Again, that's my point. YES, WE Know - so from our PERSPECTIVE, we can't imagine what the delay is. So we are left to speculate. And since, apart from this forum, no one seems to have any answers, the speculation is definitely not positive. Of course we don't expect the government to take our word for it, but what I am saying is that their process is messed up. Do the due dilligence, but don't tell people they are approved and or indicate that it will take 3 to 10 business days to return the passport when that just isn't the case.
-
How would I know how the process works beyond what is published? How would I know that it takes 50 days to do a name check. That's why I came to this forum because when I inquire to the Counsulate, they don't give any answers. So I don't understand why I am expected to know something that they wont tell me. That's silly. But I do appreciate the insight everyone is giving me. Obviously, I know I am not a terrorist and my fiance knows She is not a terrorist, so from our perspective, we can't imagine what the hold up is.

Ok. Thanks everyone. If I find out anything I will post. I did contact my US Congressman and if he finds out anything, I will post that, too. Finally, to this: "They don't care about people being understanding. Their job is not to make you happy. Their job is to protect the US." Treating people with respect and dignity is how you protect the US. Patriotism flourishes when people feel their government actually cares about them.
-
So why tell people they have been approved when they haven't actually been approved? All it does it create an expectation. It takes 50 days to do a name check???LMAO. They are only just now doing a name check? Cross referencing what???? Also, I don't think giving me specific information about my case would pose a danger to the United States. I don't think it poses a threat to say, "Hey, we are double checking you bank statement, this should take about a week"....
-
That's my point. They didn't do background checks the previous 4 or 5 months? They are only doing background checks now after already telling us she was approved? What exactly does a background check consist of and how long does that take? It shouldn't require 50 days. What kind of additional review? Review of my tickets and hotel receipts? Review of our pictures and documented conversations? What exactly, is the action and how long does it take? I think this is the reason so many people get upset. If they would just be specific and indicate what the issue is, people would be a lot more understanding. Why must they keep everything shrouded in mystery. Why update a case and not indicate what the update was? So maybe some of these experts on here can shed some light on what they are actually doing instead of just saying they have thousands of cases to do. I already know mine is not the only case, but that doesn't help me at all.

She was told she was approved (common experience) then put on AP which is over 50 days now. Basically, my question is: what are they actully doing in AP. They have had all the documentation for months. She passed the interview. What is it they are a doing that requires 50 days or more or is this just a case of paperwork sitting on a desk and they get around to it when they get around to it. Can anyone explain to me what the AP is?
-
Hey, I didn't come on here claiming to be an expert. I am just a regular person just like you that had a question about my case. I got an answer (thank you everyone) and am now dealing with the "new" issue I am faced with. So forgive me if I am a little bit challenged by the news . . . . Im sure I am not the only person here disappointed and upset about this process. No, I don't know how many thousands and thousands of applications they get each month. I don't know anything about the inner workings of this. What I do know was my fiance had her interview more than 50 days ago, they said she was approved (after having all the documentation for months) and apparently it takes more than 50 days to press a stamp in a passport. If they had bothered to answer any of my questions, maybe I would know why it takes 50 days or more to stamp something they said was approved. But thank God for this site, which gave me more answers than they did. And since some of the people here already know everything, I am sure their input with all these government witll improve the process. LOL

We are already planning the next 3-4 months. It doesn't change the fact that no one seems to be pleased with the process which means there is a lot of room for improvement.
-
LOL. I think most reasonable people, who put all this time, energy and money into this would deserve to have some questions answered instead of just sitting in limbo for weeks or months on end. You can't even TALK to any real person when you make an inqiury and when you inquire online using their form you get a total of 280 characters to lay out your case and ask your questions. That's ridiculous.

Very good points. But that doesn't mean they couldn't communicate better. Everyone i know is overworked and underpaid and stressed. Imagine if our standards were so low that nobody ACTUALLY cared about anyone, to the point where there is no real communication.
-
Yes.I know. They do not understand that this is people LIVES and all the emotion and everything that is involved. Or if they do understand, it is of no consequence to them, hence all of their "canned" replies and responses.

