nearly three months because my fiancee had received a RFE (Request for evidence) because she forgot to sign a part of the form and so additional 2 weeks were delayed from our side. You should be approved in 2 months from the day you received your I-797C receipt

2 months? i doubt it..there are still alot of june filers who haven't received their NOA2.. but im still hoping for that.. thank you :)

Wait a second....am sorry i confused you...i thought you applied for AOS.....

You applied for I-129F in August and you received your  Receipt mail (NOA1) and next you will have to wait for the Approval of your I-129F(NOA2) petition which will take about 2 months from filing. After you receive the NOA2 mail the NVC will send a NOA3 to your fiancee's country where the US embassy/consulate is located and they will get ready with the visa process. The US embassy/Consulate will send a Packet 4 to your fiance's mail(to his house) in which it will show what documents to bring to the interview.

thank you!! how long did you wait before the petition got approved?

  3. my fiance received an email from USCIS and says our application has been routed to California Service Center for processing and will received an official receipt in 7-10 days. That mean our check was ok till my fiance voided it. so it doesnt matter if your not that specific putting name on the check. my question is why are they going to process our case if the check was voided?

It 100% does NOT matter what you put on that check. They WILL cash it and if the check has been cancelled the file will be returned to your fiance for lack of payment.

If you want to avoid delays DON'T cancel the check.

If you want to delay your process then canceling the perfectly good check WILL delay it for you.

Please listen to the members here.

If you he has already voided the check then you should wait until he gets the packet back.

Do not send another file until the old one is returned or he will just create more problems

You don't want 2 files in the system.

how long do you think it will take to return our packet?

Not for nothing the USCIS hotline is also called the "misinformation hotline". THey also told everyone of the February filers that used the outdated forms that they were going to return their packages since they needed the new forms. Didn't happen. Everyone who was a few days over the expiry date still had their forms processed just fine without anyone having them get returned. I personally would've not voided the check but just waited it out to see whether they would still accept it.

i know, but we just wanted to make sure everything is right and knowing something went wrong in our application, were just worried about wasting more time..

People answering phones are not USCIS officials making decisions. They have told dumb stuff to a lot of people on VJ and they have also told people the wrong thing. The person basically told you that if something is wrong they will return your package. He or she did not agree with you nor looked at your file. They have no information in front of them.

i understand what are you trying to say, but  my fiance have already voided the cheque.. can we just send another application and updated cheque?

Personally, I don't think they would return the papers for writing "Home" instead of "Homeland"........however, if he successfully voided the check before they cashed it, I think your only option is to send another copy of everything and an updated check because they WILL return everything for a lack of payment..........just my opinion....others might disagree....

well, that is our plan.. i just wanted to make sure were doing it right. gathering all he documents is stressing.. and waiting is even more stressing. we dont wanna waste anymore time for this to get done... i hope everything goes well..

If the problem with the application is the wrong name on the cheque, they cannot cash it and return the papers. If they cash it, it means they will continue with the application and the mistake was not big enough to prevent them from cashing it.

yeah i understand but sinced my fiance called the uscis customer service and they told him they will return the papers, can we just start over, send another copy of our application and updated cheque? thank ya'll for answering back..

  9. so, my fiance sent in our k1 application last saturday which was the 5th of august and figured out the the name we put in our cheque was just US department  of home security instead of US department of homeland security. he called uscis customer service and says they will return our packet as soon as they recieved  it and see whats wrong. i just checked the tracking number and they already recieved our packet today but we havent heard anything from them (i know its too soon). so my fiance went to the bank to void the check instead of waiting for the papers to arrived. since we he made 3 copies of our documents  can we just send another one for our application?
