to help with questions along the way.

  8. As far as I know she can buy and download a do-it-yourself divorce kit from the internet, fill it out, get him to sign and file with court.

    Because of his mental state and issues he will not just sign the the paperwork for divorce. He call 100s of times a day and sends txt messages....

    First of all, if she's leaving in 1 week, she wont be able to divorce in that short amount of time. Some states require you to be seperated for one year before you can get divorced, she needs to research that, or you for her. If he's difficult, she should get legal assistance (some charities do it low cost, like Catholic Charities, some do it free) otherwise she wont be able to do much on her own with him resisting, and her not knowing the steps/process.

    Depending on what city she's in (larger Russian population), some paid lawyers can help do the divorce and send her papers to sign or whatever they need to her in Russia.

  9. I sent my husband off to get the bio done early. I figured since it seemed everyone was allowed, and approved so quickly, we'd give it a shot. I guess Chicago is not as friendly as the other locations. They did not let my husband take the bio early, and they said they may be able to correct the error of his name being mispelled if he brought in his passport as proof.

    Guess we'll be waiting.... :huh:

  10. I was getting worried about our Bio appt, as people who filed after us were getting theirs. We got the Bio appt letter today.

    I noticed my husband's middle name is mis-spelled on the Bio notice, (his name was spelled correctly on the NOA1), do they manually type these?? Should we report this anywhere? I dont understand how one notice is spelled one way, and the other is different. :wacko:

    I have a question about documents that later on my fiancee will be taking into the interview when it comes time for that. She will be going to the Warsawa, Poland Embassy. Everything thing she brings in does it have to be in English? Also does anyone know anything about the medical exam in Poland and does the fees include the vacs?

    Everything needs to be in English or it has to be translated.

    The medical exam does not include vaccinations, as they are not required on a K1 visa. Your fiance will need to have vaccination records however, when you guys file AOS here in the US. Better to do them in PL where they are cheaper... but ensure she has the records & brings them with her.

  12. Let me respond to the points you made.

    1) You live in the US, one of the richest countries in the World, a country where millions of people would like to immigrate to. Perhaps millions wanted to in the 1980-90s when the dollar had some value. The US is now a treat for 3rd world countries, not as prised as you think it is.

    While I agree with you on the demise of the US in many aspects, it still is, as I stated in my previous post, one of the richest countries in the World, and, quite evidently, and even literally, millions of people want to immigrate here.

    Hence, that was a perfectly correct statement on my part.

    2) It's a country of 300,000,000 residents, many of whom would be women of the right age group that you potentially could have married. And Bob you could have done the same, yet you choose a German, what is your point? Even more so, why would you say this, of all places VJ, where EVERYONE has a foreign spouse

    I have nothing, absolutely nothing about foreigners, as I am a foreigner myself! I married a USC in the US, after 4 years of dating, and 1 year of being engaged. By the time I got my GC, I knew my wife for more than half a decade, and we're still happily married today.

    My point was, and still is, that there are many good potential spouses in the US, and they come from all kinds of geographical and cultural backgrounds. If one is shopping for a spouse or international food, the US is probably still the land of milk and honey!

    3) You instead chose to import a woman from a country with extreme high fraud rate. Let me ask you, did you discover your now-and-still-wife on the Internet, or did you actually get to know her in person before marrying her? Poland does not have an extremely high fraud rate. They do have some people overstaying visa's, but in terms of immigrating here permanently, few are bold enough to cheat USCIS

    Poland has among the highest crime rates on planet Earth and many residents are anxious to get the hell out of there. While Nigeria is the world leader in Internet and business fraud, Poland is a god-forsaken place to live, thanks to its rather unfortunate past as concentration camp central. I've been in Poland, have you?

    There are certainly many, many honest Polish people in the world, but like you have to be careful when responding to the e-mail from Nigeria telling you that they are ready to send you a few million dollars, one has to be careful, just careful, when doing other kinds of business with countries that are black listed.

    Since the OP didn't tell us how he met his wife, I simply assumed that this happened via the Internet. If he married her without knowing her well enough (and he did, hence his problems!), he and only he is responsible for it. Quite relevant in my book.

    4) The woman comes here, you marry her, she takes off and does what she does best, just with other men. And this could apply to anyone in the world, Pole, German, USC, what does this have to do with anything?

    That was a statement of facts, to make a point. It's not about the nationality of the person at all.

    The chance that someone marries a stranger after only a few chats on the Internet is quite small if said partner lives in the US, compared to the situation where the spouse is imported, don't you think?

    5) You are upset, of course, that's understandable, but are you really surprised? Yes, I think he's surprised, cause if he knew this was coming, he probably wouldn't have done this visa journey. Again totally irrelevant

    If he's surprised (thanks for answering for the OP), Master needs help, indeed.

    The ignorant view that EVERYONE in the world wants to immigrate to the US annoys me. This is not the land of milk and honey anymore.

    Nobody claimed that EVERYONE in the world wants to immigrate to the US. I sure didn't. It's just several millions out of about 6,700,000,000 (7 billion minus 300 million US residents).

    Land of milk and honey? Well, depending from where you come from. If you live in Monaco or Switzerland, you'll laugh your brains out; if you come from a really poor country where you can't feed your children, I think the US still is the promised land.

    Bob, I can't argue with you if you keep making up stuff. You are comparing Poland to Nigeria? Get a life! I think its easier to compare Germany to Iraq.