She can get a tourist visa and go to Budapest with me, but from what I understand, she can not come here now AND got to Budapest because she wont be able to re-enter the United States.
My important life events are happening one way or another, so of course we are trying to plan to experience them together. We knew imigration isn't a fast thing and once we made the decision to get married and go forward, we did our due diligence and proceeded in a timely fashion knowing that there was a possibility we could make it all work. Springrain22 - I'm sorry you have been away from your wife for a year. That sucks. But these next 2.5 months for me are critical to a lifelong dream of becoming a world champion. As a single dad, business owner, and elite athlete leading up to this moment, these are no ordinary 2.5 months. My fiance and I will of course survie this, but this forum gives me a chance to express what I am going through to people who understand this process and this experience.....
-
Thanks for all the helpful information. I am currently ranked #2 in the world in my age group/events and have a chance to become a world champion and set a world record. Obviously I want my fiance to be there for that moment. But another 2.5 months is really, REALLY, disappointing for us....
-
Actually, 2.5 months is a lot. We had originally expected to finish this process by the end of march so that my fiance could be with me for the launch of my book and my appearance on Good Morning America. She missed that. After that she missed my speaking tour. After that she missed watching me win three national championships. She missed a lot of really once in a lifetime events that we wanted to share. All that happened in a month and a half. Meanwhile, it's been almost six months since we have been apart. Lots of lonely nights, sexual frustration, etc. Tomorrow is NOT promised to anyone, so another 2.5 months when the anticipation of getting married and starting a new life has been extreme - 2.5 months is a lot of time. Meanwhile, all of this has an affect on my training and performance, so deciding what to do is going to be a big decision.

Yes. I was aware about the driving and working and that is not a problem. I just didn't realize the K-1 is a single issue visa... and the implications.
-
I misread the question. We could wait for her to come to America AFTER Budapest, I suppose, but that would mean another 2.5 months of being apart and we haven't seen each other since November of last year and we are getting kind of desperate to be together as you can imagine. If her visa and passport get issued in the next week or so, how long is it valid? How long does she have to enter the United States?
-
-
No. It is for an athletic competition. Why can't she?
-
Greetings,
Our K-1 Visa Application has been approved and we are 50 days in "AP" waiting for the visa and passport to be issued. We expect that to happen anytime now, and as soon as that happens, she will come from China ASAP. In August, we are planning a trip to Budapest. Will my fiance be able to leave the US and then return? Will there be any problems? What will we need to do?

No. The "Immigrant Visa Case" that was updated an entered Administrative Processing on May 11th was updated again today (the 18th) but still says "AP"...
-
So now the CEAC site says the case was updated today (May 18) but still in AP...... ???? How is the case updated and yet the status the same?

I am in the same boat! Here's our timeline:
The I-129 Petition was received by USCIS on September 28, 2016 .It was approved on January 25, 2017 (and valid until 5/24/2017).According to the CEAC website, on February 8, 2017, an "Immigrant Visa Case" was created. It was received by NVC on February 16, 2017On March 23, my Fiance had her K-1 interview at the Consulate in Guangzhou, China and was told her application was approved. Two days later she was asked to submit her original divorce certificate. On March 24, a "Non-Immigrant Visa Case" was created. (Note: a second application/case number was created)On, March 31 my fiance gave the required documentation and CITIC comfirmed that they were received on April 3.On April 12 the US Consulate in Guangzhou stated that they received the required additional documentation and would process visa immediately. On May 11, the "Immigrant Visa Case" was updated an entered Administrative ProcessingOn May 16, the "Non Immigrant Visa Case" was updated to "Application Received"It has now been over 50 days and still we have heard nothing and my fiance has not received her passport.
Can my Fiance travel outside the US after she arrives

Wow! I am surprised by a lot of the comments here which basically is: "we went through this pain, to so just be quite and deal with it like the rest of us." I thought this was a discussion forum so I am discussing my case. Some of the comments and information has been helpful, some hasn't. I am not blaming USCIS or anyone for anything, We have followed the rules and I am quite proud of me and my fiance's effort to navigate this complicated system on our own. We made it this far. I think some of you forget that at one time, you, too, did not know all of the stuff you know now and that all of what you learned you learned as you went through the process. I am not an immigration lawyer, so I didn't know all of the intricacies. Imperfect knowledge, yes. Poor planning - well that's your judgement. We were just two people in love doing our best to get married and create a life together. Not skilled and seasoned adversaries to a government beuracracy
I wasn't asking anyone to give me specific answer to my specific case, but I did have some legitimate general questions. No, I did not know about the details of the Advanced Parol and the I-485, the I 131 and the I 765 but now I do. Unfortunately, there won't be enough time for that. Yes, we will just have to wait the extra 2.5 months, disappointing as that is. I know those of you who have loved ones can empathize. It wasn't my aim to get on here and rant or rave about anything - Im just responding to all the comments in an open and honest way and I am not afraid to expose my real experience and what I am thinking or feeling.
My word of advice to some of you: please remember what it was you experienced when you went through whatever it was you went through. Probably it was or would have been nice if someone talked to you and helped you in a way that wasn't condescending.
