She won't be deported or taken out of the country, she's technically in a loop hole at this point and her status is in limbo land.

Do not leave the country though, else she won't be allowed back in.

Yes, she will be fine. Stay put. ICE has bigger fish to fry.

Re-send everything in the post again. She probably will not be able to get her driver license until she gets her EAD (depends on the state you live in) which is currently taking 4-6 months.

Thank you both for your replies, we're getting it all sent in again tonight.

You both have really helped us take a load off as we've been panicking the past few days!

Has the check/money order been cashed? Re-send everything. DO NOT LEAVE THE COUNTRY. If she leaves the country, you will be starting over from scratch with the CR-1. You NEED advance parole before leaving the country.

Hello, thank you for replying so quickly. My bank reported the money order had not been cashed yet.

But we also haven't received a notification or receipt of acceptance/delivery. USPS doesn't have any idea where it went.

Even if we submit the paperwork now ( there's no way it'd be completed in time? ), is she ok to stay in the country without issue? We had an issue where she couldn't get her driver's license without having her change of status done yet- and we're worried she'll end up being deported or taken.

  3. Sorry for the title gore, but we only recently found out that USCIS has never even received the paperwork we submitted.

We ended up getting Married in September when she arrived, and we're worried she might have to go back to her home country since her visa states it expires November 11th.

What should we do in this case? Is there an expedition process? Is there anything we should prepare for?

We're about to send another batch of paperwork and money order with an overnight ( as well with all the same verification we used before ).

Just  a little shaken up and worried about what's to happen- we don't want to interfere with anything and we certainly don't want ICE banging down our door..

  4. Hello! I'm nearing the final interview with the US Consulate in Sydney Australia.
My questions are, How long is the interview?

Does it go for more than one day?

Or is there possibly someone I can contact to find out? (I guess calling the embassy directly is best?)

I'd like to know so I can plan my flight and hotel around this.

    Thank-you!

  5. Hello,

just wanted to make sure I was filling out our visa journey timeline correctly on the K1 side of things and to verify we’re on the right track.

Apologies in advance, as I’m on mobile.

We started our K1 Visa Process back on September 14th, it arrived at USCIS on September 21st.

We then received an NOA2 March 19th.

April 2nd is when we received an email from the NVC stating our case was expedited.

After filling out the DS160, isn’t fiancee was requested to fill out information on April 3rd to

    http://cdn.ustraveldocs.com/au/

I paid the fee, and got the receipt. Currently waiting to find out more.

I’m not sure if we’re currently waiting for anything to come to her door, or if we’re waiting for an email confirmation?

The consulate requested an email as well once we were done.

I was also unsure about certain forms such as the affidavit of support and if that need some to be sent to her for the interview with all of my pay stubs, or if that’ll be used for something else?

We have also run into the issue of being unsure of where to get her medical done within Australia as the form she presented to her doctor was expired and couldn’t be filled out by him. Not to mention it was requiring information by a physician? Not sure if it’s going to happen at the embassy or if it needs to be done before.

Thanks in advance for the help!

  6. So I wanted to give an update on the situation, as I've done multiple background checks and had nothing show up- so I had wondered if my record even existed.

So due to the even happening when I was 14, the event was dismissed, sealed and expunged- and I recently did a biometrics check with the FBI and received results showing that there was nothing on my record whatsoever.

However, one thing I also noticed, is none of my paperwork ( pertaining to the event that happened when I was 14 ) has a Social Security Number attached to it- and also on forms that specifically ask for one.. I don't have anything listed. I didn't end up getting a Social Security Number till AFTER the event happened and everything was sealed when I was 16.

Not sure if my information helps anyone at all- but I sure hope it does!

So I've actually been reading over these as it still had me wondering about actually reporting the offences and if it would have to be the extraordinary circumstances waiver on the I-129f.

You're also everywhere on this forum, thank you for your reply!

  8. Hello, I apologize in advance for my formatting errors and possible auto-corrects, I am currently on mobile and have been trying to wrap my brain around this issue.

When I was 14 ( 2008 ), I had an inter-family problem, which I'm not here to debate the case, because that doesn't matter- but the results show me as being charged with: Sexual Assault in the Second Degree. ( A.C.A. § 5-14-125(b)(2), Class D felony )   I was found guilty under circumstantial evidence.

I was not put on the sex offender list. Or registered as a sex offender.

I completed probation, Psychiatric therapy, and the dismissal was approved in 2008.

The case was also expunged and sealed.

However, this was over 10 years ago now, and I have been scared and unsure of what to do.

The immigration attorneys in my area I have contacted have been useless in the assistance of understanding what is needed and can not assist me.

They did not know whether this is subject to AWA, and if it still needs to be disclosed if it has been dismissed.

I have been trying to get my fiance here to the US, as she is from Australia, and we were currently working on a K1 Visa for the past few months. ( No paperwork has been submitted yet. )

I would hope someone could assist me in this process, and I hope to know if there's anything I should be doing.

    Thank You.
