  1. Hi there... 

    So we had cc complete last week and they said we had a checklist for my SO not quite earning enough (We just got back from a year of travel and he is restarting his career) 

    However we have way way over the asset ammount in cash. All of the bank statements and proof were sent to NVC but they said it's down to the interviewer to decide. Has anyone else taken assets to prove affidavit of support to the interview? Don't nvc send all the documents to the embassy? 

    Any info is helpful... 😀 thanks

    Tell me about it. When I received the approval letter from USCIS after 6 months of waiting I thought I was done and the rest was just formalities. Here we are another 6months already. I don't even know what to tell my folks anymore as everyone did the Happy danse when I told them that everything was good after the approval from USCIS.

    Really... what are they asking from you ?? Not sure why they give people check list when you send everything they ask for...

    We finally agreed to try it. So I will let you know what happens, we basically sent the AOS paperwork,  On the I-485 it asks for a current petition/case that is already pending. 

     

    In the instructions is said we could include the NOA2 for our I-130 or send with it pending. 

     

    To be honest I have no idea how we are supposed to do it. I guess the new petition is our way of telling USCIS that we are changing. 

    Woweeeeeee that's exciting... but also nerve wracking with people going on about the new apparent aos rule.... wishing you well and I'm glad you have no more separation 😍 x Yes let me know how you get on... 

  4. Curious to your case... how do you aos when you already started cr-1. Do you have to wait for your noa2 approval first?? Have you informed uscis about your change??

    Just a question regarding change of address. We used our friends address for our initial paperwork for i-130 (cr-1) as my husband didn't have his own home yet. We are 8 months into waiting for noa2. But now he has a place, shall we change it now or wait for after noa2. I didn't want anything to get mixed up or lost. But as we are also waiting so long we thought if we change it now it might mean our paperwork is processed faster as someone must have to look at our paperwork to change the address. Any thoughts on this ? Or have we been waiting so long that I'm imagining all sorts  of ways to get our noa2 in the mail asap 😀😀 This patience drives us crazy. Anyway it's serious question whether we should wait or do it now.

This is why there are several service centers etc. because there are so many people to handle. Yes - the i130 sometimes takes longer than the usual 6 month process but the CR1 spouse visa is the fastest route so consider yourself lucky! There are plenty of people who are family members that have to wait YEARS like 5/10+ years before being accepted. Whenever you are stressed out remember that and count your blessings :) In the meantime - make sure you have all your other documents sorted for the NVC stage.

     

    The next step is the NVC stage. Check out this site and read it like a bible in order to prepare everything. Good luck!

    Whoops yeah... I got a little stressed there. You're right.. it doesn't help. But it sometimes gets to us no matter what stage of the process we are.

    I'm early Jan too.. sent on 11th recieved on 17th. Feeling so disheartened now. Really thought it would be almost finished by now. 😐 Fingers crossed for you. Maybe our case is in the same pile I think someone super slow...... 😥

    I don't necessarily think it's fair to just decide to AOS bc you're here, as there are many people who are longing to be with a loved one and don't have the luxury to visit and decide to adjust, but since you didn't plan on it, you're more than welcome to legally do so :-)

     

    You won't be able to change your application, so essentially you'd be starting over (back of the line, if you will) but if not working and not travelling won't be a concern for you, and you're prepared to be here long term, then why wait?  The only thing you're out is the filing fee, as you'll have a new one to submit.

    That's fair...and again thanks for the info. Life is on hold for everyone as we have no certain answers. 

    But I assume every single person waiting would do it if they could. We all want to be together sooner rather than later. I wish for everyone a speedy process, but sadly it's not the case. 😢 Its just something we are considering depending on the process and steps....

    I've already filed the i-130.. been waiting 6 months for it already, and I can travel no problem. I'm just worried I might not be let in next time as I have already spent a lot of time here in the last 2 years.. just simpler to adjust instead of the cost of back and forth with the worry...

    You can wait here and submit the i-485 when the i-130 is approved, but you can't work until you submit AOS/EAD/AP and get your EAD/AP card, so an additional 3-4 months after submitting AOS. AOS also costs an additional $1225.

    If you wait the process out in the UK until you get your spousal visa, you won't need to go through AOS and you'll be able to work right away.

    Thankyou for the info..Yes I am aware we won't be able to make the wedding but he can understand this is a big life change for us.. ..

  11. Hi guys.. 

    I've been looking for the info but not really sure how to go about this. 

     I came with my new husband for a 2 month visit to CA, with no plans to AOS. As my brother is getting married in uk in august and we have other things happening. However... having arrived here, and then preparing to head back for these events we realised we don't want to keep putting life on hold and ready to make a life here in San diego. The wait for our i-130 is at 6 months already and  it's looking like it will take much longer to complete. So my question is, can we change our application to AOS? I-130 has not been approved as of yet. Do we cancel it and start again ? Or just wait for approval and then AOS

    Still waiting for the hard copy in the mail to find out exactly what it is they want. I heard that USCIS have 60 days to approve the RFE. I hope it is only 2 weeks :( 

    Oh no dina... hope itshe taken care of quickly for you. Maybe it's my turn any day now... x
