I received my letter today! I guess it was faster for me because I live in Orange County and the California service center is in Laguna Niguel.

    Notice date: 12/23/2020

We have completed a preliminary review of the application or petition listed above. As part of standard processing we transferred your case to the USCIS office listed below that has jurisdiction over your case. That office will notify you in writing when they make a decision on your case or if they need additional information.

National Benefits Center, Lee's Summit, MO

From what I've seen from Texas service center cases being transferred there, there's usually an approval in two months, I hope this is the case for us, too.

Same case here i just got the mail stating my case being transferred to same NBC and i am July filer.

    1. Your assets would need to be really high, and yes a one come amount placed in savings would likely be questioned. If she works below poverty level where did the money come from? I'm sure if she could prove that, for example, she won the lottery, maybe it would be different. Otherwise she obviously has help from friends/fam and why couldn't they be a co-sponsor?

    2. Is your biological mothers husband a US citizen? He HAS to file taxes and all his back taxes to be a sponsor. It's also questionable to use one of your relatives as a sponsor, maybe it would look like your family is trying to get you there instead of it being a real relationship.

    3.  I will admit I don't know any rules on whether or not foster care counts as income - I would say no. It's not money she gets for babysitting, it's money for the child's expenses. And if it is a dependent the child should have been mentioned and she will need to be above poverty level for a family the size including the child.

m sorry i need to correct myself here m the beneficiary and in 1) point as she is below poverty line here i put wrong she is below income requirement as per her last income tax she files $14911 but we need $16240. but we have some assets like her car and some in bank too.

nd  in 2) i need to correct myself saying that its her biological mother and step dad. and do we need to fill i864 form if we go for co sponsor sperately ???

  5. Hi everyone,
    1) My fiancé's tax return for 2016 is less than poverty level. If we don't want to have cosponsor, is it possible to go with savings or it is risky? How the savings should look like? If there is a big deposit will it look suspicious?

    2) if not can i  put my biological mothers husband as my co sponsor will it look good. he owns good assets but due to disabilities he don`t file tax returns will it be ok and we need to fill i-864 form separately right???

    3) i have one more query that she is adopting her sisters son which is in process and  who is dependent on her but we didn't mentioned him before on any other form if we mention him on i-134 will it be ok ??? and she is getting income from state as foster care too can we take it as income but no taxes are deducted from it can we add it too to count income requirements..???

guys plz helps us out we need ur help...

looking forward for your all replies

    thank you

Correction - You need to show income or assets or a combination of the two at a 100% level of the poverty line for a K-1 visa - not 125%.  If you use assets, they need to be five times the poverty line or five times the difference in income and the poverty line.

In 2017, the poverty line for a household with 2 people is $16,240.  So, you would need approximately $6,645 in assets - ($1,329 x 5).

However, you will need to meet the 125% requirement only a few months later when you file for the green card, after getting married.

This explains it fairly well -

The amount of savings (assets) you need depends on the difference between your fiance's income and 125% of the poverty line.  What is his income amount?

Why would there be a big deposit?  Be careful here, if you are talking about having someone else deposit money into an account temporarily for immigration purposes and then withdrawing it later on, you might run into legal ramifications.

If you have a cosponsor, your cosponsor needs to prove they have income that meets or exceeds 125% of the poverty line.  Cosponsors cannot use assets to qualify.

as per her last income tax she filed $14911
