Anyone else is having a tough time to wait like my case? Visa available on April 2018 but still have not heard anything from USCIS My daughter will soon to be 21 year old in October this year.
I'm so frustrated.
-
Thanks @geowrian. I was doing research about the timeline between USCIS vs NVC and was thinking USCIS would have done a better job
So i guess even the visa is available for my daughter (according to April Visa Bulletin) we are still waiting for the decision on I-485 (which could take to 10 months)?
She will soon turn in 21year old on October 2018, when do you think we need to consider for CSPA submission? Or i guess her age will be frozen in April ( when her visa is available) and so no CSPA is needed?
Thanks again for your input.

I also have a friend who also sponsor for her child-under 21 (Outside the US) through NVC. Same PD as mine, April 2016. However, They already have received interview letter for April 24 2018.
What am i missing here? My daughter is in the US and we submitted I-485 in October 2017, and i assume our case would be faster compare to whom staying outside the US and have to go through NVC.
I'm really frustrated at this time. Please help.
Note: Visa will be available in April

Hi All,
My PD 04/11/2016 (F2A-Unmarried child). Legally staying in US, already submitted I485 and biometric done in October 2017. I'm sorry that if i have asked this question before but i want to have a solid answer .
Should I receive IL soon since they are working on April applications? Or USCIS will take time to approve my I485?
Please let me know if you know the process because i'm nervous and checking mail everyday. THANK YOU!

Can't wait...PD 04/11/2016 for F2A minor children

There is no where saying how long you can stay out of the country. However, if you stay outside more than 6 months, custom agent can refuse your entry with a valid reason. Recommend to apply for re-entry permit which give you 2 years.
-
Yes i believe you are protected until July 2018 by CSPA. i hope they will freeze your age by the time your visa is available (not 100% sure)
-
@geowrian. Is this gonna be the same process as 10 year GC (for spouse) and they will decide whether the interview is needed or GC will be sent to us directly?
@Hassan Jadoon. DOB is 10/06/1997. I hope you are right IL will be sent end of Feb.

Hi all,
PD 04/11/2016 F2A GC father sponsor unmarried children under 21 (lives legally in the US since then). We have been submitted AOS through USCIS few months ago. From March visa bulletin, look like the final action date will be in April for April visa bulletin, meaning visa is available.
What is next? Are we expecting the interview letter in March, or it would take few more months to process AOS?
Thank you.

So i guess your PD is 05/04/2016. Final action date for March bulletin maybe at 03/31/2016. Hopefully, your visa will be available before 07/01/2018 where you are protected by CSPA. I believe they will stop counting your age at the time your visa is available.

Hi,
His previous employment is not caused a red flag or does everything else. Its likely because you are GC holder and so his chance of getting B2 visa is rare. He has to prove to CO that he has tight to his country and wont stay after in the US. For you being GC holder, CO will assume you will sponsor for him to stay in the US and that's the risk.

@Michael2017 Hi. any predictions for March Visa Bulletin?
-
In order to know if CSPA can be applied, we need more info such as PD date, I130 approved date and DOB of her daughter.

By any chance you know which field office my case fallin to? Would i withdraw the case?. Or i can do parallel with my divorce process because technically im qualified through 3 years rule. I'm not trying to treat the system, but in VA we have to legally separate for 6 months before getting divorce. Thank you for your quick response.

Hi everyone,
I have applied for Naturalization through getting married with a U.S spouse (3 years). My latest status from USCIS is "Case is in line for an interview" since September 26, 2017. Things happen and we are getting a divorce. Will that affect my naturalization process? below is my timeline for N-400:
Receipt: 07/14/2017
Biometric Notification: 07/21/2017
Biometric Compete: 08/11/2017
Latest Status from USCIS page:
Case is in line for an interview.
On September 26, 2017, we started the interview scheduling process for you form N-400, Application for Naturalization, Receipt Number NBC*007961534. We will send you an interview notice. Please follow any instructions in the notice.
I live in Virginia, The receipt show Lee's Summit, MO USCIS office so i'm not sure how to search the processing time under which field office. Please help.

2 scenarios for timeline. It would take around 1 year max if your parents stay outside the US. I guess around 4- 6 months if the parents are inside the US while processing the paper work.
-
I'm still confused how you are in college without a valid status? I know some people here with a tourist visa but convert to F1 so they can stay here. How could the school issue you any paper work if your status is not valid? I would recommend you to find an immigration lawyer and ask them to help on your case.
-
Apology for the incorrect answer above. @geowrian is 100% correct. you can file i-485 for AOS while you are in the US. I was confused with the timeline. Either you are in or outside the US, the final action date is the date when USCIS/ NVC starts schedule you for an interview.
-
I130 is still not approved after 1 year? that's interesting. I assume max waiting time for current i130 is 6 months.
I don't think the info below is correct. Either you are in or outside the U.S, you can start filing I485 for AOS. The only difference is the timeline, USCIS will take care of your process when you are in the US, versus NVC will cover it while you stay outside the us and so the process may take longer.
Final Action dates is when both USCIS and NVC starts on your case for the interview process.
On 1/21/2018 at 2:30 AM, geowrian said:Are you inside the US? If so, then you can that chart starting February 1st to file an I-485 for AOS.
If you're not in the US, then you have to interview abroad for a visa instead. That goes by the final action dates as shown on the visa bulletin: https://travel.state.gov/content/visas/en/law-and-policy/bulletin.html

The main point is the daughter needs to remain unmarried for the entire time while processing the paper work.
-
You have to check with USCIS link below:
https://www.uscis.gov/visabulletininfo
Each month they will decide which chart to use for AOS

My child has been stayed in the U.S since 2013 as F1. I become GC holder and currently sponsor for my child. And so yes i think they would ask my daughter about her school.
p.s: Is there a list of common questions for Minor Children F2A?
-
I think you will be fine. At least you still have few extra months (time took on I130 approval) from your 21st birthday. CSPA will protect you from that.
-
I assume it took 2 months for your I-130 to be approved? if so CSPA only protects you until you turn 21 + 2months (I-130) = 04/31/2017 + 2 months= 06/31/2017. Your visa wasnt available for your category until November 2017
I think this is the reason why they will move you to F2B

Hi All,
I received an email from NVC with the subject: Your immigrant visa case was expedited.
Can someone please explain to me how this happened since my daughter is in the US and we applied through the USCIS.
Thank you.