    Concentration camps in Poland make it a bad place, its the GERMANS who put them there; and how many camps did your Nazi's have in your homeland?? Maybe you need to take those blinders off. Poland is certainly not the country you paint it out be. You must only know it from WWII movies. If you've been in Poland, I dont know what hole in the ground you were near, but I've lived in Poland and certainly prefer it over the milk & honey US you paint. Is now a time to remind you that US is in a sucky recession and Poland is not?

    Poles dont view the US like they did 20yrs ago, you are stuck in the communist times, I can't help you with that.

    Maybe MasterNateDawg can come and chime in on Bob's view that he sat on the net to get a girl he didn't know and its his own fault.

    Cheating is not a foreigner type of thing, it happens to those who know each other 2 months, and those for 20yrs.

    In any case, Master, you omit some really relevant information, so let's sum up what we know, and carefully fill in the blanks, shall we?

    1) You live in the US, one of the richest countries in the World, a country where millions of people would like to immigrate to.

    2) It's a country of 300,000,000 residents, many of whom would be women of the right age group that you potentially could have married.

    3) You instead chose to import a woman from a country with extreme high fraud rate. Let me ask you, did you discover your now-and-still-wife on the Internet, or did you actually get to know her in person before marrying her?

    4) The woman comes here, you marry her, she takes off and does what she does best, just with other men.

    5) You are upset, of course, that's understandable, but are you really surprised?

    1) I am confident that she is quite informed about the further plan of action to pursue. She will find a divorce attorney, for whose services YOU will pay. (You said she doesn't work and doesn't want to work, correct?)

    2) She will remove conditions on her own, possibly even claiming her "Master" abused her. But even if she doesn't go that far, she'll most likely will be able to get her 10-year Green Card.

    3) Since you signed an affidavit of support for her, which USCIS has on file, you'll be paying through the nose for the next decade for your non-working wife. By 2019, however, you'll be free again. Broke perhaps, with more gray hair then Tailor Hicks, but free.

    So is there any upside to this? Yes, there is. Believe me, you are not alone. There are quite a few people who married somebody they don't know well enough and then experience a hard landing when reality kicks in. For you it may be a hard lesson to learn, but I'm hopeful you will learn it and won't make such a paramount mistake again. For others, it's a valuable lesson, a repeat one, to be careful and take a marriage step by step, not like a parts order over the Internet.

    Bob, let me correct you on some assumptions.

    1) You live in the US, one of the richest countries in the World, a country where millions of people would like to immigrate to. Perhaps millions wanted to in the 1980-90s when the dollar had some value. The US is now a treat for 3rd world countries, not as prised as you think it is.

    2) It's a country of 300,000,000 residents, many of whom would be women of the right age group that you potentially could have married. And Bob you could have done the same, yet you choose a German, what is your point? Even more so, why would you say this, of all places VJ, where EVERYONE has a foreign spouse

Let me ask you, did you discover your now-and-still-wife on the Internet, or did you actually get to know her in person before marrying her? Poland does not have an extremely high fraud rate. They do have some people overstaying visa's, but in terms of immigrating here permanently, few are bold enough to cheat USCIS

  14. it all depends on the evidence you send in and the mood of the person receiving or looking at your file, nycbra there is some lucky couples who don't get inerview for aos.

    We were one of those couples... I actually thought our AOS journey was pretty fast and smooth. I guess our luck ran out this time. :unsure:

    Sorry we are a little sidetracked from the " July " topic. But just continuing the discussion... I guess when you apply for the K1 visa you need an interview, right? So maybe for those who were adjusting status from K1 an interview is not required? I thought in my case an interview was required - I adjusted from F1 status.

    So, it does seems from the current trend that those who didn't go through interview during AOS are having a more "difficult" time with the ROC. I really don't understand USCIS system...

    I think it is partially random, and partially what evidence is sent with the AOS, that determines whether or not you'll have an interview. We did AOS based on my husbands K1 and we still had an interview for AOS. If I remember correctly, it was about 50/50 as to who had an interview and who didn't, and most were from a K1. I'm hoping we wont have one now for ROC.

  15. If I was in his situation and know the marriage is ending, I would find out what she wants, since the husband has not much saying in the matter of removing her condition, I would facilitate and help her with this process but would ask for repayment of the money spend on the K1 process.

    I would try to see this matter with my head and not my hart or anger. Hard to do tho!. However at the end it becomes a business transaction.

    I would not help a spouse that has treated the other like #######, cheated with random men (plural!!!) I think you have to draw the line somewhere on being civil, and being walked on.

  16. I would take her name off everything, but NOT divorce her. Let HER file and pay for the divorce, and i'd drag out the divorce too, she can't file to lift conditions if you are still married without you being at the interview.I would also not give her a SHRED of evidence to help show proof of marriage, ie photos, bills with both names on it.

    She can file to remove conditions and never be requested to interview. Best bet is to shred all mutual evidence, and make sure she doesnt have access to his credit cards, checking accounts to run up crazy items before she departs.

  17. Are you saying you would live in the house peacefully while your spouse ran around with other people? I bet living at his home is not what the cheating wife wants, as its infringing on her ability to do what she wants with whomever she wants.

    He can give her a 30day notice, I think that would be fair.

    The abuse card can be played, so some cautions need to be taken. Maybe he can talk to neighbors (not to air dirty laundry) but in case she does pull something like screaming murder, to have them know what she's capable of.
