Hello everyone just wanted to update you and inform you that USCIS asked that I send a written letter with the baby's personal information (DOB, address, full name) to the service center that is processing my k1 visa.  I spoke with 2 different representatives and they both stated that it should not affect my petition as I have not been approved and that is not a major issue.  Thanks everyone for your assistance and response to this topic!

    Your fiance, cannot petition for his child himself until he is an LPR.  It takes 2 years for an LPR to petition an immediate relative.  Really this is the last direction you will want to take as they will be apart for years, right after he got sole custody.

    Or you can try to include the child now.  Yes I've seen it done on this forum even when the child was not included on the I-129F. You do have a valid reason to have not have included this child along with the paperwork to back that up. 

    Or you can petition the child once you're married as a USC step-parent.  It will take about 1 year.  

    If your fiance is the sole custody parent who is going to look after his child when he leaves his country to marry you? This is his responsibility so trying to figure this out soonish would be best.  

    Thanks a lot and his mother is willing to watch the watch the baby until he can come to the states as she currently watches him so my fiancé can work. We will still visit and financially support the children. I have been to Jamaica 3 times this year.

    Does the i134 add the omitted child?? I only petitioned for my fiancé on k1 visa and didn't put the baby down but now I wanna add him so my fiancé can send for him once he's working. If he does a k2 visa can't he just show proof that the baby is his son and petition for him although he wasn't on the original petition??

    Has it been 1 year since the K1 was granted or is the beneficiary still in process? Why was the child not mentioned on the I-129F?

     

    Well he was going through court and u sure about paternity but now it has been established and he has sole custody...everything is still in process he has not even had an interview...was wondering should he tell the consulate during the interview or should I suspend the petition or simply wait until he has LPR and does the process for the child later on his own

    Thanks but Will doing another I-130 delay the process significantly? Can another relative simply petition for the child to come later?? Can he petition for the child once he has established LPR??

Does anyone know what to do if a child was not on the k1 visa petition if they can be added or the parent try to bring the child later?  How do you suspend your petition to add a child to bring at a later time and approximately how long would that delay the process??   (Do you simply wait until the consulate interview and inform them of the mistake??) Does anyone have any such experience?? Please reply! Thanks.

He just got sole custody of them and wasn't certain if baby was his son...I read something about the consulate suspending the petition if you add a child....so I'm wondering should I just do so now although we haven't even received NOA2 yet. He wanted to get married, work then send for them, like add them under k2 visa (you have a yr to do so?) but I'm not sure if it works like that?

If my fiance in Jamaica decided to wait and bring his two boys due to me having children already and not being able to meet the financial requirements, can he "send for them" at a later date?  What would they process be? Once we are married and he's working can he go through the k2 visa process for his children or would it be something else? What should we do?? Any suggestions??

  9. As for lawyer I'm  learning that now smh! It's more of a lawyer service something called rapid visa and it was $1200! Now I see I could've filed it myself as they only correspond via email! Doesn't FB require wifi for calls? Is it better than WhatsApp or about the same? Please can you mesaage me travel tips? I'm going on my 3rd third trip end of month but was debating should I wait as we received NOA1 on May 8th? Seems to be taking longer than expected but if there's a chance he could come by November I was thinking of waiting to save the $ but haven't heard a word yet and it's been 20wks! Please reply LionessDeon.

Never did I ask for any to tell me to lie and it was actually on this very website when Jamerica and others said that they would advise so why they advised it and how Jamaica consulate is no tolerance.  It was on these forums that said one time use was said to be ok for marijuana. I am seeking opinions and experiences as some people said they don't even ask while others said they have a one year ban. Yes our love is real no question but money is real too and this long distance relationship is quite expensive phone calls travel lawyers so imagine another year! Thanks for your comment.

O ok thank u and yes true nothing negative so far but I was saying no judgement for smoking yet still want opinion on situation...guess will just have to see, haven't got interview yet n I'm glad gives him time to make sure it's all out his system...some people say one time use may not cause ban for smoking weed but guess that's still dishonest...Wish could just let the urine specimen speak for itself as I'm pretty sure will be clean

  12. So if u say no but your urine is clean how can they tell?? I read somewhere one time use of marijuana is ok like if u say u experimented or tried before but didn't like it or was at a party or something...I read a lot of Jamaicans say lie cus admittance results n ban while Americans say b truthful smh it's crazy n I'm confused cus I'm American n have smoked for yrs quit n passed last 2 urine tests for work so seems like he could do the same if it's been over 6 mths since he smoke? Jus worried honesty will b our enemy we've waited 6 mths already! So they check your hands lol seems like residue shouldn't stay on skin long though?

  13. I was saying could he get the tourist visa so he can visit while waiting the year ban out. Nobody trying to admittedly break the law...I asked for no judgement as everyone negative about smoking weed like it's crack...but if k1 visa is denied and we apply for CR1 will he have a medical?? Can I just go over n get married n adjust the visa type or do u have to wait this process out first?? 

  14. My fiancé is in Jamaica and I know he smoked marijuana quite heavily in the past but we both quit when we decided to get married...so the k1 visa process began! Now as I'm browsing this forum I noticed a lot of discussion about 1 yr ban for just admitting drug use! 😪 Does every medical in JA include a urine test or blood test or how far back does it go?? I know he's been at least 6 mths smoke free. I wish we knew this at first as it seems like we may have loss lots of $$$! If he can't get the k1 visa can he just apply for a 10yr tourist visa instead? Would he still have to wait the ban out?? 🤔 Please reply, non offensive or judgemental comments welcome

Our NOA1 was received May 8th for k1 visa. It's been 126 days and haven't heard a thing! **Is 5 months the max time for NOA2??** I'm debating about going back to Jamaica end of this month for about a week as he may be getting interview next month. Is that realistic? I noticed on USCIS website it says California is processing February applicants as of June 30th but the site was last updated Aug16th. Does anyone know if my fiancé may have interview next month & likely to to finish up this process??? Is 6 mths the usual processing time now for k1 visa??? Please reply! Thanks!
