  1. So my husband and I went to the interview this morning and we had our son with us and a translator in the room as well. The whole interview was around 30 minutes. They got our marriage certificate, birth certificate for our son, rental agreement for our apartment, photos of our little wedding,   And after the whole thing was over with the lady said she’s not making a decision now but we’ll hear from them within 90 days. If anyone has anything new to share please let me know!

    To get an SSN, just go to the local Social Security Administration (SSA) and apply for it. They will need their passport w/ visa and potentially a printout of their I-94 (https://i94.cbp.dhs.gov/I94/). They must apply within the first 76 days of entry, or else wait until they get an EAD or green card.

    I wasn't born in the USA and I have a green card...

  3. so I my fiancé has finished his ds160 and submitted it, he's waiting to go to the doctor for his medical exam,I have sent in my money and waiting to hear back so I can continue and fill out affidavit of support and my ds 261, have I missed anything and to anyone who has already gone through this process is there anything I've missed or should be doing as well? thank you for any help

    K-1 petitions are given new case number and being sent to the embassy by NVC, only spousal visa are processed by NVC. Some people get those two process mixed up.

     

    At NVC they give your petition new case number and forward it to US embassy of your choice for final processing. I suggest reading  your country US embassy site for further instructions. Your status here https://ceac.state.gov/ceacstattracker/status.aspx should be “in transit” or “ready”. After US embassy receives the petition they will send you necessary information by mail. 

     

    Generally as a beneficiary you need to fill form DS-160, pay MRV fee to be able to schedule an interview. 2 weeks before your interview you should have done medicals by a panel physician listed by your embassy. Each country might be a bit different so that’s why I suggest reading informations at the US embassy site or wait for your letter! Good luck! 👍🏻 

    im not the beneficiary my fiancé is, but we got our case number from nvc today and now I'm just confused as to what I should do I'm being told that my fiancé needs to fill out ds261 then ds160 and pay for fees but I'm not sure in which order

    It is confusing wording.  It just means who should be the primary person to get the subsequent correspondence. 

     

     It can be the petitioner, beneficiary, or an attorney if you have one.  They just want to know who is doing the hands on work and responsible for the case to completion.  The petitioner and beneficiary get cc'd either way. 

    oh ok thanks but I still don't know the next steps what do I do now that I have this case number?

    I agree you are looking at a LONG time. Especially from a MENA country.  I hope you understand that.  Your husband will not be in america to see the birth of your child unfortunately.  He will probably get put in AP as well.  I just want you to mentally prepare for that ahead of time

    whats an AP??? and how long are we talking? because the approval was nov 29 and I haven't heard anything from the nvc yet but I received NOA2

The NVC should send you a letter that says they sent your fiances case to thier state/city where they will go for thier interview. (I still havent got this letter!) That could take up to 4-6 weeks.     Right now all you can do is gather the documents needed for your fiancé to take with them to the interview. Below is copied information from this site! Good luck :) 

     

     

     

    What to send to your fiance once the I-129F is approved (Receive NOA2): 
    1.    A copy of the entire I-129f package (that you made when you sent the petition in) and a copy of information that you sent back due to an RFE (if you received one). Your fiance should review this information in advance of the interview (the embassy will have copies of this as well).
    2.    Send copies of the documentary proof that you submitted with the I-129F for your fiance to have on hand for their interview at the embassy. Your fiance should review this information in advance of the interview (the embassy will have copies of this as well).
    3.    Send an original letter affirming your desire to marry your fiance and your continued support of the K-1 Visa. Sign and date the form. This will be similar to the letter you provided with the I-129F, but dated much closer to the interview (it will have most likely been several months since you submitted your I-129F).
    4.    I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence. Begin collecting the required information ahead of time, as it can often take several weeks to collect it all.
    5.    You will need several items (for the above form). Gather duplicate evidence of income and resources as appropriate: 

     

    (A) Statement from an officer of the bank/financial institution with your deposits, identifying the following: 1. date account opened; 2. total amount deposited for the past year; 3. present balance 
    (B) Statement(s) from your employer on business stationary showing: 1. Date and nature of employment; 2. salary paid; 3. whether position is temporary or permanent (also include copies of your last two pay stubs and your previous W-2 for the associated employer if available) 
    (C) If Self Employed: 1. Copy of last income tax return filed (or IRS transcripts); or 2. report of commercial rating concern 
    (D) List containing serial numbers and denominations of bonds and name of record owner(s). 

    Begin collecting these ASAP after your NOA2 arrives. See this FAQ for more tips and useful information on the Affidavit of Support Form.
    6.    A copy of the NOA2 that you received in the mail. (backup information; the embassy will have copies of this as well)
    7.    Proof of your ongoing relationship. This needs to be taken to the interview!

     

    Include photos, travel documents, emails, online chat logs (pick several over the prior few months), etc.. from between the time you filed and present (NOA1 until date-now).

    Examples: Copies of land line and cell phone bills, appropriate emails and letters you have sent including the stamps on envelopes (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

     

     

    I just got back to the USA NOV 29 (same day as our approval) and had our baby dec 10 and I haven't been working and don't have a bank account so I filed my mother for the affidavit of support is that the right thing to do considering I'm not working and don't have a bank account; ill open one up eventually but with a newborn right now isn't the best time to get a job..

  8. We got our approval on November 29th 2017 for a k1 finance visa, I'm in the United States pregnant and waiting for him to come here. Just wanted to know what I should be expecting in the upcoming weeks and how to best prepare myself and help him through the process as well. I know that theres the ds-160 form and he has to go get a medical and all that stuff for his interview but what else should I be preparing for? I was also curious about when my letter from the NVC will arrive and what it will say on it, should I call the NVC before I receive the letter or after or will they only send it to me after I call? PLEASE AND THANK YOU FOR ANY HELP!!!

    Sounds like you have everything. Did your parents wrote a letter for you yet? Or any close member of your family? Did you sent at least 15 pages of your continuing communication?

     

    His brother and uncle wrote that they were present at our engagement ceremony but my parents didn't write a letter, no. Also we didn't send any thing of us communicating bc we both ended up breaking our phones and losing proof.

    1) Depends on what is the RFE is about. If it something simple like forget to tick a box, it will take around a week. For more complicated matters, it will take around 2-3 weeks.

    2) After they receive your RFE, if everything is good to go, they will issue a Notice of Approval (NOA2).

    3) What you can do now is just wait. If you are the beneficiary, start to gather all documents needed (such as police certificate, translated birth certificate). You can start fill up the I-134 too and gather all the petitioner W2 and tax return.

    Proof of our relationship; we sent in pictures, letters, hotel bookings, receipts also im pregnant so we sent in a doctors note and all that. So around 2 to 3 weeks?
